Chairperson Dave Skelton called the meeting to order at 10:05 a.m. He noted a change to be
made on the agenda-item 1 would become item 2 and item 2 would be discussed first.
A. FINAL REVIEWS
1. Swan Falls CUP#Z-97126 - (Skelton)
1915 West College Street
- A Conditional Use Permit Application to allow a phased 2-building,
woodframe,2-story office complex.
Bill Roller and his client joined the DRC. Chairperson/Senior Planner Skelton noted the
conditions from Planning Staff are boiler plate. He continued that a recommendation by DRC is
required on this application to be given to the Planning Board and City Commission.
Project Engineer Rick Hixson reviewed the conditions from the Engineering Department, noting
all are standard.
Water/Sewer Superintendent Larry Woodward noted his conditions are tricky due to the private
sewer. Condition#1 concerns the granting of easements to the City rather than to the landowner.
Mr. Roller noted if they have to place the sidewalk in the standard location, several mature
cottonwood trees and a spruce tree will have to be removed or trimmed drastically. City Engineer
Craig Brawner suggested moving the sidewalk easement farther onto the property and allowing it
to meander through the property. Discussion ensued on the width and location of the sidewalk.
Condition#2 relates to the water and sewer connections and the abandoning of the septic system.
Discussion followed on the location of the water stubs.
Mr.Roller asked about the dedication of the sewer easement to the City. Mr. Woodward
discussed the process. Chairperson Skelton asked what would happen if they don't get the
easements. Mr. Brawner noted they wouldn't be allowed to hook up to the sewer. Discussion
followed on the dedication by Mr. Cowdrey as discussed this morning and the need for TV
inspection of the sewer prior to acceptance of it.
Mr. Hixson noted the approach to the house on College Street would be abandoned in phase two.
He added the bridge would be removed to close the access onto College Street. Mr.Roller's
client asked about the gas lines that are under the bridge and supported by it. Discussion ensued

on how to leave the bridge unaccessible by vehicles, yet carry the gas lines.
Mr. Hixson moved to recommend approval with conditions as per DRC. Mr. Poulsen seconded
the motion which carried 5-0.
2. Prendergast MiSP #Z-97123 - (Arkell)
107 South Church Avenue
- A Minor Site Plan Application to allow the removing of an existing garage
and the replacement with a garage/apartment.
Shannon Prendergast joined the DRC. Chairperson Skelton noted a decision would be made by
the DRC this morning.
Water/Sewer Superintendent Larry Woodward reviewed his department's conditions.
Mr. Prendergast asked about having a separate sewer for the back building. Mr. Woodward
explained his preference for two sewer lines. Discussion followed on the ideal location of the
lines.
Chairperson Skelton reviewed Planning Staff s conditions.
Mr. Winn moved, Mr. Hixson seconded,to approve the application as per DRC conditions. The
motion carried 5-0.
Chairperson Skelton suggested that he and Mr. Prendergast meet tomorrow to discuss the
conditions and the process for appealing any of the conditions to the City Commission.
3. Kids Clubhouse CUP#Z-97121 - (Olsen)
1612 West Babcock Street
- A Conditional Use Permit Application to allow a daycare for 28-35
children in an existing building.
Vice-Chairperson Chuck Winn continued the meeting. Lisa Buchanan joined the DRC. Planner
Jody Olsen reviewed the conditions from Planning Staff. She noted that two variances are being
requested, one to allow the parking lot surface to be gravel and the other to allow parking in the
side yard. She noted some landscaping will have to be added to satisfied Code requirements. The
parking will have to be shifted slightly towards the back of the lot to keep it from encroaching
into the front yard setback. The sign is larger than allowed by Code and will have to be reduced
in size. She included conditions to cover the paving of the parking lot and the parking in the side
yard in case the variances are not granted.
Project Engineer Rick Hixson reviewed his department's conditions. Water/Sewer
Superintendent Larry Woodward reviewed his conditions,noting that condition#1 requires the
water system be disconnected from the water well and condition#2 requires a fixture count to
ensure the proper size water service is installed, which will allow the City to charge the
appropriate amount for sewer use. He noted the installation of the water service will require a
street cut permit for the fire line to be installed,

