NOVEMBER 18, 1997
MINUTES
Members Present: Dave Skelton, Larry Woodward,Neil Poulsen, Craig Brawner, Al Scholes,

Chairperson Dave Skelton called the meeting to order and noted that the first and second items
will be switched in order. He handed out comments on the Aspen Meadows aka Harvest Creek
Major Subdivision. He discussed them briefly.
A. FINAL WEEK REVIEW(Discussed second during the meeting)
1. Kagy Crossroads MaSub Preliminary Plat#P-9751 - (Saunders)
NW corner of South 19th Avenue and Kagy Boulevard
- A Major Subdivision Preliminary Plat Application to subdivide 21.64 acres
into 1 multiple family residential lot on property zoned"R-4" (Residential,High
Density) and 9 commercial lots on property zoned "B-2" (Community Business).
John Marks, owner and developer, and Rob Bukvich, Montana Department of Transportation,
joined the DRC. Public Service Director Phill Forbes joined DRC. Planner Chris Saunders
reviewed the application. There are 8 code requirements and 7 recommended conditions. (Staff
reports are on file in the Planning Office.)
Mr. Marks asked about the access from S. 19th Avenue that is being denied(#6). Planner
Saunders explained the reasons.
Project Engineer Rick Hixson presented his department's comments. He will provide the
applicant with finalized comments later today as this is a working document at this time. He
reviewed his standard requirements and required conditions. Mr.Marks asked for an explanation
of the water line sizing and noted that his model was calculated for usage an average day. Mr.
Hixson noted that when the City calculated the sizing,the engineers used a maximum daily flow
plus the 3,000 cubic feet for the fire line.
Streets/Sanitation Supervisor Roger Sicz reviewed his conditions and recommendations.
Mr.Bukvich asked if sidewalks were being required on South 19th Avenue. Mr.Hixson replied
yes. Mr. Marks asked why he was being required to install sidewalks when the City has no clear
notion what south 19th Avenue will look like in the future. Discussion followed on the sidewalks
requirement. Mr. Hixson noted the City has a preliminary design for S. 19th Avenue. City
Engineer Craig Brawner noted that the grades on Kagy Blvd and South 19th Avenue will not
change. Mr. Bukvich noted that the two intersections will be improved to a standard street
section. Mr. Marks asked if they would be required to upgrade South 19th Avenue to a 5-lane

street. W. Brawner noted that the City is requiring this development to provide road surface to
meet the needs of this development. Discussion continued on this issue.
Mr. Bukvich noted that this plan needs to take into consideration what this street will look like in
the future so the street and water/sewer don't have to be tom up to make further improvements.
Mr. Bukvich and Mr. Marks discussed the need for a center lane. Mr. Bukvich asked to be a part
of the review of the street improvements and the signal installation for the intersections at Kagy
Blvd./South 11th Avenue and Kagy Blvd./South 19th Avenue. Discussion ensued on right-of-
way issues.
Water/Sewer Superintendent Larry Woodward reviewed his standard and recommended
conditions.
Deputy Chief, Fire Operations, Al Scholes reviewed his condition. Mr.Marks asked if WQB 1
and UFC codes are different requirements. Mr. Scholes noted that because of the types of units
being proposed, his department calculated the maximun requirements.
City Engineer Craig Brawner noted there is an issue with the cul-de-sac being located on a lot.
He disucssed the problem with that kind of cul-de-sac and getting the curb and gutter in later.
Mr. Marks commented on the issue.
Mr. Marks asked about the required installation of a full standard street on Remington Way. He
has approached the Evangelical Free Church about paying for half of the street. He doesn't feel
he should have to pay the cost of the curb and gutter for their share. Mr. Brawner noted that
won't be an issue as the City will require paving from back of curb to 32 feet from his side of the
street. He also noted it will cost the church 20-25%more if the improvements are done with an
SID. It would be cheaper in the long run for them to cooperate with Mr. Marks and do their
share of the improvements when he does his.
Planner Saunders noted there are other two properties or vacations that need to be considered.
Mr. Marks asked if the City would consider condemnation of property for the easement/right-of-
way for the extension of Remington Way. Discussion of that issue followed.
Mr. Marks noted that his traffic study shows that the middle access point is usable. He doesn't
want the City to decide that it shouldn't be used. He discussed his reason,noting the traffic study
shows that a right in/right out access would be appropriate. Planner Saunders noted the study
doesn't address the timing for restricting the access. Mr. Hixson noted that the primary purpose
of an arterial is not to provide access. Mr. Marks noted that this access meets the most restrictive
requirements. Discussion continued on the accesses.
Planner Saunders suggested moving the grocery store from Lots 1,2, and 3 to Lots 4, 5, and 6.
Mr. Marks noted that the grocer wants access to South 19th Avenue and that grocers now want 5
acres for a store. Mr. Brawner asked how the location of the store affects the traffic flow. Mr.
Marks explained he plans to submit easements for a driveway with curbing to control stormwater.
Mr. Bukvich noted a concern is the speeds there are 55 mph, and until a signal is installed at Kagy

