MINUTES

Chairperson Dave Skelton called the meeting to order at 10:05.
A. FINAL REVIEWS
1. Barnaby CUP #Z-97122 - (Williams)
1403 Cherry Drive
A Conditional Use Permit Application to allow the remodeling of the
basement into an accessory dwelling unit.
Greg Vidmar and Anne Barnaby joined DRC. Chairperson Skelton noted a recommendation is
needed today for Planning Board and City Commission. Project Planner Christopher Williams
reviewed the one condition from the Planning Department. He noted that the Bozeman Zoning
Ordinance covers other concerns.
There were no conditions from other City Staff.
Fire Marshall Chuck Winn moved, Chief Building Official Neil Poulsen seconded,to recommend
conditional approval to the Planning Board and City Commission as per Planner Williams's
condition. The motion carried 7-0.
B. SECOND WEEK REVIEWS
1. Taco John's MiSP/COA/Dev/Var#Z-97116 - (Olsen)
303 North 7th Avenue
A Minor Site Plan Application with a Certificate of Appropriateness, a
Deviation, and Variances to allow the replacement of the existing Taco John's
building with a new, larger building and increase the parking in the back of the lot.
Richard Knell joined DRC. Chairperson Skelton noted a recommendation will be needed next
week for Planning Board and City Commission. Planner Jody Olsen reviewed the application and
her preliminary conditions, noting that all are standard. She reviewed the variances requested and
noted that two deviations are being requested from the Public Service Director. She noted the
conditions required of the vet clinic across the street, as requested by City Engineer Craig
Brawner, were 1)the sidewalk would be installed in five years or whenever the property to the
south installs them, and 2)waivers of right to protest the creation of SIDs for improvements to

Beall Street.
Public Service Director Phill Forbes asked if the parking lot could be shifted. Mr. Knell explained
how shifting would affect the park area in the rear of the property and how leaving it as proposed
would improve the appearance of the rear of the property. He also noted the access is 16 feet
wide and narrows to a 10 foot driveway. Planner Olsen noted the Planning Office will require
signage to prevent entry from Beall Street.
Mr. Forbes noted the driveway will be difficult to access due to its narrowness. Discussion of
alternatives followed.
Water/Sewer Superintendent Larry Woodward noted a fixture count is necessary to ensure the
water service is adequate.
Mr. Rob Bukvich, Montana Department of Transportation (MDOT), noted that no trees will be
allowed in the right-of-way without permission of MDOT.
2. American Bank Drive-Through MiSP/COA#Z-97131 - (Patterson)
32 North Willson Avenue
- A Minor Site Plan Application with a Certificate of Appropriateness to
allow a new facility with drive through and walk-up facilities.
Bob Gilbert joined the DRC. Planner Dean Patterson presented the application, noting concerns
with queuing space and backing on to the right-of-way. He noted another concern is for the
business across the street whose parking spaces are being replaced by the structure.
Project Engineer Karen Finke asked how storm water will be handled. Mr. Gilbert noted that all
storm water is currently going into the City's storm sewer. He noted there should be less run-off
with the additional landscaping to be installed. He addressed the queuing concern and noted that
they couldn't rotate the canopy as it then wouldn't be the required ten feet from the property line.
Mr. Woodward noted the need for a fixture count to ensure the installation of the properly sized
water service. Discussion followed on the stacking of cars in the drive through, the forecast for
walk-in traffic over car traffic, and the number of tellers.
Planner Patterson asked if there were any fire concerns. Fire Marshall Chuck Winn noted there
were none.
3. Morgan Creek Condos MaSP#Z-97124 - (Skelton)
West Villard Street
A Major Site Plan Application to allow the construction of 40 two and
three bedroom condominiums.
Chuck Hinesley joined DRC. Chairperson/Senior Planner Dave Skelton noted a recommendation
will be needed next week for the Planning Board. He noted one concern is that the plat has not
been filed. Mr. Hinesley noted it is to be filed on September 3, 1997. Chairperson/Planner
Skelton reviewed his conditions. He asked if there were any concerns for the Engineering

