HomeMy WebLinkAbout02-18-1997 DRC Minutes DEVELOPMENT REVIEW COMMITTEE TUESDAY, FEBRUARY 18, 1997 Members Present: Roger Sicz, Larry Woodward, Chuck Winn, Craig Brawner,Neil Poulsen, Phill Forbes Staff Present: Jody Olsen, Chris Saunders, Debbie Arkell, Rob Bukvich, Dean Patterson, Karen Finke, Rick Hixson, Carol Schott Visitors Present: Al Stiff, Joan Rudberg, Gene Graf, Mark Chandler, Jeff Kack, Dave Jarrett, Bruce Foley, Donald Platisha, Joby Sabo] Vice-Chairperson Chuck Winn called the meeting to order at 10:00 a.m. A. FINAL WEEK REVIEWS 1. Smith/Barney Office MiSP #Z-9707 - (Olsen) 200 South 23rd Avenue - A Minor Site Plan Application to allow the construction of a 5,412 gross sq. ft. single story office building and related site improvements. Vice-Chairperson Winn introduced the project. Mark Chandler joined DRC. Planner Olsen reviewed the conditions from the Planning Department (all staff reports and memos are on file in the Planning Office). Project Engineer Karen Finke reviewed the Engineering Department's conditions. City Engineer Craig Brawner recommended that the applicant consider extending the public and private sidewalks to meet to allow better pedestrian traffic flow. Fire Marshall Chuck Winn reviewed his memo. MOTION: Mr. Sicz moved, Mr. Woodward seconded, to conditionally approve the application. The motion carried unanimously, 6 - 0. 2. Bozeman Interfaith Housing 2 ZMA, Annexation, and MiSub #Z-9712, 3302 West Babcock Street #A-9704 & #P-9704- (Saunders) - Zone Map Amendment, Annexation, and Minor Subdivision Applications to allow the annexation of 2.696 acres, the subdivision of 9.764 acres into 4 lots, and initially zone the 2.696 acres to be annexed as R-3 "Residential, Medium Density", with variances from Sections 16.42.030 and 16.12.020 of the Subdivision Regulations relating to the construction of street and utility improvements. Bruce Foley and Don Platisha joined DRC. Planner Chris Saunders explained that a motion will be needed for each application. He reviewed the Planning Department's conditions for annexation(Staff Report on file in the Planning Office). Development Review Committee-February 18,1997 1 Project Engineer Karen Finke reviewed the Engineering Department's conditions. City Engineer Craig Brawner suggested that a condition which restricts further development of the last two lots until City infrastructure is available be added. Streets/Sanitation Superintendent Roger Sicz asked how many units would be built to which Mr. Platisha answered ten. MOTION: Mr. Forbes moved to recommend conditional approval of the Annexation application, Mr. Poulsen seconded. The motion carried 6 - 0. After noting that the Planning Office has no comment on the ZMA at this time, Planner Saunders reviewed previous comments and the Planning Department's conditions on the subdivision application. He also noted that FWP had commented that the overflow ditch is a perennial stream. Mr. Sicz noted that the maintenance of stream/ditches are not the responsibility of the City and prospective buyers should be notified up front that the ditches belong to someone else and not to tamper with them. Mr. Brawner noted that most of the conditions and comments from the Engineering Department are applicable to the subdivision and annexation. Mr. Forbes noted that a condition is needed that approval is contingent upon annexation. MOTION: Mr. Forbes moved, Mr. Sicz seconded,that conditional approval of the Zone Map Amendment and the Minor Subdivision be recommended to the City Commission. The motion carried 6 - 0. 3. Graf Annexation #A-9701 -(Arkell) West of North 19th,between Baxter Lane and the interchange An Annexation Application to allow the annexation of 167 +acres. Gene Graf and David Jarrett joined DRC. Planner Debbie Arkell reviewed the project. She noted that during the Minor Subdivision review might be a good time to get the right-of-way for roadway easements. She asked for comments on Dead Man's Gulch; is the right-of-way easement needed now or when Lot 3 comes in for review. Mr. Graf noted that the applicant may want to swing the road to the north to allow a larger lot to be formed on the south side of Rolf's property. Gene Graf asked about the process to change the name of Dead Man's Gulch. He was referred to'the County Road Office. Mr. Brawner suggested getting right-of-way easements with subdivision rather than annexation, with the exception of Baxter Lane,where 45'will be needed. Planner Arkell noted that sewer service is available to the north and south of the property. Capacity may be a problem and future developers may need to do a capacity study. Ms. Finke noted that the Engineering Department has received information on capacity for Costco. Planner Arkell noted that the applicant is applying for a variance with the subdivision for well usage until City water is available. She noted water rights are generally due at the time of subdivision, and asked if they should be obtained for lots 1 and 2 at the time of final subdivision, and then for lot 3 at the time it is further subdivided. Phill Forbes indicated that would be