Planner Olsen noted the next review of the application will be by the Planning Board.
Mr. Hixson moved to recommend approval as per conditions of DRC, The motion was seconded
by Neil Poulsen and carried 5-0.
4. Sourdough Montessori Preschool CUP #Z-97120 - (Olsen)
4310 Sourdough Road
- A Conditional Use Permit Application to allow a pre-school for 20-25
students in an existing home.
Jay Jacobs joined the DRC. Planner Jody Olsen reviewed the application. Two variances are
requested, one for the parking lot to be unpaved and the other to allow more signage than allowed
in the Code. (Public Services Director Phill Forbes joined DRC.) Planner Olsen reviewed the
conditions from the Planning Staff, She noted there are conditions to cover the requested
variances if they are not granted. She continued that one space encroaches into the side yard and
the parking lot will have to be shifted slightly. The applicant is to install additional landscaping to
meet Code. The driveway is to be 16' wide unless a deviation is granted by the Public Service
Director.
Planner Olsen noted that Sam Gianfrancisco County Road Supervisor had given her his conditions
which deal with ingress/egress concerns. He noted the applicant will have to reconstruct the
approach from Sourdough Road. He also suggested additional drop off space be provided for the
safety of the children. Also due to the applicant's use of Trooper Trail as an exit,he is to join the
homeowners' association to pay his fair share of the upkeep of that road.
Planner Olsen noted that County Environmental Health has indicated there is an existing septic
permit,however additional work will be required on the septic system to ensure capacity for the
increase usage.
Fire Marshal Chuck Winn noted the applicant is to get a letter of approval from the Sourdough
Fire Chief. City Engineer Craig Brawner asked if the applicant has an access easement from his
property to Trooper Trail. Mr. Jacobs noted that he does.
Project Engineer Rick Hixson noted his conditions are standard. He added that the driving aisle
in the parking lot has to be 26' wide for two-way traffic. Planner Olsen asked Public Service
Director Phill Forbes about granting the variance for the 15 foot egress. Mr. Forbes noted he
would grant the variance. Discussion ensued on the curbing of the driveway.
Mr. Jacobs noted that all of the conditions stated thus far have been anticipated. He has hired
Fluidyne to handle the water/sewer calculations. Discussion ensued on the condition from Mr.
Gianfrancisco about rebuilding the grade. Planner Olsen will discuss the condition with Mr.
Gianfrancisco.
Water/Sewer Superintendent Larry Woodward reviewed his conditions. Mr. Jacobs asked how
much lead time Mr. Woodward needs to install the water service. Mr. Woodward noted two
weeks would be sufficient. Discussion followed on condition#3 which concerns a sewer line
crossing a water line. Mr. Jacobs noted he won't be installing a sewer line over the water line.

Mr. Hixson moved, Mr. Poulsen seconded,to conditional approve the application. The motion
tamed 5-0.
5. Reid ZMA#Z-97114 - (Saunders)
310 Ice Pond Road
- A Zone Map Amendment Application to amend the zoning designation on
a 6.978 acre tract of land from R-S,Rural Residential Density, District to R-3,
Residential Medium Density, District.
Bob Lee joined the DRC. Planner Chris Saunders noted there are no zoning related conditions at
this point,there will be conditions if the property is developed. There were no comments from
Water/Sewer, Building, Fire, or Public Service Departments.
Project Engineer Rick Hixson noted there is no available sewer capacity in any of the sewer mains
in that area. Mr. Forbes noted that another access is needed to the site and the water will have to
be looped when the property is developed. Chairperson Winn concurred.
Mr. Forbes asked Mr. Lee if fireworks are still stored in the ice house. Mr. Lee noted they have
been moved out since 1989 and are stored all over the county. One storage place is on
Goldenstein Road.
Planner Saunders asked about the surface of the road. Mr. Winn noted that his department will
require it to be paved with asphalt upon development.
Planner Saunders noted he'd like the conditions in writing as soon as possible.
B. INITIAL WEEK REVIEWS
1. Taco John's MiSP/COA/Dev/Var#Z-97116 - (Olsen)
303 North 7th Avenue
A Minor Site Plan Application with a Certificate of Appropriateness, a
Deviation, and Variances to allow the replacement of the existing Taco John's
building with a new,larger building and increase the parking in the back of the lot.
Planner Jody Olsen presented the application. She explained the variances and the deviation
requested. Public Service Director Phill Forbes noted the driveway is shown as 10 feet and has to
be 16 feet. Planner Olsen noted there are also two deviations requested from Mr. Forbes,the one
he noted and one to allow the drive aisle to be one foot from the property line. The applicant is
planning to pave the parking lot.
Water/Sewer Superintendent Larry Woodward commented on the water/sewer. Planner Olsen
noted there is an existing modular building on the property which will be replaced with another
modular building.
Chief Building Official Neil Poulsen asked for the square footage of the proposed building.
Planner Olsen noted it is about 1800 square feet.
City Engineer Craig Brawner asked if there was an existing waiver for the paving of Beall.

