HomeMy WebLinkAbout10-21-1997 DRC Minutes DEVELOPMENT REVIEW COMMITTEE TUESDAY, OCTOBER 21, 1997 MINUTES Members Present: Larry Woodward, Craig Brawner, Al Scholes, Phill Forbes,Roger Sicz,Neil Poulsen Staff Present: Chris Saunders, Debbie Arkell, Jody Olsen,Rick Hixson,Karen Finke, Carol Schott Visitors Present: Joan Rudberg, Jerry Gaston,Mark Iwaniak, Jack Ranieri, Gene Graf, Greg Gianforte,Ray Center, George Gibson, Ken LeClair, Jerry Taylor, Frank Cikan Chairperson Dave Skelton called the meeting to order at 10:00 a.m. A. DISCUSSION ITEM 1. Site Plan Boiler Plate Conditions - (Skelton) Chairperson Skelton led the discussion on the new boiler plate conditions. The new conditions will need further tweaking. City Engineer Craig Brawner noted that the goal is to address what has to be done to obtain Temporary Occupancy and when Final Occupancy can be granted. He noted the problem is with the granting of Temporary Occupancy. Streets/Sanitation Superintendent Roger Sicz wants the contractors to clean up the streets during and after the construction. He'd like the clean up to be a requirement worked into the new conditions. B. ]FINAL WEEK REVIEW 1. Gianforte Density Amendments ZCA#Z-97156- (Saunders) A Zone Code Amendment Application to amend the residential densities to change the definitions to allow calculations for"net" densities. Greg Gianforte joined the DRC. Planner Chris Saunders gave an overview of the amendments noting there are three parts to the application. He asked for written comments and there were none. 2. Crescent Valley MiSub #P-9744- (Arkell) Coiner of Babcock Street, Ferguson Avenue and Fallon Street A Minor Subdivision Application to create 3 lots from a 21.37 acre tract. Ken LeClair and Frank Cikan joined the DRC. Assistant Planning Director Debbie Arkell reviewed the application and her conditions. (All DRC conditions are on file in the Planning Office.) She noted the improvements Mr. LeClair proposes to install during the first phase including streets and infrastructure. City Engineer Craig Brawner asked about the sewer and water to be added. Planner Arkell noted that condition#5 states that all water and sewer infrastructure will be installed for the subdivision. She continued with the review of the conditions. Mr. Brawner discussed the funding of the traffic signal at Ferguson and U.S. 191. Ray Center joined DRC. Discussion continued on the funding of the traffic signal. Public Service Director Phill Forbes suggested a change in wording to "funded solely by state or federal Development Review Committee'Minutes-October 21,1997 1 funding". Project Engineer Rick Hixson reviewed his conditions,noting that most are standard. Discussion ensued on the condition regarding the issuance of building permits and the completion of the streets. Planner Arkell noted that the developer is contemplating phasing the subdivision. Phase 1 is the north-most and south-most lots. Mr. Brawner was concerned with fire department access. Planner Arkell noted that is a Site Plan issue. Mr. Brawner and Mr. Hixson discussed the conditions in regard to phasing and noted they will need to change their conditions to refer to the phasing of the subdivision. Mr. Hixson continued with his review of the conditions. Water/Sewer Superintendent Larry Woodward noted that his condition#4 covers the bottleneck that exists north of Kountz Mobile Home Park and noted that a capacity study will be required. Mr. LeClair asked about the traffic analysis required in Mr. Hixson's condition#9. Planner Arkell noted she is concerned about requiring a traffic study at this phase. She noted it could be picked-up with the Site Plan. Public Service Director Phill Forbes concurred. Streets/Sanitation Superintendent Roger Sicz moved, Mr. Hixson seconded, to recommend conditional approval of this minor subdivision. Carried 6-0. 3. Crescent Valley MaSP #Z-97158 - (Arkell) Corner of Babcock Street, Ferguson Avenue and Fallon Street A Major Site Plan Application for residential condominium and office development on Crescent Valley Minor Subdivision. Mr. LeClair, Mr. Center, and Mr. Ciken remained with the DRC. Assistant Planning Director Debbie Arkell reviewed the application and the conditions. Streets/Sanitation Superintendent Roger Sicz noted that curb will have to be installed on Ferguson. Planner Arkell noted it will be done with the subdivision. Project Engineer Rick Hixson reviewed his conditions. He noted that#13 can be stricken as Planner Arkell has covered it. He added#14 to required a detailed traffic analysis prior to final site plan approval. Water/Sewer Superintendent Larry Woodward reviewed his conditions. He noted he will change #5 and #6 to reflect the location of the meters to be detailed on the building permits. Mr. Hixson moved, Chief Building Official Neil Poulsen seconded,to recommend approval as per the conditions of the DRC. The motion carried 6-0. Interior Home & Bath MiSP/COA#Z-97148 - (Olsen) Rawhide Ridge and North 19th Avenue A Minor Site Plan with a Certificate of Appropriateness Application to allow the construction of a 9,000 square foot retail and warehouse building and related site improvements. Gerry Gaston, George Gibson, Jack Ranieri, and Mark Iwaniak,joined the DRC. Planner Jody Olsen reviewed the application. She noted that this is the second week even though the DRC saw this application for first week review almost a month ago. She noted there is time for an additional week for review if needed. She reviewed her preliminary conditions. Discussion followed on the path easement and paving and the location of the 50 foot corridor easement. Project Engineer Rick Hixson noted that the water line isn't there yet. He asked about the location of the sewer line. Mr. Iwaniak noted he researched the location of the line and where it is stubbed at the Clerk and Recorders office. He noted they may have to install a lift statinon. Mr. Gaston asked where to tap into the service line. City Engineer Craig Brawner noted that would probably be best. Discussion followed on the sewer and water. Mr. Gaston noted they plan to put in water lines connected to a well, to be disconnected and connected to the future City water line. Mr. Woodward noted that is possible if the lines built to City standards and