TUESDAY, APRIL 29, 1997

Chairperson Dave Skelton called the meeting to order at 10:00 a.m. He noted that of the six
reviews, four of them are first week reviews with one final and one second week review.
A. FINAL WEEK REVIEW
1. Montana Kids Child Care Facility Expansion MiSP/COA#Z-9731 - (Arkell)
1105 Campbell Road
- A Minor Site Plan with a Certificate of Appropriateness Application to
allow the construction of a 1728 sq. ft. (footprint) 3-car garage with day care
center classrooms and facilities on the main level for the Montana Kids Child
Care Facility
Ben Lloyd, Wendy Tage, and Tammy Beyer joined DRC. Assistant Planning Director Debbie
Arkell reviewed the proposal and the conditions of the DRB and Planning Staff. She continued
with a description of the Walker Property Covenants trails provisions.
Project Engineer Rick Hixson reviewed the conditions from the Engineering Staff.
Hearing no comments or questions on Staff conditions and no comments or questions in general,
Mr. Hixson moved, Mr. Poulsen seconded, to approve the project as per Staff conditions. The
motion carried 6 - 0.
B. SECOND WEEK REVIEW
1. University Condo MaSub Preliminary Plat 9-P-9719 - (Skelton)
1800 West Kagy Blvd.
- A Major Subdivision Preliminary Plat Application to subdivide one lot for
34 condominium units.
Senior Planner/Chairperson Dave Skelton reviewed last week's concerns and annexation
requirements. He noted that he would sign the building permit except for units 19 and 20, as they
are shown to be located over the drainfield of the existing home. He continued that units 19 and
20 cannot be permitted until the existing house connects to sewer/water. Discussion ensued on
the requirement for water hookup. Public Service Director Phill Forbes suggested adding a
condition requiring connection to water service. Discussion followed on impact fees.
C. FIRST WEEK REVIEW
1. Valley West Annexation-#A-9703 - (Arkell)

- An Annexation Application for Annexation of 411 acres. (First of three
week review for Preliminary comments; will then review 2 more times for final
comments after preliminary report completed)
Assistant Planning Director Debbie Arkell presented the project. She noted that the applicants
have divided the project into three sections -the section they want to annex, the section they'd
like to annex, and the section they would annex if they could. She explained the DRC meeting
schedule as three weeks of review, then a preliminary report, followed by two weeks thinking
time,then two more weeks of review before the final report is due. She noted that the flaw in this
plan is that if only the first section is annexed,the Adam Bronken Memorial Park cannot be
dedicated to the City, as the sponsors of the park intended.
Project Engineer Karen Finke inquired if there has been any more discussion on the sewer trunk
that Morrison-Maierle is working on for the Delaney property. Mr. Hixson noted they have run
into a snag.
Discussion followed on the extension of City limits with no increase in manpower to service the
area. Fire Marshall Chuck Winn noted that more and more response time is needed for
emergencies.
2. Valley West MPA & ZMA-#P-9721, Z-9741 - (Arkell)

A Master Plan Amendment to change the land use from Suburban
Residential to Urban Residential and from Rural Residential to Commercial and a
Zone Map Amendment Application for multiple changes. (First of a
four week review)
Planner Arkell continued with a discussion of the schedule for these two applications, noting they
will run concurrently, with four weeks of review. She discussed the Urban Growth Area as
sho«Nm on the Master Plan map. She continued that the sewer service area extends out to
Cottonwood Road.
Planner Arkell noted that initial comments on the annexation are critical. She continued that there
is more time for comments on the ZMA and MPA.
Water/Sewer Superintendent Larry Woodward noted that infrastructure was installed at Billion
Auto Plaza to less than City standards and aren't readily adaptable to City systems.
3. Mr. T's Towing and Service CUP/CO a-#Z-9735 - (Olsen)
816 N. 8th Avenue
- A Conditional Use Permit with a Certificate of Appropriateness
Application to allow the construction of a 6400 sq. ft. structure for a towing and
service facility including an enclosed yard for vehicle storage.

Wendy Weaver joined DRC. Assistant Planning Director Debbie Arkell presented the project.
Project Engineer Karen Finke noted that the plans and specs have been received for water, sewer,
and street improvements. Water/Sewer Superintendent Larry Woodward asked for the sewer
easement location. Planner Arkell noted that wouldn't be a sewer easement as the sewer is
located in a public alley. Streets/Sanitation Superintendent Roger Sicz noted a waiver for alley
improvement may be required. Planner Arkell reviewed the December Informal meeting notes
where the applicant was informed by the DRC members that unless his project utilized the alley,
he would not be required to improve it.
Discussion ensued on the location of fire hydrants. Fire Marshall Chuck Winn noted the three
hydrants should be located one on each comer and one evenly spaced between those two.
4. West Babcock Street Manufactured Home Court MaSub Prelim. Plat-#P-9723 -
2700 Block of Babcock Street (Saunders)
- A Major Subdivision Preliminary Plat Application to subdivide 20.1542
acres into 92 manufactured home spaces.
Planner Chris Saunders presented the project. He noted that in the community impact statement
for Babcock Meadows, traffic was projected to be at level D. In this project they are stating that
there is plenty of room left at level C. Discussion followed on which level was accurate. Planner
Saunders asked for input on the level of traffic on West Babcock.
Water/Sewer Superintendent Larry Woodward noted that his department is negotiating whether
or not there will be meter pits.
Discussion ensued on the deviation for the cul-de-sac installation. Public Service Director Phill
Forbes noted that Donna Avenue should be a public street. Streets/Sanitation Superintendent
Roger Sicz concurred, noting that he'd want it to continue through to West Main Street. Mr.
Forbes noted that there should be another access to the subdivision.
DISCUSSION
Legislative update:
Chief Building Official Neil Poulsen noted that HB 388 passed,which requires the County
Commission to give the City permission in writing to administer the jurisdictional area. It requires
public hearing(s), etc., and goes into effect July 1. It puts the responsibility of the jurisdictional
area in the hands of the County Commission. If part of a subdivision is in the jurisdictional area,
then the whole subdivision is in and is subject to City regulations.
Also there is a new requirement for handicapped access being provided to a building, not just to
the site. The City of Bozeman is already meeting this requirement.
Mr. Sicz moved, Ms. Finke seconded, that the meeting be adjourned. The meeting was adjourned
at 11:15.
