UTILITY EASEMENT
Nancv C. Characklis, of 3390 Summer Cutoff Road, Bozeman, Montana, GRANTOR, III
consideration of $ 1.00 and for other and valuable considerations, receipt of which IS
acknowledged, grants to The City of Bozeman, a municipal corporation of the State of Montana,
with offices at 411 East Main, Bozeman, Montana 59715, and other public and/or private utility
providers, GRANTEES, their successors and assigns, a perpetual utility easement for the use of
the GRANTEES, in, through, and across a strip of land situated in Gallatin County, Montana,
seven (7) feet wide to be located on the following described real property:
The north seven (7) feet of the vacated east-west alley in Block 19, Capitol Hill
Addition, City of Bozeman, Gallatin County, Montana, which is adjacent to the
east 75 feet of Lot 19 (inclusive of the west half of the vacated original north-
south alley), Block 19, of said Capitol Hill Addition.
The casement is more particularly described as follows:
A strip of land seven (7) feet wide which is contiguous to and north of the
following described line: Beginning at the northeast corner of said Lot 19, thence
southerly along the west line of the north-south alley opened by Ordinance No.
642 in said Block 19 a distance of 25 feet to a point on the centerline of the east-
west alley vacated by Ordinance No. 1540 , the true point of beginning;
thence westerly along said centerline a distance of 75 feet to the end of the
easement.
The GRANTOR states that she possesses the real property described above and that she
has a lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEES may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions ofthis easement shall extend to and be binding upon
the heirs, executors, administrators, personal representatives, successors, and assigns of the parties
hereto.
