HomeMy WebLinkAbout11-12-1997 DRC Minutes DEVELOPMENT REVIEW COMMITTEE NOVEMBER 12, 1997 MINUTES Members Present: Al Scholes, Larry Woodward, Dave Skelton,Karen Finke(for Craig Brawner) Staff Present: Chris Saunders, Debbie Arkell, Kirsten Emborg, Carol Schott Visitors Present: Rob Bukvich, John Marks, Brian Tolstedt,Dennis Balian Due to technical difficulties,the meeting was called to order at 10:10 by Vice-Chairperson Al Scholes. A. ONE WEEK REVIEW 1. Yellowstone Peaks Manufactured Home Park #P-9650 - (Arkell) 2700 Block of West Babcock - A one week review of an approved Preliminary Plat to reconsider condition #7, which requires West Mendenhall Street to be extended to the east. Dennis Balian joined the DRC. Assistant Planning Director Debbie Arkell explained condition#7, which is the condition to be modified. She noted that the Gallatin County Sheriff has advised Mr. Balian to stay off Mr. Heidecker's property as he may be trespassing. She noted that there are 3 items to be considered, she described them. Senior Planner Dave Skelton asked if City Attorney Paul Luwe had commented on the possibilities. Planner Arkell noted he had. She noted that this section of road is not necessary for a secondary access. She recommends that the DRC delete the second paragraph of the condition. Planner Skelton noted that the DRC would defer to City Engineer Craig Brawner and Public Service Director Phill Forbes. Engineer Karen Finke noted that Project Engineer Rick Hixson has approved the deletion of the condition as secondary access is provided in another area. Mr. Balian noted he has done everything he could to comply with the condition. He had dug out the roadbed and was proceeding with the building, since then he has had to refill the area. He noted that the sheriff recommended that he stay off the property until a decision has been made on the easement. He noted that the developer of Wheeler Manufactured Horne Park has developed a City standard street connection to Mendenhall Street and,therefore, condition#7 has technically been met. Planner Arkell noted that a response to Mr. Balian is due today. Planner Skelton moved to recommend that condition#7 be reconsidered, as per the applicant's request,by deleting the second paragraph of condition#7. Vice-Chairperson Scholes seconded the motion, which carried 4-0. Development Review Committee Minutes-November 12,1997 1 B. SECOND OF THREE WEEK REVIEW l. Kagy Crossroads MaSub Preliminary Plat#P-9751 - (Saunders) NW corner of South 1.9th Avenue and Kagy Boulevard - A Major Subdivision Preliminary Plat Application to subdivide 21.64 acres into 1 multiple family residential lot on property zoned"R-4" (Residential,High Density)and 9 commercial lots on property zoned "B-2" (Community Business). Vice-Chairperson Scholes introduced the application. Developer and property owner John Marks and Rob Bukvich of Montana Department of Transportation joined the DRC. Planner Chris Saunders presented the application. Planner Saunders noted that traffic is the biggest concern of the Planning Department. He noted the applicant has presented a detailed traffic study for the build-out of the property. Mr. Marks noted there are temporary cul-de-sacs shown. He and Planner Saunders discussed the need for an easement for the cul-de-sacs from the Aakers. Engineer Karen Finke indicated possible locations for temporary cul-de-sacs. Permit Coordinator Kirsten Emborg asked for the intended use of the properties. Mr. Marks noted they will be one person owned parcels. Mr. Marks and Planner Saunders discussed a condition that will be imposed requiring the extension of the south half of Garfield Street. Water/Sewer Superintendent Larry Woodward noted the City will require a 24 inch water main on the same side of street as it is now and then indicated where tie-ins will be required. Mr. Marks took exception to the requirement as the only place the easement shows up is on a COS, which doesn't make it necessarily legal. Discussion ensued on the future street improvements to be installed by the City and State, which probably will not include turn lanes. Mr. Bukvich noted that State law requires accommodation for utilities be made along roadways. Planner Saunders noted that Mr. Marks would need to make application to the State for the permits for utility locations. Mr. Marks and Mr. Bukvich discussed the accesses. Mr. Bukvich noted the approaches are under the jurisdiction of the City of Bozeman. He continued, the City also maintains both Kagy Blvd. and S. 19th Avenue and the State has an agreement with the City for traffic control devices on those streets. Planner Saunders asked for Mr. Bukvich's recommendation for the shared access used by the two homes. Mr.Bukvich recommended the two homes be accessed from Kagy Blvd. as it is less busy. Discussion followed on the location of the access on Kagy Blvd. and the problems that would have to be solved- shelter belt location and nearness of the access to the property line. Mr. Marks asked if the recommendation would be made next week and if the conditions would be available before the meeting. Planner Saunders noted the recommendation would be made next week and the conditions will be available at the meeting. He and Mr. Marks discussed the easements needed for the lots. Planner Saunders asked if stop signs will be enough for traffic control. Engineer Finke will take Development Review Committee Minutes-November 12,1997 2 the question to Project Engineer Rick Hixson. Mr. Marks noted that the extension of S. 22nd Avenue would run into the Marsh Labs. He recommended extending Professional Drive rather than S. 22nd Avenue and do it with the development of the property west of Tech Park. Mr. Bukvich noted concerns with the private access as it is too close to the intersection. He noted that installation of a traffic light is not allowed by law until it is warranted. Discussion followed on the warrants that have to be met. He noted that Mr. Marks will have to buy some right-of-way to install the north bound turn lane. Discussion followed on the right turn from Kagy turning north. Mr. Bukvich noted that the City of Bozeman will be issuing the permit. Vice-Chairperson Scholes asked for any other comments. Planner Saunders noted that comments will be due next week. C. INFORMAL REVIEW 1. American Bank Informal#I-9758 -(Skelton) 1612 & 1632 West Main Street - An Informal Review for advise and comment on site improvements. Vice-Chairperson Scholes introduced the application. Brian Tolstedt from Locati Architects joined the DRC. Senior Planner Dave Skelton presented the project,noting that a facade change is proposed, and the possibility of ingress/egress questions. Mr. Tolstedt noted the primary goal is to provide a facelift for the property,tie the two buildings together, improve vehicular access, and do landscaping improvements. He also noted that egress in northwest corner has been in the past a shared access with Beaver Pond Plaza and not sure that will continue. Planner Skelton noted the access next to the Red Barn may also be a problem as there is an easement on the east side of Petcetra that may have to be considered. Rob Bukvich of Montana Department of Transportation asked for the changes that are proposed. Mr. Tolstedt noted the existing curb cuts,proposing to consolidate two accesses into one, and sharing an access with Beaver Pond Plaza. Mr. Bukvich noted the State would prefer the shared access. Planner Skelton noted the applicant is interested in curtailing through traffic to Babcock Street. Mr. Bukvich noted some improvements would be required,noting he liked the proposal in general. Mr. Tolstedt asked what would be the consequences if he could not get an agreement for the shared access. Mr. Bukvich noted the lack of an agreement would not hold up the project. Planner Skelton asked about the access to the Red Barn,noting the access may be eliminated with a tentative development to the east. Project Engineer Karen Finke recommended continuing the informal to next week when public Service Director Phill Forbes, City Engineer Craig Brawner, and Project Engineer Rick Hixson would be here. Vice-Chairperson Scholes noted the application will be continued to next week. D. DISCUSSION ITEM l. Holiday Meeting Dates--December 23,December 30???