Blvd, and South 19th Avenue, it will continue to be a concern.
Mr. Marks asked about the level of service and what level of improvements are required for a
level of service C, and not less than service level D. Mr.Brawner discussed the requirements. He
noted the condition will have to be open ended to allow for whatever is approved by City
Commission. Mr. Marks noted that if they have to spend $300, 000 to install the signal at Kagy
Blvd. and South 19th Avenue, then the project will be dropped at this time. Mr. Brawner noted
that Mr. Marks does understand where the City stands.
Mr. Forbes noted the subtle issue of the triangluar piece could be a problem. Planner Saunders
noted that code requirements are for Remington Way to be extended with this kind of project.
Discussion followed on these issues.
Mr. Woodward asked about the difference in conditions on fire hydrants from water and fire. Mr.
Brawner noted that Mr. Woodward and Mr. Winn will need to collaborate to get their conditions
to correspond. Mr. Forbes commented on the middle access fron Kagy to Lots 1, 2, and 3.
Mr. Scholes moved to recommend conditional approval as per DRC conditions and modifications
to the Planning Board, with final engineering comments which are being compiled as we speak.
Mr. Hixson seconded the motion which carried 8-0.
B. FIRST WEEK OF A THREE WEEK REVIEW (Discussed first during the
meeting)
1. Spain Homestead Park Minor Subdivision, Lot 4,MiSP/COA#Z-97171 -
Haley Springs Road (Olsen)
- A Minor Site Plan Application with a Certificate of Appropriateness to
allow the placement of an existing barn structure on a foundation,modifications of
the structure converting it into warehousing/office spaces, and the installation of
related site improvements.
Planner Jody Olsen presented the application. She doesn't expect many comments from DRC, as
it is behind American Furniture Warehouse,which is on the edge of the Jurisdictional Area. She
explained she intends for this review to be an FYI notification for DRC. Project Coordinator
Kirsten Emborg noted the architect applied for a building permit several weeks ago. The DRC
concurred to see this application one more week.
C. FIRST OF TWO WEEK REVIEW
1. Vosti Annexation (aka Manley Annexation)#A-9706A- (Saunders)
689 Manley Road
- An Annexation Re-Application in accordance with State Law for the
former Manley Annexation.
Planner Chris Saunders presented the application and noted the changes made since this parcel
came in as the Manley Annexation.

D. INFORMAL REVIEW CONTINUED
1. American Bank Informal#I-9758 - (Skelton)
1612 & 1632 West Main Street
- An Informal Review for advise and comment on site improvements.
Brian Tolsedt joined DRC. Chairperson/Planner Skelton reviewed the application. Public
Service Director Phill Forbes asked about the effect of the parking on the neighbors. He noted
that the parking was what derailed the Re-Use application. He suggested that Planning Staff be
an advocate and help resolve the parking/through-traffic problem with the bank and Beaver Pond
Plaza. He is concerned that parking will be on Main Street. Mr. Tolstedt noted that Mr.
Erickson has not talked to the Patagonia people as of yet. He will be sure to discuss it with Mr.
Erickson.
Planner Skelton discussed the type of submittal he expects.
City Engineer Craig Brawner asked about the number of parking spaces. Mr. Tolstedt noted the
parking area behind the smaller building will probably have a gate across it. Discussion followed
on the egress driving aisle and the elimination of one parking space to permit the access in a
different location.
Rob Bukvich, Montana Department of Transportation, wants to know where the approaches are
for Main Street, noting there is a potential conflict for cars from both directions wanting to tam
left at the same point. Mr. Tolstedt noted where the existing and proposed accesses are located.
He discussed drainage issues that have to be resolved.
Planner Skelton noted that the site plan needs to show where the egress/ingress points are located
on this and adjoining properties. He suggested eliminating the parking in the rear of the smaller
building. Mr. Brawner noted that the parking problem needs to be addressed. Planner Skelton
noted the Planning Office may require a perpetual parking agreement. Mr.Brawner suggested the
site plan show parking on the property to the west. Mr. Tolstedt commented on the suggestions.
As there was no further business,Mr. Brawner moved to adjourn the meeting, Mr. Woodward
seconded the motion, which carried 8-0.
