MINUTES

Chairperson Dave Skelton called the meeting to order at 10:00 a.m.
A. FINAL WEEK REVIEWS
1. HRDC Headstart CUP/VAR#Z-9744 - (Olsen)
52 North 24th Avenue
- A Conditional Use Permit Application with Variances to allow the
construction of a pre-school classroom building with variances relating to building
footprint, trash enclosure and parking encroachments into required yards.
Planner Jody Olsen reviewed the project, highlighting conditions#2, #6, #12, #13, #14, and#15.
Bill Hanson and John Langenheim joined DRC. Mr. Langenheim asked if the legal agreement
would be given by the City Commission. Planner Olsen noted it would given by them. Mr.
Langenheim asked about the encroachment application/permit. City Engineer Craig Brawner
joined the DRC and explained that the application/permit is obtained from his office. John
McNeil, Parks Department, noted that Mr. Langenheim will have to specify an expiration time as
the permits are usually renewable every 3 years.
Project Engineer Karen Finke reviewed her conditions. Discussion followed on the storm water
drainage calcs. Conditions #144 and#10 were highlighted by Ms. Finke.
Water/Sewer Superintendent Larry Woodward noted his conditions are standard.
Mr. McNeil noted there is no need to have a linear trail in the location shown as it will probably
never be allowed to connect to Kirk Park through Mrs. Lessley's property.
Streets/Sanitation Superintendent Roger Sicz moved, Mr. McNeil seconded, to recommend
conditional approval of the application to the Planning Board and the City Commission as per
DRC conditions. The motion carved 5-0.

2. West Kagy Development MaSub PUD Pre-Application #P-9746 - (Olsen)
SW corner of West Kagy Blvd. & South 1 lth Avenue
A Major Subdivision Planned Unit Development Pre-Application
to allow the subdivision of 14.592 acres into 19 commercial lots.
3. West Kagy Development PUD Concept Plan #Z-97163 - (Olsen)
SW corner of West Kagy Blvd & South 1 lth Avenue
A Planned Unit Development Concept Plan Application to allow a
commercial office development.
Ray Center, Dan Kamp, and Gene Cook joined the DRC. Chairperson Skelton suggested that the
two applications be discussed at the same time. Planner Jody Olsen reviewed her conditions and
highlighted#1, #10, and#11 on the Pre-Application. She noted she had few specific comments
on the zoning issues, however, she highlighted phasing requirements, requests for waivers or
relaxation of the subdivision and/or zoning standards, and requirements addressing criteria that
are applicable for residential and commercial developments.
Project Engineer Rick Hixson reviewed his conditions, adding a point to condition#2: "d.
Improvements to a local street on the south side of the property." City Engineer Craig Brawner
expanded on Water/Sewer condition#1, noting the extension of sewer lines from the South 17th
sewer will be extended using local developer funding and City impact fees. Mr. Hixson continued
with the conditions review. He noted that looping of the water is critical to the development
occurring. Discussion followed on the amount of cover that will exist on the 12" line after
MDOT rebuilds Kagy Blvd. He reviewed the Streets, Curb & Gutter, and Sidewalks conditions,
adding "Address the need for a center turn lane." to condition#1, and "Addressing shall be
indicated on the Preliminary Plans" added to condition#3. He also highlighted conditions #6 and
#9. Public Service Director Phill Forbes joined DRC.
Streets/Sanitation Superintendent Roger Sicz noted that it is mandatory to have turn lanes for
both directions on Kagy Blvd. He noted there will be no parking along Kagy Blvd. and a stop
sign is needed on the south side of Kagy Blvd. on South l Ith. Chairperson Skelton noted that a
pedestrian pathway in the key areas would helpful in identifying the streets.
Mr. Cook asked about the extension of water lines coming down Kagy Blvd.--how far out in the
future will that happen, should they just extend the water main down Lincoln, or wait for the one
in Kagy Blvd., and will there be paybacks. Discussion ensued on the location of the new main to
be extended on 19th to Kagy Blvd. Mr. Woodward noted there is a $100,000 difference in cost
for what capacity is needed for the other development and what the City needs. Discussion
followed on the timing issues, with Mr. Cook noting that 4 or 5 buildings will be going in next
summer if approval is given on this project. He asked, hypothetically, if he could extend the water
line along Kagy Blvd. to South 19th Avenue and connect when the extension comes up 19th
Avenue. Mr. Brawner noted there are paybacks, impact fee credits, etc., that could be available.
Mr. Woodward added that, aside from Fire Marshal Chuck Winn's concern with fire protection,
he is not going to approve a large expansion in this area until a looped water line is installed. Mr.
Brawner suggested if the 12" were extended to connect to the University Condo/Remington Way
main, that would address the fire and looping concerns.