inspected by the City, Chairperson Skelton asked if there needs to be a waiver for annexation. Mr. Brawner noted there is a waiver already in place for the whole Simmental/Gardner Park subdivision. Development Review Committee Minutes-October 21,1997 3 Mr. Gaston asked if this was the first or second week of the review. Chairperson Skelton and Planner Olsen noted that this is the second week review and next week will be the final week review. Planner Olsen reviewed conditions from other governing entities. Mr. Gibson asked if the City will required hookup to water where it is available. Public Service Director Phill Forbes noted that they will be required to hookup when City water is available. Discussion followed on the handicapped parking. Mr. Hixson asked about the drainage arrows from the loading dock. Mr. Iwaniak noted the drainage will flow into an existing swale. Discussion followed on the retaining wall to be constructed. 2. Chuckwagon Chili MiSP/COA/Dev. #Z-97159 -(Olsen) {Revised info included 720 South loth Avenue with this packet} - A Minor Site Plan/Certificate of Appropriateness with Deviations application to allow the demolition of the existing building and the construction of a 1700 square foot restaurant and related site improvements. Jerry Taylor joined the DRC. Planner Jody Olsen reviewed the applciation and her preliminary conditions. Project Engineer Rick Hixson noted that a two-way driveway aisle is required to be 24 feet wide. On these plans it scales to be 21 feet. City Engineer Craig Brawner asked about the location of the approach. Discussion followed on the width of the drive aisle and the probability that drivers will park to the side of the driving aisle while picking up the food. Chairperson Skelton asked if this could be a potential solvent site. Mr. Hixson has also heard that some dumping has been done on this site. He noted that the City Attorney will want some sort of indemnification agreement that eliminates any liability for the City should the site be contaminated Water/Sewer Superintendent Larry Woodward asked for the size of the water line to be installed. Discussion ensued on what will happen to the existing water line during demolition and reconstruction. Mr. Woodward noted that the size of the water line has to be on the final site plan and impact fees for water and sewer will be calculated on the size of the water service. Chairperson Skelton noted that DRC will make a recommendation to the City Commission next week. D. INITIAL WEEK REVIEW 1. HRDC Headstart CUP/Var#Z-9744 - (Olsen) 52 North 24th Avenue - A Conditional Use Permit Application with Variances to allow the construction of a pre-school classroom building. Planner Jody Olsen presented the application,noting it is the same project as seen several weeks ago, with improvements to address the concerns of that time. Discussion followed on public use of the fenced in area of the park. Discussion ensued on the parking requirements and signage of Development Review Committee Minutes-October 21,1997 4 the temporary space. City Engineer Craig Brawner suggested an alternative parking arrangement. 2. West Kagy Development MaSub PUD Pre-Application#P-9746 - (Olsen) Comer of West Kagy Blvd. & South 11th Avenue A Major Subdivision Planned Unit Development Pre-Application Application to allow the subdivision of 14.592 acres into 19 commercial lots. Planner Jody Olsen presented the application. Chairperson Skelton referenced the Dan Figgins memo of long ago that Gene Cook refers to which allows him to do some development without further improvements to the infrastructure. Streets/Sanitation Superintendent Roger Sicz noted there will be a need for traffic control on South 11th and Kagy. He thinks the light at South 19th and Kagy may be triggered by this development and a street on the south boundary is necessary. Chairperson Skelton noted that South 11th is a proposed arterial extension. Discussion ensued on the need for a traffic light at South 1 lth and Kagy. DRC concurred that sidewalks, curb, and gutter will be required along Kagy. City Engineer Craig Brawner noted that all interior streets are proposed to be private. 3. West Kagy Development PUD Concept Plan#Z-97163 - (Olsen) Corner of West Kagy Blvd& South 1 lth Avenue A Planned Unit Development Concept Plan Application to allow a commercial office development. Planner Jody Olsen presented the application. Discussion ensued on the extension of South 15th to connect with Willow Way. City Engineer Craig Brawner noted that something is amiss with the alignment of South 15th and Willow Way as shown. For the Good of the Development Review Committee: 1) City Manager Clark Johnson joined the DRC to discuss two issues. The City Commission had a problem with the wording of conditions that came forward to them from the Planning Office. Last week some of the conditions were changed between the DRC action and the meeting with the City Commission. City Engineer Craig Brawner noted that the planning staff usually has to meld several departments' conditions into one condition. He noted that usually the planner runs the melded condition past each staff member concerned. Chairperson Skelton suggested a boiler plate summation of the resources required to meet the needs. Mr. Johnson asked for specifics as to what the service is now, such as -plowing every 3 days - and what it will be when the new streets are in service - once every 4 days. Mr. Johnson noted conditions that state there will be too great a burden placed upon a department don't mean anything without validation. He'd like more explanation of why it is a burden. Chairperson Skelton suggested discussing it for the next two weeks or so at DRC. 2) Chief Building Official Neil Poulsen noted that the left turn lane at Babcock and Rouse is a major problem. Drivers aren't following the signage and drive straight through the intersection Development Review Committee Minutes-October 21,1997 5 instead of turning, Streets/Sanitation Superintendent Roger Sicz noted that it is signed per code; people just aren't following the signs. Discussion continued on this problem and other similar situations. Mr. Hixson moved, Deputy Fire Chief Al Scholes seconded,that the meeting be adjourned. The motion carried 6-0.