Department. Project Engineer Karen Finke and Mr. Hinesley discussed a concern about storm
water drainage. (City Engineer Craig Brawner joined DRC.) Discussion ensued on the existing
sewer main extensions and those proposed and as to when building permits could be issued.
Water/Sewer Superintendent Larry Woodward noted the sizes of the services aren't shown on the
site plan and must be included. Mr. Hinesley noted the sizes will either be I Y2 inches or 1%
inches.
City Engineer Craig Brawner asked Project Engineer Karen Finke about the storm drainage plans,
then explained the impervious area requirements to Mr.Hinesley. Fire Marshal Chuck Winn
asked for the location of the fire hydrants. He asked if there is a site plan that depicts the area fire
hydrants and access roads/streets. He noted it was difficult to visualize how his department will
service the area. Discussion followed on the fire hydrants and street locations. Mr. Winn asked if
T,D, &H could make available a site plan that shows accesses, fire hydrants, and structures.
Chairperson Skelton asked Mr. Hinesley to provide the plan by Thursday for distribution in the
next packets. He emphasized the need for a site plan depicting the development of both lots.
Mr. Hinesley noted he hopes to have the infrastructure plans by next week. Chairperson Skelton
asked that the water and sewer mains and stubs be shown on the site plan also. He asked that
elevations of the garages be included.
C. INITIAL WEEK REVIEWS
1. Interior Home and Bath Informal and Variance#B-9720 -(Olsen)
NE corner of North 19th and Rawhide Ridge
A Variance Application to allow the east setback to be reduced from 25
feet to 0 feet to reduce the building's visual impact on North 19th and hide the
loading dock. (First of a two week review)
Jack Ranieri and Steve Dooling joined DRC. Rob Bukvich joined the Committee. Planner Jody
Olsen reviewed the variance request and the informal application. She noted the property is too
narrow for the 50 foot front and 25 foot rear yard setbacks. She noted it is outside City limits
and City sewer, with no water available, and within the solvent site.
Mr. Bukvich noted that the lot may not be accurately shown. According to Montana Department
of Transportation records the lot should be 154 feet wide. Mr.Ranieri noted their records show
it is 151 feet,which, after allowing for the setbacks,leaves 79 feet for the building. The goal of
the applicant is to hide the loading docks. Mr.Ranieri continued, the applicant needs two docks,
one for pickup trucks and one for semis. Chairperson Skelton noted that parking is tight on that
site.
Planner Olsen asked if the access location would be a problem for Mr. Bukvich. He noted the
access is out of his jurisdiction.
Chairperson Skelton noted the informal application for the minor site plan gives the City
departments the opportunity to comment and discuss any problem areas.
Mr. Dooling noted the setbacks have eliminated part of the lot. He noted the need for a variance
to allow the docks and dumpster to be in the proposed location.

Chairperson Skelton noted waivers for improvements to water mains and streets would be
required. City Engineer Craig Brawner noted several issues to be included on the site plan.
D. INFORMAL REVIEWS
1. Bozeman Inn Addition Informal#I-9750- (Skelton)
1235 North 7th Avenue
- An Informal Application for an informal review of an addition to the
Bozeman Inn.
Mike Gaffke and Mark Iwaniak joined the DRC. Chairperson Skelton noted they are requesting
to vacate a 35 foot wide service drive,which is a leftover from years ago when the plan was for a
frontage road along North 7th Avenue. He noted that City Engineering has approved the
vacation with the stipulation that a 10.5-ft.wide public access easement be given from the
property line. He reviewed the proposal noting the applicant will need deviations and variances
for parking and the front yard setback. He continued,noting there will be no additional units
added or seating added,only the moving of the pool and addressing traffic circulation. Mr.
Iwaniak noted the locations of the accesses former, existing, and proposed. City Engineer Craig
Brawner inquired if sidewalks are proposed. Mr. Gaffke noted they are not a part of this
proposal. Mr. Brawner noted that an easement will be required for the sidewalk. Discussion
followed on the circulation of traffic to Santa Fe Reds. Mr. Gaffke noted a small directional sign
and banner at the new access on the south have been installed to direct people into the parking lot
from the south,rather than have them swing around the median on North 7th Avenue/Oak Street.
Discussion continued on traffic circulation and turning radii. Mr. Brawner suggested widening
the southern access. Mr. Gaffke noted they would have grade problems if they widen it.
Discussion ensued on the exhibits for easements. Mr.Rob Bukvich of Montana Department of
Transportation noted the easement being granted to the State is much larger than is currently
needed and won't be used for at least 10 years.
2. Bridger Peaks Informal-(Saunders)
North 19th Avenue
An Informal Review of one set of plans as an FYI item.
Planner Chris Saunders presented the conceptual plans for the proposal. Chairperson Skelton
noted the only public road shown is Midline Road,there is a need for another east/west public
street. He noted the rest of the interior streets are private with private parking lots. He noted one
concern will be with the ADA path and pedestrian circulation. Mr.Brawner and Mr. Forbes
noted that curb and gutter are to be installed along Oak Street and North 19th Avenue. Mr.
Bukvich noted that the drainage may not work,however, if the City Public Works Director
approves it,he will approve it also.
Discussion ensued on the sidewalks and boulevard. Mr. Bukvich noted that curb, gutter, and
sidewalks are already shown on a typical cross section. Discussion followed on the location of
the sidewalk/pathway within the 50 foot setback to get a meandering walkway away from the four
lanes of traffic. Mr.Bukvich noted there is a new gas line that crosses into private property.
Discussion followed on the signal at Oak Street and North 19th Avenue and what would trigger
its installation.

