I. PURPOSE
The purpose of this Memorandum of Understanding (MOU) is to establish a
framework for coordination and cooperation between the U.S. Geological Survey
(USGS) and the City of Bozeman (hereinafter also referred to as "Partner") that
will facilitate the conduct of cooperative activities in areas of mutual interest in
support of The National Map.
II. BACKGROUND
A core mission of the USGS is to meet the Nation's needs for current base
geographic data and maps. Through partnerships with federal, state, and local
governments and the private sector, the USGS is committed to providing the
Nation with access to current, accurate, and nationally consistent topographic
maps and geospatial and remotely sensed data and information to help informed
decision making by resource managers and the public. This synthesis of
information, products, and capabilities, The National Map, will be a seamless,
continuously maintained set of geographic base information that will serve as a
foundation for integrating, sharing, and using other data easily and consistently.
This agreement supports the mission of the USGS through collaborative efforts
to establish partnerships necessary for the development, maintenance,
dissemination, and use of The National Map.
The City of Bozeman was founded in 1864. In the Spring of 2000 the City began
implementing a system to show where certain data exists on a map. It is
accepted that 80% of all City data has a geographical element such as water
lines, historic districts, zones, and land uses to name only a few. These data
elements can be thought of as 'layers'. Each layer can be viewed on top of each
other to see relationships never before realized. These layers can also be tied to
existing databases such as billing information, street conditions, and fire hydrant
flow data. The possibilities of visualizing data, modeling, and retrieval of

information are endless. The National Map application will allow citizens instant
access to this data and information.
III. AUTHORITIES
This MOU is entered into by the USGS and the partner under Public Law 99-591
that bestows permanent authority to the USGS to "prosecute projects in
cooperation with other agencies, ~ederal, State, and private" (43 U.S.C. 36c).
When applicable, any further agreements entered into between USGS and the
partner that implement specific activities under this MOU will be pursuant to the
authorities and policies governing such agreements, in accordance with section
VI of this MOU.
IV. SCOPE
This MOU serves as an umbrella agreement that sets forth the general terms and
conditions under which USGS and the partner will coordinate and cooperate in
activities involving The National Map. The activities covered by this MOU will be
of mutual interest and benefit within, but not limited to, the following areas:
1. Data and database development
2. Data and database maintenance
3. Data dissemination and distribution
4. Exchange of geospatial / remotely sensed information, data and products
5. Feature serving and generalization
6. Outreach and education
7. Research and applications
8. Sharing technical information and expertise
9. Standards development
\ 10. Web mapping services and applications
11. Workshops, training, and technology transfer
V. RESPONSIBILITIES
The specific relationships and responsibilities of the Parties with regard to the
cooperative activities under this umbrella MOU shall be defined in separate
agreements which shall become annexes to this MOU, in accordance with
section VI.
Both the partner and USGS will continue to maintain open communication and
coordination to facilitate a cooperative working environment to support current
. agency missions as they relate to The National Map. The partner and USGS will

provide leadership and program oversight for the cooperative activities
conducted under this MOU.
VI. IMPLEMENTATION
Specific activities to be conducted under this MOU and the method of their
implementation will be determined on a case-by-case basis by USGS and
the partner, in consideration of thE\ merit, existing commitments, projected
schedules, available funding and personnel resources, and other relevant
factors.
As appropriate, implementation of specific activities under this MOU will be
outlined in separate agreements, such as, but not limited to, Interagency, Joint
Funding, Innovative Partnership, Workshare, or Data Sharing Agreements, which
will be coordinated through mutual agreement between the parties and
independently authorized by appropriate statutory or other authority. As
appropriate, the agreements implementing specific activities shall be annexes to
this MOU. Each annex shall describe the project or activity agreed upon in
regard to its objectives, scope, responsibilities of the parties, project schedule,
deliverables, and funding.
VII. FINANCIAL ARRANGEMENTS
This MOU defines the general terms upon which the USGS and the partner will
cooperate. Performance under the terms of this MOU is subject to the
availability of appropriated funds and personnel resources through each party's
respective funding procedures. This MOU is neither a fiscal nor a funds
obligation document and, as such, does not constitute a financial commitment on
the part of either party. Any endeavor or transfer of anything of value involving
reimbursement or contribution of funds between USGS and the partner will be
handled in accordance with applicable laws, regulations, and procedures
including those for Government procurement and printing. Any such endeavors
will be outlined in separate annexes or agreements, including work plans or
statements of work, which shall be made in writing and shall be independently
authorized by appropriate statutory authority. This MOU does not provide such
authority. Specifically, this MOU does not establish authority for noncompetitive
award of any contract or other agreement. Any contract or agreement for training
or other services must fully comply with all applicable requirements for
competition.

