HomeMy WebLinkAbout01-14-1997 DRC Minutes DEVELOPMENT REVIEW COMMITTEE TUESDAY,JANUARY 14, 1997 MINUTES Members Present: Larry Woodward, Neil Poulsen,John McNeil, Craig Brawner, Phill Forbes Staff Present: Chris Saunders, Debbie Arkell, Dean Patterson, Rick Hixson, Carol Schott Visitors Present: Bayliss Bradley, John Marks,Tom Milleson, Gene Payne, Scott McCullough, Eric Klotz, Joan Rudberg, Ralph Ferraro Assistant Planning Director Debbie Arkell called the meeting to order and introduced the first project. A. FINAL WEEK REVIEWS 1. Aaker/Payne/Scenic Developers Master Plan Amendment#P-9653 - (Saunders) West of South 19th Avenue between Lincoln Road and Stucky Road A Master Plan Amendment Application to allow a change in land use designation on 120.37 acres from Urban Residential to 56.33 acres of Commercial with 64.04 acres remaining Urban Residential. John Marks and Gene Payne joined DRC. Planner Chris Saunders noted that the Planning Office has one concern with the application-the designation of the area west of the creek as residential infill as that designation doesn't comply with the requirements for that designation as written in the Master Plan. Water/Sewer Superintendent Larry Woodward commented that the sewer main in South 19th Avenue may have the capacity to handle the first 21 units proposed in this application,however the capacity is not there for the rest of the development. He also noted that a large water extension will be required on the east side of South 19th from Lincoln Road to Kagy,Blvd, as well as individual mains looped through the acreage scheduled for initial development. He explain the looping required. This project will impact other area properties. John Marks noted that South 19th is scheduled to be expanded to a 4-lane street in the near future. He doesn't want to tear up the street to install the improvements,then have the City widen the street and redo the paving. Craig Brawner noted that the main is in the right-of-way, not under the street as usual,therefore,now is the time to install the mains-before the street is expanded. Discussion ensued on the necessary water improvements. Mr. Marks noted that he has contacted MSU for an easement for access to its mains and they are very receptive to the idea. Discussion ensued on the capacities of Tech Park mains,the requirements for main extensions,and the need to visit with the Engineering Department on determining the proper locations to tie into the City's systems. Assistant Planning Director Arkell asked Planner Saunders if the east portion of this project has been annexed. Planner Saunders noted that both this application and the annexation application Development Review Committee-January 14, 1997 1 will be heard before the City Commission on February 18. Assistant Planning Director Arkell noted that the urban residential infill designation requires annexation. She also noted that Staff probably will not support the residential infill designation as it doesn't meet the Master Plan. Mr. Marks asked if the size of the commercial property is too large. Planner Saunders noted that the area is acceptable as it would be a localized service area. Development Review Committee-January 14, 1997 2 A. FINAL WEEK REVIEWS 2. Boodles Restaurant CUP#Z-96100 -(Arkcil) 215 East Main Street - A Conditional Use Permit Application to allow the restaurant to serve alcoholic beverages. Assistant Planning Director Debbie Arkell introduced the application. Bayliss Ward and Ralph Ferraro joined DRC. Assistant Planning Director Arkell reviewed last week's concerns with the sprinklering of the basement being the main concern. Water/Sewer Superintendent Larry Woodward presented comments from his department. Assistant Planning Director Arkell commented on the seven conditions of approval that Planning Staff will recommend. Mr. Ferraro asked if he is required to have a standardized form for condition#6. Assistant Planning Director Arkell indicated that for now a letter is required, however, some time in the future there will be a standard form. Chief Building Official Neil Poulsen noted that the basement will have to be sprinklered before the building can be occupied-upstairs or down. Assistant Planning Director Arkcll reviewed the Planning Board and City Commission hearing dates for this project. Development Review Committee-January 14.1997 3 B. SECOND WEEK REVIEW 1. Gibson Guitar Addition MaSP#Z-9699 -(Skelton) 1894 Orville Way - A Major Site Plan Application to allow a 9,100 square foot addition to the existing facility and parking lot expansion. Assistant Planning Director Arkell introduced the application. Tom Milleson, Eric Klotz, and Scott McCullough joined DRC. Assistant Planning Director Arkell reviewed and distributed letters from Tom Kingma and Chuck Winn. Assistant Planning Director Arkell noted that DRB will review this application this afternoon. She reviewed Planner Skelton's recommended conditions for DRB approval. Mr. Milleson noted that some concern has been expressed by the DRC about the vacating of the cul-de-sac. Public Service Director Phill Forbes noted that the concern was expressed by him and it is in regard to the turning around of snowplows and emergency vehicles without the cul-de-sac. Assistant Planning Director Arkell noted that the County Commission will be making a decision on the vacating of the cul-de-sac this afternoon. Mr. Forbes noted that if it is vacated, it could cause problems if and when the property is annexed due to snow removal concerns and water/sewer main extensions. City Engineer Craig Brawner noted that the lot located the farthest south may have an access problem if the cul-de-sac is vacated. Mr.Milleson asked if the access problem should be addressed at this time. Mr. Brawner noted that it will be addressed at the time of annexation. Assistant Planning Director Arkell asked if access to North 19th would be allowed to the southern lot. Mr. Forbes indicated it would not. Assistant Planning Director Arkell reviewed a road vacation committee report which will be presented to the County Commission. It states that there would be no landlocked lots. Mr. Brawner noted that waivers for water main improvements to serve the overall area will be obtained if the property applies for annexation. He also noted that Engineering will have standard comments regarding storm drainage, etc. with regard to the subject application. Assistant Planning Director Arkell noted that written comments will be due next week for Planner Skelton's report to the Planning Board. This application will be heard by the Planning Board on February 4. Development Review Committee-January 14, 1997 4 C. 1 OF 2 WEEK REVIEWS 1. Jaramus COA/Dev COA/Dev#Z-9693 - (Patterson) A Certificate of Appropriateness Application with Deviations to allow the construction projects in progress, including the expansion of the existing garage to include a guest house, car port, and shop area; the construction of a hot tub area beneath the second story; and the demolition of the front steps and their replacement with a new porch area. Assistant Planning Director Arkell introduced the application. She noted that usually COA/Dev don't come before the DRC,however, Planner Patterson decided to get the input from the group as there are so many deviations and construction is virtually completed. Planner Dean Patterson noted that the project has been completed in violation of building permit requirements and a stop work order. Planner Patterson noted that the carport has been constructed into the City alleyway. Options include removing the portion that extends into the alley and approving an encroachment permit. Chief Building Official Neil Poulsen noted that the structure, since it is constructed of wood materials, has to be 5 feet from the property line or have a one-hour fire rating. Discussion ensued on how to remedy the carport violation. Planner Patterson noted that deviations are being sought for the work largely consisting of yard encroachments by the additions, some of which are located right on the property line. He continued with a discussion on the history of the additions that have recently been done and the deviations required if the additions are to be allowed to remain in place. Assistant Planning Director Arkell asked about the availability of a permit to allow this construction. Public Services Director Phill Forbes noted that normally the alleys in town are narrow enough without encroaching into them. Discussion ensued on the encroachment issues.
