David M. MacDonald and Cheryl A. MacDonald, GRANTOR, in consideration of $ 1.00 and for other and
valuable considerations, receipt of which is acknowledged, grants to The City of Bozeman, a municipal
corporation of the State of Montana, with offices at 411 East Main, Bozeman, Montana 59715,
GRANTEE, its successors and assigns, a perpetual street and utility easement for the use of the public,
in, through, and across a strip of land situated in Gallatin County, Montana, 45 feet wide to be located on
the following described real property: Across a portion of Tract 1 A of Certificate of Survey No. 1855A.
The easement is more particularly described on the attached Exhibit, which by this reference is made a
part hereof.
The GRANTOR states that he possesses the real property described above and that he has a
lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and
privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding upon the
heirs, executors, administrators, personal representatives, successors, and assigns of the parties hereto.

LEGAL DESCRIPTION - PUBLIC STREET AND UTILITY EASEMENT
A Public Street and Utility Easement located on a portion of Tract 1 A of Certificate of Survey No. 1855A,
located in the northeast one quarter of Section 11, Township 2 South, Range 5 East, Principal Meridian
Montana, Gallatin County, Montana and being further described as follows.
Beginning at the CE 1/16 corner of said Section 11, said point also being the Southeasterly corner of said
Tract 1A.
Thence S 880 14' 47" W, along the southerly line of said Tract 1A, a distance of 329.36 feet;
Thence N 000 25' 42" W, along the westerly line of said Tract 1A, a distance of 45.01 feet;
Thence N 880 14' 47" E, a distance of 329.63 feet to a point on the east line of said Tract 1A;
Thence S 00004' 57" E, along the said east line of Tract 1A, a distance of 45.02 feet to the point of
beginning.
EXCEPTING THEREFROM that tract of land of record on Film 156, page 3248, as recorded with the