Chairperson Skelton asked Planner Olsen, that due to the complexity of the comments, to put
together the comments and run them by the committee members before sending them to the
applicant and his representatives.
B. SECOND OF TWO WEEK REVIEW
1. Gateway (Aspen Meadows)MaSub Pre-app #P-9748 - (Skelton)
N of the intersection of Hunters Way&Durston Road- Gateway Annexation
A Major Subdivision Pre-application to subdivide 148 acres into 410 lots
for single family development.
Keith Belden, Tim Howard, and Bruce Foley joined the DRC. Chairperson/Planner Skelton
reviewed the notes from last week. He asked for the name of the subdivision. Mr. Belden noted
it is Harvest Creek. Planner Skelton asked Mr. Belden to include Greenway and North Meadows
subdivisions on the location map included with the Preliminary Plat. He reviewed his comments
for consideration in preparing the Preliminary Plat Application.
City Engineer Craig Brawner concurred with Planner Skelton's suggestions on the streets. He
noted that on the north end of the project they are pushing the 1200 foot block length limitation
also. Discussion followed on the alignment of the infrastructure on this subdivision and the two
subdivisions to the north. Mr. Belden discussed the location of the pole line, noting that half is on
Lane's property and half on Harvest Creek. Mr. Belden noted that an adjustment in the location
of the comer utility pole should be made now to prevent having to offset North 27th Avenue at
Oak Street. Mr. Brawner noted that North 27th Avenue and Oak Street should be developed
with this project. Mr. Belden noted he would submit the topos showing the location of the
utilities prior to the Preliminary Plat submittal. He noted that he and the City Engineering
Department could then discuss the street locations. Fire Marshal Chuck Winn joined DRC.
Planner Skelton noted this project will go before the City Recreation Board Thursday night. Mr.
Belden noted he would attend if it was a public meeting.
Water/Sewer Superintendent Larry Woodward noted several missing items and noted the phasing
doesn't work with the infrastructure. He noted he did a chart showing the amount of
infrastructure needed for each phase. Mr. Brawner noted the plans need to show just exactly
what infrastructure is phased and what is to be installed up front.
Mr. Belden asked about the routing, sizing, and cost sharing possibilities of the sewer extension
for this project. Mr. Brawner discussed those concerns, noting that if Mr. Belden provides the
calcs for the capacity needed for this development, the City usually pays the cost of the over
sizing. Mr. Woodward noted the sewer is shown on the wrong side of the road. Discussion
followed on the sewer trunk its location.
Parks Superintendent John McNeil noted that his comments will be better made after the Rec
Board meets.
Planner Skelton noted that if Annie Street and Durston Road are to be dedicated streets, they
need to provided the dedicated right-of-way with this application. He noted they the easements
for the two streets are part of the Annexation Agreement which are scheduled the City

Commission's November 17th agenda.
C. FIRST OF THREE WEEK REVIEW
l. Kagy Crossroads MaSub Preliminary Plat#P-9751 - (Saunders)
NW corner of South 19th Avenue and Kagy Boulevard
A Major Subdivision Preliminary Plat Application to subdivide 21.64 acres
into 1 multiple family residential lot on property zoned "R-4" (Residential, High
Density) and 9 commercial lots on property zoned "B-2" (Community Business).
Plans were forwarded for comment on October 27, 1997.
John Marks joined the DRC. Planner Chris Saunders presented the application. One question to
be resolved is the access for the Payne property onto the extension of Kagy Blvd. There exists a
single shared access for two existing homes. One home will be demolished and the location of the
access for the remaining home will have to be determined.
City Engineer Craig Brawner asked about plans for the sewer main extension. Mr. Marks
discussed the plans and the future possibilities. He noted that he is not showing the extension of
South 22nd to the northern boundary. Discussion followed on the water main location along
South 19th Avenue and street cuts that will be needed to provide water service to both sides of
the street. Water/Sewer Superintendent Larry Woodward explained the looping needed to
provide a secondary water source for this development. Mr. Brawner noted that the more tie-ins
there are to the water mains, the better the City is able to service a development.
Streets/Sanitation Superintendent Roger Sicz noted that the intersection at South 19th Avenue
and Kagy Blvd, will need a traffic signal before the development is built out, noting it will become
the number 1 accident intersection when this development is built out. Planner Saunders noted
the traffic control needs can happen in concurrence with the traffic study. Mr. Brawner asked if
turn lanes are shown. Mr. Marks noted the locations of the turn lanes. Mr. Brawner noted that
when a certain level of traffic is reached, the project that throws it over that level has to fix the
traffic problem.
D. SECOND WEEK OF TWO INFORMAL REVIEW
1. Hell Roaring Brewery Informal#I-9733 - (Saunders/Strahn)
820 Front Street
- An Informal Review for advise on the re-use and re-development of the old
Northern Pacific Depot as a micro brewery/pub/restaurant. Plans were forwarded
with October 28, 1997 DRC agendas.
Jim Horan and Al Borrego joined the DRC. Planner Chris Saunders presented the review. He
noted that the applicants distributed questions last week, then he shared his comments and
answers to those questions.
Project Engineer Karen Finke reviewed her comments, highlighting#10, noting all the others are
standard comments and requirements.

Discussion ensued on the deferment of the installation of the curb & gutter and sidewalks until the
location of Front Street could be determined. Mr. Brawner noted that an easement would be
required rather than a dedication of the right-of-way. He explained the requirements for curb &
gutter and paving of the street.
Streets/Sanitation Superintendent Roger Sicz asked how other streets in the area will be affected
by this development. He is concerned that people will come in from Broadway rather than
traveling to Wallace. Discussion ensued on the use of the triangular property across the street by
Customized Services trucks. Mr. Sicz noted a concern with traffic movement and parking.
Planner Saunders explained the two review processes that will be required for this project -- MiSP
and CUP, noting that each will give the DRC the opportunity to review parking, streets, etc. Mr.
Horan noted that they intend to leave green spaces and not develop the whole area for parking.
Water/Sewer Superintendent Larry Woodward noted he tried to answer all of the questions or
refer the applicants to someone who could answer them.
Mr. Horan asked about the fire code questions. Fire Marshal Chuck Winn reviewed his concerns,
noting that he and Mr. Poulsen toured the building. He noted it would be a good use of the
building.
Mr. Winn moved, Mr. Sicz seconded, that the meeting be adjourned. The motion carried 7-0.
