TUESDAY, OCTOBER 14, 1997
MINUTES

Chairperson Dave Skelton called the meeting to order at 10:05 a.m.
A. FINAL WEEK REVIEW
1. Valley Glass and Windows MiSP/COA#Z-97152 - (Saunders)
20 Rawhide Ridge
- A Minor Site Plan with a Certificate of Appropriateness Application to
allow the construction of a 12,355 square foot structure for retail, office, and
warehouse uses and related site improvements.
Steve and Frank Armknecht and John Sinrud joined the DRC. Associate Planner Chris Saunders
reviewed the conditions from the Planning Department. (All conditions on file at the Planning
Office.)
Streets/Sanitation Superintendent Roger Sicz had no comments.
City Engineer Craig Brawner reviewed the conditions from the Engineering Department.
Fire Marshal Chuck Winn noted he had talked to the Rae Fire Department Chief who stated that
the project will be annexed someday and should be constructed according to City standards.
Assistant Water/Sewer Superintendent Mike Cetalic reviewed the conditions from the
Water/Sewer Department.
Chairperson Skelton noted two new boiler plate conditions will be added to all projects from now
on: 1)All improvements have to be certified by a certified architect to have been installed as per
the final site plan prior to receiving an occupancy permit and 2. A required certification that, at a
minimum, a "rough" finish grade has been completed and is to be certified by architect, especially
retention/detention ponds. He will get the language of the boiler plates to DRC by next meeting.
The applicants had no questions. Planner Saunders moved, Mr. Sicz seconded,to approve as per
conditions of DRC. The motion carried 7-0.

B. SECOND WEEK REVIEW
1. Gianforte Density Amendments ZCA#Z-97156-(Saunders)
A Zone Code Amendment Application to amend the residential densities to
change the definitions to allow calculations for"net"densities.
Susan Gianforte participated with the DRC,remaining in the audience with her children.
Assistant Planner Chris Saunders presented the application. He noted that Staff is in general
support of the application.
Chairperson Skelton noted the reasons for clarifying the densities definitions. Planner Saunders
noted this is an attempt to close a loophole that allows densities to be calculated using gross
acreage,including unbuild able land, in the calculations. He asked for written comments next
week.
2. Crescent Valley MiSub #P-9744 - (Arkell)
Corner of Babcock, Ferguson and Fallon
A Minor Subdivision Application to create 3 lots from a 21.37 acre tract.
3. Crescent Valley MaSP #Z-97158 - (Arkell)
Comer of Babcock, Ferguson and Fallon
A Major Site Plan Application for residential condominium and office
development on Crescent Valley Minor Subdivision.
Ken LeClair joined the DRC. Assistant Planning Director Debbie Arkell presented the application
noting it is a remainder of the Valley Unit annexation that has not been subdivided,noting it is
proposed to be a phased development consisting of residential and office condominiums, with 106
residential units in 56 duplex structures and 9 office structures. She noted that Engineer Rick
Hixson was going to research the sewer line easements.
Discussion followed on sewer easement locations. City Engineer Craig Brawner asked about
sidewalks along the private roadways. Planner Arkell noted the private roads are actually private
driveways, and that sidewalks were not proposed. Mr. Brawner discussed the making of private
vs. public streets and addressing for the units. Mr. LeClair noted he would install maps at the
entrances/exits of the private driveways. Water/Sewer Assistant Superintendent Mike Certalic
asked if all sewer/water infrastructure will be installed prior to construction. It was noted that
would be required. Discussion followed on the required infrastructure during phasing. Mr.
LeClair noted that all infrastructure will be installed at the same time.
Ray Center joined DRC. Discussion continued on the requirements of street improvements
during subdivision. Mr. LeClair noted they will be phasing construction of buildings from both
the north and south towards the middle. He and Mr. Brawner discussed the timing of the
construction of the streets.
Streets/Sanitation Superintendent Roger Sicz noted waivers for SIDS are needed for Babcock and
Ferguson. Planner Arkell reviewed the current SID's they are participating in.
Chairperson Skelton noted written comments are needed next Tuesday.

4. Interior Home & Bath MiSP/COA#Z-97148 -(Olsen)
Rawhide Ridge and North 19th Avenue
A Minor Site Plan with a Certificate of Appropriateness Application to
allow the construction of a 9,000 square foot retail and warehouse building and
related site improvements. (Open and continue pending submittal of
additional information.)
Planner Jody Olsen noted that the engineer for the applicant is planning to submit materials
tomorrow. She noted the second week review will be done next week.
D. INITIAL WEEK REVIEW
1. Chuckwagon Chili MiSP/COA/Dev. #Z-97159 - (Olsen)
720 South 1 Oth Avenue
- A Minor Site Plan/Certificate of Appropriateness with Deviations
application to allow the demolition of the existing building and the construction of
a 1700 square foot restaurant and related site improvements.
Planner Jody Olsen reviewed the proposal, noting the applicant plans to demolish the old brick
building. The applicant is requesting two deviations, 1) outdoor seating and 2) signage.
Streets/Sanitation Superintendent Roger Sicz asked about parking requirements. Planner Olsen
noted there is more parking than required for the four tables that they'll have. Chief Building
Official Neil Poulsen noted they are anticipating mostly walk-in traffic. Chairperson Skelton
noted he is concerned about the retention/detention plan as the grade slopes towards the sheet.
City Engineer Craig Brawner noted his department will require the best that can be done on the
site,however,the drainage looks possible. Mr. Poulsen noted that with a restaurant this small,
UBC would allow one unisex restroom. It has to be ADA accessible. Planner Olsen asked how
wide the sidewalk has to be on the side of the building. Discussion followed on requirements,
with Mr. Poulsen noting the hearing being held on accessibility is changing parking stall width,
site accessibility, etc. He's left a copy in the Planning Office. Mr.Brawner noted that the
dimensions for the drive access, parking stalls, etc. have to meet Code.
FOR THE BETTERMENT OF THE DRC
Mr. Poulsen noted that the State rule change for agricultural buildings requires 4 exits and 2
restrooms. He noted there are several other changes in the rule.
Chairperson Skelton discussed the new boiler plates and what improvements cannot be financially
guaranteed,noting that if the improvements aren't connected to occupancy, the financial
guarantee won't work. Fire Marshal Chuck Winn noted he wants no break-away barriers, gates
and he suggested no Temporary Certificates of Occupancy be issued, as once the buildings are
occupied, it is difficult to get the rest of the improvements done.
No being no further business, the meeting was adjourned.