Planner Olsen noted she would check on it and she has already warned the applicant that he will
be participating one way or the other.
2. Bamaby CUP #Z-97122 - (Williams)
1403 Cherry Drive
A Conditional Use Permit Application to allow the remodeling of the
basement into an accessory dwelling unit(ADU).
Greg Vidmar and Anne Barnaby joined he DRC. Project Planner Christopher Williams presented
the application noting it appears to comply with zoning and there is adequate parking. He noted
he has received calls from two neighbors. Both neighbors noted the covenants may not allow the
addition of the accessory dwelling unit. Planner Williams noted he had researched the covenants
at the Courthouse and reviewed his findings. Mr. Vidmar noted there has not been an
architectural review committee in that neighborhood. Discussion ensued on what would happen if
the property owner set up an ADU. Planner Williams noted the neighbors could challenge the use
in a court of law. Mr. Vidmar asked if they should visit with the neighbors to get their concerns.
Planner Williams noted that was a good suggestion. He noted the plan looks good according to
the Bozeman Zoning Ordinance. He continued that there could be protest from the neighbors,
however,he would provide the applicant copies of any letters received.
Water/Sewer Superintendent Larry Woodward noted a fixture count would be required to
determine if the water service size was adequate, and if the size is increased, impact fees will be
assessed. He also noted that if any new plumbing is installed, it will have to meet code.
Planner Williams noted this is a two week review, therefore,next week will be the last week of
review.
3. American Bank Drive-Through MiSP/COA#Z-97131 - (Patterson)
32 North Willson Avenue
- A Minor Site Plan Application with a Certificate of Appropriateness to
allow a new facility with drive-through and walk-up facilities.
Planner Dean Patterson presented the application,noting the issues may be with 1)the elimination
of the parking spaces, 2)the configuration of and backing within the parking lot, and 3)long lines
at the drive-up causing congestion problems on Willson Avenue.
Water/Sewer Superintendent Larry Woodward asked where the water/sewer would be located.
Planner Patterson noted the applicant has indicated they will be installed wherever the City wants
them. The applicant is aware of the work being done at the intersection of Mendenhall and
Willson. Mr. Woodward noted the applicant's proposal is to be shown on the site plan. He also
noted that a street cut would be needed. Engineer Rick Hixson noted there is a small window of
time for installing services as the roadway will be remilled and repaved. City Engineer Craig
Brawner and Planner Patterson discussed whether the building is located in the sight triangle -- it
appeared not. Mr. Woodward asked when the street would be milled. Mr. Hixson noted within
the next two weeks. Discussion followed on whether the structure would sit on a slab or have a
basement. It appears that a slab was planned.

Discussion ensued on the queuing of cars and shifting the location of the drive-up aisle.
Planner Patterson asked Mr. Woodward to determine if a street cut would be allowed as the
matter is very important for the application. City Engineer Craig Brawner noted the properly
owner might need a variance from the street cut ordinance. Mr. Brawner noted the property
owner should be applying to Mr. Woodward for water service now, Mr. Woodward noted the
builder needs to determine where the service lines will enter the property and building. Mr.
Forbes noted this particular use is very intense for the space and creates congestion.
4. Morgan Creek Condos MaSP #Z-97124 - (Skelton)
West Villard Street
A Major Site Plan Application to allow the construction of 40 two and
three bedroom condominiums.
Vice-Chairperson Chuck Winn presented the application. Public Service Director Phill Forbes
noted that the subdivision hasn't been filed at the Clerk and Recorder's Office at the Courthouse.
City Engineer Craig Brawner noted the infrastructure hasn't been installed and could be changed.
Mr. Brawner noted there is a prerequisite that the final plat has to be filed at the County
Courthouse before the City can approve site plans. Water/Sewer Superintendent Larry
Woodward noted the project shouldn't be reviewed until the streets are in, however he noted they
plan to break ground tomorrow for the water main. He noted they have 75 day contract to get all
the infrastructure installed.
There being no further business, Mr. Hixson moved, Mr. Poulsen seconded,to adjourn the
meeting. The motion carried and the meeting was adjourned at 11:30 a.m.