appropriate.. Development Review Committee-February 18,1997 2 Ms. Finke reviewed the conditions from the Engineering Department. Discussion followed on the necessity for signalization of Baxter Lane and East Valley Center Road. Vice-Chairperson Winn asked how the fire protection issue will be addressed. He suggested addressing it as each development occurs. He reviewed his condition. Planner Arkell noted that the application will be on the consent agenda for the March 3rd City Commission meeting with the hearing on April 7th. B. SECOND WEEK REVIEW l. Kack MaSP/COA#Z-9705 - (Skelton) 51 Evergreen Drive - A Major Site Plan Application with a Certificate of Appropriateness to allow the construction of a 11,500 sq. ft. warehouse and office building, and a 7,000 sq. ft.light industrial/manufacturing facility,and related site improvements. Jeff Kack joined DRC. Planner Debbie Arkell reviewed concerns from last week. Vice-Chairperson Winn noted options available to the Kack's for fire protection -hydrants or sprinklering. He noted that if the buildings aren't sprinklered, another hydrant is needed towards the rear of the larger building. Mr. Kack and Vice-Chairperson Winn discussed the fire protection issues. Mr. Poulsen commented that it depends on the use whether or not the UBC would require sprinklering. The hydrant that exists is close to meeting the requirement. Mr. Kack noted that he wants to consider sprinklering and will ask an engineering firm to do a draft plan. Vice- Chairperson Winn noted that if hydrants are used,the second one should be within 350'of the rear of the building. Mr. Woodward noted that the water service cannot be located under the building as proposed. Mr. Kack asked if the fire line can be installed in the same trench as the domestic line. Mr. Woodward noted that the domestic line can be installed in the same trench as the fire line. Discussion ensued on the uses that would require sprinklering. Vice-Chairperson Winn asked when the access road behind the building will be installed. Mr. Kack noted that it will be installed with this project. Options were discussed on the water main locations. Discussion continued on the possibility of moving the mechanical room within the rear building. Vice-Chairperson Winn clarified that the large building must either be sprinklered or an on-site fire hydrant must be installed,or with the access road being built,perhaps the hydrant near it could be used. Planner Arkell noted that written comments are needed next week for a recommendation to Planning Board. C. INITIAL WEEK REVIEW 1. Bee Hive Home CUP/Variance#Z-9706 -(Olsen) Development Review Committee-February 18, 1997 3 2916 Donna Avenue A Conditional Use Permit Application with a variance for parking to allow the construction of a 10-resident adult group home facility. Planner Jody Olsen presented the application. She noted the applicant is requesting a variance from the parking requirements, as they want to install only 4 spaces instead of the required 10, as the residents will not be driving. Mr. Woodward noted that the infrastructure may not have been installed in this area. Project Engineer Rick Hixson led a discussion on the location of the infrastructure in the area. Mr. Woodward asked if the V water line is large enough for 10 people. Discussion ensued on a restriction that is on those lots for single-family homes and that only ;/" water lines were installed. Mr. Forbes asked Planner Olsen to research the numbers on the water services. Mr. Poulsen asked for the talcs to be brought to him also. Mr. Hixson noted that though these people don't drive,there will be visitors and more parking will probably be needed. 2. Costeo MaSP#Z-9708 - (Patterson) On the south side of East Valley Center Road, and approximately 1,000 feet west of the intersection of N. 19th and East Valley Center Road A Major Site Plan Application to allow the construction of a 123,745 sq. ft., retail structure with a tire sales-and-installation center, and related site improvements. Planner Debbie Arkell presented the application and noted that Dean Patterson will be conduction the review. Mr. Forbes asked if a traffic study has been done. Planner Arkell noted that it has and if it is not in to the Planning Office by next Monday, the application will not be discussed at DRC on Tuesday, but will be continued. Rob Bukvich, MDOT,joined DRB. Planner Arkell noted that the Minor Subdivision application has been received by the Planning Office and will be distributed today. She explained the project. Discussion ensued on the street right-of-way. Mr. Sicz noted that if this is a public street, it has to be curbed and guttered. Planner Patterson noted that both creeks are proposed to be relocated. Planner Arkell noted the applicants will need all the permits from NRCS and FWP to accomplish the relocations. Planner Patterson noted that one consideration is the signage proposed - 1200 sq. ft. Is proposed, however, only 400 sq. ft. is allowed under the Code. Planner Arkell noted that they are proposing to ask for a variance on the signage, and that our comments on signage