PUBLIC STREET EASEMENT
Harrington's. Inc., Grantor, in consideration of$1.00 and for other valuable considerations, receipt
of which is acknowledged, grants to THE CITY OF BOZEMAN, a municipal corporation of the
State of Montana, with offices at 411 East Main, Bozeman, Montana 59715, its successors and
assigns, a perpetual street and utility easement for the use ofthe public, in, through, and across a strip
of land situated in Gallatin County, Montana, 45 feet wide to be located on the following describe
real property:
See attached Exhibit "A". Legal description. Harrington's, Inc. Property
The easement is more particularly described on the attached Exhibit "B" which by this
reference is made part thereof.
The GRANTOR states that he possesses the real property described above and that he has
a lawful right to grant an easement thereon.
The GRANTOR further agrees that GRANTEE may peaceably hold and enjoy the rights and
privileges granted without any interruption by the GRANTOR.
The terms, covenants, and provisions ofthis easement shall extend to and be binding upon the
heirs,\executors, administrators, personal representatives, successors, and assigns of the parties

Legal Description
Harrington's, Inc,Property
All that portion of a tract ofland located in the NW Y4 of Section 11, Township 2 South, Range 5 East,
M.P.M., within the following metes and bounds, to-wit:
Beginning at a point in the South line of the S Y2 of said NW Y4 of said Section 1], said point being
665.4 feet, more or less, East of the Southwest corner thereof; thence East 1 to feet, more or less;
thence Northerly 396,5 feet, more or less; thence West 110 feet, more or less; thence South 396.5 feet,
more or less to the point of beginning, less right of way for county highway purposes, as is now
established along the South line of said Northwest Quarter of Section 11; said aforesaid lands being
the same lands as described in a deed recorded in Film 186, page 3389, of the records of the
County Clerk and Recorder of Gallatin County, Montana.

Description:
A 45.00' wide street and utility easement over, under and across a tract
of land described in a deed recorded in Document No. 2009278, the
southerly line of said easement being described as follows:
Commencing at the southwest corner of the South Half of the Northwest
Quarter of Section 11; thence North 89'24' East, along the south line of
said South Half of the Northwest Quarter, a distance of 665.4 feet to the
southwest corner of said tract and the Point of Beginning; thence North
89'24' East, along the south line of the South Half of the Northwest
Quarter of Section 11, a distance of 110 feet to the southeast corner of
said tract, the south line of the easement there terminating.
The northerly line of said easement to be prolonged or shortened to
terminate on the east and west lines of said tract.
The herein described easement is shown by the hatched area on the
drawing below and contains 4950 square feet, more or less.