Mr. Brawner noted the applicant may want to consider a different name for the development as
there currently is a Bridger Center in Bozeman.
3. Chuckwagon Chili Informal#I-9748 - (Skelton)
720 South 10th Avenue
- An Informal Application for advice on the conversion of an existing
structure into a restaurant.
Jerry Taylor joined DRC. He gave an overview of the proposal,noting the existing building will
be demolished and a new structure built. He indicated that seating would be very limited due to
the parking limitations. He asked if the existing approach could be retained. He noted two of the
problems are the sloping of 3 to 4 feet from the building to South 10th and the impossibility of
capturing all of the stormwater and sending it to the northeast corner. Most of the stormwater
will flow into the 10th Avenue storm sewer, as it does now. Mr. Taylor noted the applicant is
requesting to use the alley as the exit and locate the dumpster off the alley rather than on-site.
The applicant is requesting to encroach into the driveway for a temporary pick-up window. He
noted there is a potential for outdoor seating in the south west front yard and asked for any
comments on any portion of the proposal.
Public Service Director Phill Forbes asked if the alley was paved. Mr. Taylor noted it is,
however, it is in very poor condition. Mr. Forbes noted the paving of the alley would be a
condition of approval. City Engineer Craig noted the encroachment of temporary parking in the
driving aisle is a concern. Mr. Taylor noted in reality the customers would be parking along the
retaining wall. He asked if street parking in that area is by permit only. Staff noted it was.
Discussion followed on landscaping of the site.
Chairperson Skelton noted the location of the dumpster on the alley would require a variance. He
noted several deviations would be required, 1) for the driveway to be located in the side yard,2)
for seating to be allowed in the front yard. He continued that a variance may be needed for
parking. Another concern he noted was with drainage areas. Mr. Brawner noted most of the area
is paved,however,repaving would improve the site.
Chairperson Skelton noted there would be a screening requirement from the adjacent residential
property, over and above the existing wood fence.
E. ADVICE AND RECOMMENDATION
1. Sun runner Car Sales Special Temporary Use Permit#T-9708 -(Saunders)
421 North Broadway Avenue
- A Special Temporary Use Permit Application to allow the use of a
property for automotive services and repair, sale of parts, and car sales.
Sparse Miller joined the DRC. Planner Chris Saunders asked DRC to identify concerns with the
Special Temporary Use Permit and for advice on a future Minor Site Plan. He noted Mr.Miller's
business is a very small car dealership. Mr.Miller noted he specializes in Subaru only. He
continued that 20%of his business is car sales,with the major focus being on repair and parts. He
does no painting. Fire Marshal Chuck Winn noted there were several fire and building code
issues. He suggested he,Mr. Miller, and Chief Building Official Neil Poulsen meet on site to

discuss what needs to be done for permanent occupancy. Mr. Miller noted the fire taping is done,
the formax is no longer exposed, and the bannister is installed.
Planner Saunders noted the property lines are vague in this part of town. Mr. Miller noted he will
request a presale survey. He noted that in conversations with the Planning Director,he is
comfortable with the short term Special Temporary Use Permit.
Mr. Miller asked for the difference between the Special Temporary Use Permit and a Minor Site
Plan. Planner Saunders explained the difference. Public Service Director Phill Forbes noted a
concern with backing onto Broadway,Bozeman Municipal Code doesn't allow it and traffic really
moves around that corner. Mr. Miller noted he has considered one way traffic beside the building
and exiting onto Avocado Street. Discussion followed on the distance from the front of the
building to the sidewalk. Discussion ensued on the sight triangle requirements.
Chairperson Skelton noted that DRC isn't commenting on the use of the property, only on the
ability of the property to meet zoning requirements. He noted that section of town was developed
before the current zoning regulations were in effect, and, if the curb and sidewalk were in, there
wouldn't be enough area for the use to exist. Mr. Miller noted that he is improving the property
and preventing the use of it by hobos and kids. Chairperson Skelton noted it is a tough piece of
property to develop due to the size. Mr. Miller noted he doesn't intend to increase the footprint
much, only add a small storage area and an office. He noted he wants multiple locations in
different cities and to use this one as an informational center.
Planner Saunders noted that parking appears to be adequate. The problem is where the property
lines are located. Until the exact location of the property boundaries are known, the parking and
other concerns are difficult to ascertain.
Mr. Miller asked why the property hasn't sold in the last few years. Mr. Brawner noted that the
goal of the City is to get new businesses into Bozeman that can upgrade a site and get it as close
to code as possible. Mr. Miller noted there is a need for signage to slow traffic on that corner.
He accepted the fact that backing onto the street cannot occur.
Mr. Forbes moved, Mr. Brawner seconded that the meeting be adjourned. The motion carried 7-
0. The meeting was adjourned at 12:15 p.m.