will be limited to the fact that the signage does not comply with Code, and it must on the FSP unless a variance is granted. Discussion ensued on future water easements and proposed sewer locations and easements. Mr. Brawner noted that the new street that will serve the building will have to coordinate future water main installation. Discussion continued on infrastructure. Mr. Woodward wants to see the plans Development Review Committee-February 18,1997 4 for the water mains. Planner Arkell noted that there will be two wells on the site-one for domestic and one for fire protection. Discussion ensued on the best location for the sewer main. Mr. Forbes noted that there appears to be too much parking. Planner Arkell noted that the parking was figured according to the formula used for Wal-Mart and is appropriate. Planner Patterson asked if anything else is needed to continue DRC proceedings. Mr. Woodward noted that the correct location for the infrastructure must be shown on the final plan. Vice-Chairperson Winn is concerned that the applicants won't want to tear up their parking lot to install hydrants and suggested all the hydrants and infrastructure be installed prior to FSP approval. Planner Arkell noted it should be required and inspected prior to FSP approval. Mr. Woodward noted that the building will be sprinklered. Mr. Forbes noted that the inspections by the City on the infrastructure must be done before the paving is installed. Planner Arkell suggested making the inspections a condition of approval. Discussion followed on the installation and inspections. Discussion ensued on the fire protection system. Vice-Chairperson Winn noted that there will be a minimum of 6 hydrants required. Discussion on the requirements for connecting a well system to the City mains and the inspections and the sterilization required. Gaston Engineering needs to be called for plans for the water infrastructure being proposed. Planner Patterson is concerned about trying to continue with this project with inadequate information. Planner Arkell indicated the information submitted is adequate and the review of the project will continue on schedule. 3. North Meadows MaSub Preliminary Plat#P-9709 -(Saunders) South of Durston Road, West of Hunter's Way A Major Subdivision Preliminary Plat Application to allow the subdivision of 23+acres into 19 lots for residential,multi-family/office,park area, and approximately 7 acres for future phases. Second Vice-Chairperson Phill Forbes continued the meeting. Planner Debbie Arkell noted that Planner Chris Saunders will be carrying this project. Planner Saunders presented the project and noted the possibility of a sewer bottle-neck. Project Engineer Karen Finke noted that a sewer capacity study has been received and is in the process of being reviewed. Planner Arkell noted that 4-plexes are proposed for the first phase and 8-plexes for the second phase. Discussion ensued on water services and looping of water mains. Water/Sewer Superintendent Larry Woodward noted that his department is to be informed of what the applicants are doing as they are doing it. Discussion ensued on phasing and stubs required and when. Mr. Forbes asked when written comments are due,to which Planner Arkell said in 2 weeks. Planner Saunders asked about getting a financial guarantee for sewer improvements. Planner Arkell suggested hooking the sewer system into the Durston Meadows main. Development Review Committee-February 18,1997 5 4. Kamp MiSub#P-9708 - (Patterson) Intersection of I-90& East Frontage Road - A Minor Subdivision Application to allow the subdivision of 7.5 acres into 5 commercial lots. (First of two week review) Vice-Chairperson Winn continued the meeting. Planner Dean Patterson presented the application. He noted that the road standard will need to be addressed and the entire project is shown as natural wetlands on the NRCS's wetland map. Planner Arkell suggested that Planner Patterson check with NRCS and get their recommendations. Planner Arkell also suggested he call Dan Kamp and request a written extension of the 35 day limit to allow time to get comments back from all agencies. 5. Midwest Industries MaSP/COA/Dev#Z-9709-(Skelton) 2320 North 7th Avenue - A Major Site Plan/Certificate of Appropriateness Application with a deviation to allow an 11,468 sq. ft. shop addition and a 2,100 sq. ft. office addition to the existing C.M.U. facility,and related site improvements. Planner Debbie Arkell presented the project. She noted that the paving will have to be extended in the parking lot to provide adequate parking for the expansion,which will require detention facilities. No other infrastructure extensions are proposed.. D. INFORMAL REVIEW 1. Safeway Informal #I-9658 - (Arkell) North 5th Ave &West Oak Street An informal discussion of a proposal for an alternate site layout plan based on staff s concerns about the vacation of N. 5th Avenue Planner Debbie Arkell presented the project. Discussion followed on the layout of the alternate site plan, which was generally not favored by DRC members. Development Review Committee-February 18.1997 6
