UTILITY EASEMENT
Richard K. & Melody M. ZaideL of 1014 S. 6th Avenue, Bozeman, Montana, GRANTORS, in
consideration of$ 1.00 and for other and valuable considerations, receipt of which is acknowledged,
grant to The City of Bozeman, a municipal corporation of the State of Montana, with offices at 411
East Main, Bozeman, Montana 59715, and other public and/or private utility providers,
GRANTEES, their successors and assigns, a perpetual utility easement for the use of the
G-RANTEES, in, through, and across a strip ofland situated in Gallatin County, Montana, seven (7)
feet wide to be located on the following described real property:
The south seven (7) feet of the vacated east-west alley in Block 19, Capitol Hill
Addition, City of Bozeman, Gallatin County, Montana, which is adjacent to Lot 18
(inclusive ofthe west half ofthe vacated original north-south alley), Block 19, of said
Capitol Hill Addition.
The casement is more particularly described as follows:
A strip ofland seven (7) feet wide which is contiguous to and south ofthe following
described line: Beginning at the southwest corner of said Lot 18, thence northerly
along the west line of said Block 19 a distance of 25 feet to a point on the centerline
of the east-west alley vacated by Ordinance No.l..5A..O...., the true point of beginning;
thence easterly along said centerline a distance of 150 feet to a point on the west line
of the north-south alley opened by Ordinance No. 642, the end of the easement.
The GRANTORS states that they possess the real property described above and that they
have a lawful right to grant an easement thereon.
The GRANTORS further agree that the GRANTEES may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding upon
the heirs, executors, administrators, personal representatives, successors, and assigns of the parties
hereto.