IX. LIABILITY

X. PUBLICATIONS AND RELEASE OF INFORMATION
~
When deemed appropriate, the activities conducted, or scientific data developed,
under this MOU will be documented and made available to the general scientific
community through publication in appropriate journals or other established
channels as soon as practicable and consistent with good scientific practice.
Publications documenting cooperative efforts may be prepared by either party, or
jointly, provided that both Parties have an opportunity to review manuscripts prior
to publication. In the event such reports or publications are copyrighted, each
party shall have a royalty-free right under the copyright to reproduce, distribute,
and use such copyrighted work for their own purposes.
Releases of general information to the public may be made by the appropriate
Party with respect to its own portion of the project/cooperation as desired. The
Parties will seek to consult with each other prior to any such releases that
reference the other party's participation, consistent with the Parties' respective
laws and policies.
The Parties agree that sharing credit is mutually beneficial, and will assure that
appropriate citation and attribution, including the use of official agency visual
identifiers, is given for work performed under this MOU. Specific uses of a
Party's logo or seal, however, will require advance approval by that Party.
~1. PARTICIPATION IN SIMILAR ACTIVITIES
This MOU in no way restricts any of the partners from participating separately in
similar activities with other public or private agencies, organizations, and
individuals, including other activities between USGS and the City of Bozeman.
XII. EFFECTIVE DATE. REVIEW, MODIFICATION. AND TERMINATION
This MOU shall take effect upon the date of the last signature and shall remain in
effect for a period of five (5) years. This MOU may be reviewed annually or at
the request of either party. This MOU may be modified at any time upon joint
approval. This MOU may be terminated at any time by mutual written agreement
of the Parties, or by either Party upon 90 days written notice to the other party.

Pertaining to
The National Map
I. Purpose
This agreement is entered into between the City of Bozeman (known as the partner) and
the U.S. Geological Survey (USGS) for cooperation in support of web mapping services
and data activities related to The National Map. This agreement shall constitute an annex
to the umbrella Memorandum of Understanding between the partner and USGS
pertaining to support for The National Map, dated July 23rd, 2004. This agreement is
entered into under Public Law 99-591 that bestows permanent authority to the USGS to
"prosecute projects in cooperation with other agencies, Federal, State, and private" (43
U.S.c. 36c).
II. Scope
Under this agreement, the partner will pursue activities that directly support the
implementation of The National Map. Specifically, the partner will maintain geographic
data and information in which they have direct responsibility for. The partner will also
provide an Open GIS Consortium (OGC), web mapping service that will at a minimum
support the harvesting of resident geospatial data by The National Map Catalog and
viewing download and metadata services capabilities through The National Map viewer
application.
This annex describes the terms and conditions governing the responsibilities of USGS
and the partner with regard to the scope of activities identified above.

III. Responsibilities
The partner and the USGS agree to the following:
The City of Bozeman will: Undertake activities related to the maintenance of geographic
data and development I operation of a Web Mapping Service (WMS) that supports The
National Map. In general, the partner agrees to:
- maintain geospatial data over an agreed upon area of interest in respect to age,
accuracy and content, and
- provide access to this data through a WMS.
Specifically the partner agrees to:
1. Accept ownership of specific geographic data themes within a specified area of
responsibility. This agreement defines the area of responsibility to be the City of
Bozeman which is comprised of 15.8 square miles of land area and 2, I :24K
USGS quadrangles. Data maintenance responsibilities include but are not limited
to the following layers:

2. The data will be served by a map service conforming to the OpenGIS Web Map
Service Implementation Specification OGC 01-068r2, or current OGC
specification.
3. Service will support the WGS 84 geographic coordinate system (spatial reference
system). A calI to the GetCapabilities must return EPSG code 4326 for the spatial
reference system.
4. Maintain and host appropriate metadata as described by the Federal Geographic
Data Committee and adopted by the USGS for use in The National Map.
5. Provide service addresses and metadata locations to the USGS.

6. Work with USGS to comply with recommended data content specifications and
future specifications required by The National Map application.
7. Provide this data in the public domain, subject to applicable federal and state
statutes.
The USGS will:
1. Provide management and support of partner services through The National Map
catalog.
2. Provide public access to partner data through The National Map viewer
application
3. Provide appropriate recognition to partners in The National Map applications
4. Provide appropriate technical assistance to partners as needed and mutually
agreed upon.
5. Provide partner with access to appropriate USGS information using applicable
teleconferences, meetings, office visits, training opportunities, and written
correspondence.
6. Evaluate WMS and partner data to assure a National standard
7. Continue to work with partner to develop standards and guidelines both technical
and procedural to better define The National Map and our partner relationship.
IV. Disclaimer
The National Map is built on the premise of maintained data and every effort will be
made to provide the best available data over anyone area of responsibility. However, the
parties to this agreement make no express or implied endorsement or warranty as to the
accuracy, completeness, or suitability for any particular purpose of any data, products, or
services prepared, exchanged, or made available under this agreement. Any applications
of, or conclusions drawn from these data, products, or services are the responsibility of
the user. "',
V. Liability
Each party to this agreement agrees that it will be responsible only for the acts of its own
employees, contractors, or subcontractors, and the results thereof, and shall not be liable
for the acts of the other Parties' employees, contractors, or subcontractors, and the results
thereof: relative to the data, products, and services prepared, exchanged, or made

available under this agreement. Any liability of the United States resulting from acts of
its employees shall be governed by the Federal Tort Claims Act (28 U.S.C. 2671, et seq.)
VI. Financial Arram!ements
There will be no exchange of funds between the parties based on this mutual agreement
to cooperate. As applicable, performance of either party is subject to the availability of
appropriated funds and personnel resources through their respective funding procedures.
VII. Duration of Aereement
This agreement shall take effect upon the date ofthe last signature and will remain in
effect for a period of five years from that date.
VIII. Review of Aereement
The Annex may be reviewed periodically for currency, and amended as necessary with
the mutual consent of both parties. Similarly, the Annex may be renewed by written
amendments. This Annex may be terminated by either party upon 90 day's written notice
to the other party.
