SUBJECT: Request for Extension of DNRC Grant Completion Date for the Bozeman Creek at Bogert Park Enhancement Project

RECOMMENDATION: Authorize the City Manager to sign Amendment No. 1 to the Department of Natural Resources and Conservation Grant Agreement No. RRG-14-1608
(Attachment 1) extending the grant deadline.
BACKGROUND: Resolution No. 4492, the Commission acknowledged receipt of a $100,000
Montana Department of Natural Resources and Conservation grant and allocated up to $440,000
in TOP bond funding for the Bozeman Creek at Bogert Park Enhancement Project. In early 2014, a preliminary design was prepared in order to negotiate access from property owners along the creek adjacent to Bogert Park. One property owner does not wish to permit any construction
activity on his/her property. As such, the design will need to be revised and construction, which
must occur during the low-flow period, will be delayed until Fall 2015. This amendment will
extend the deadline for completion of the project to June 30, 2016.
UNRESOLVED ISSUES: None.
ALTERNATIVES: As directed by Commission.
FISCAL EFFECTS: None.

THIS AMENDMENT MADE AND ENTERED INTO BY AND BETWEEN THE MONTANA
DEPARTMENT OF NATURAL RESOURCES AND CONSERVATION'S (DNRC)
CONSERVATION AND RESOURCE DEVELOPMENT DIVISION HEREINAFTER CALLED.'DNRC", AND, THE CITY OF BOZEMAN, HEREINAFTER CALLED THE ''PROJECT
SPONSOR''.
The parties to this Agreement in consideration of the mutual covenants and stipulations set out
herein hereby agree as follows:
THAT because additional time is needed to complete the project, SECTION 2. TERM is hereby
amended as follows:
SECTION 2. TERM. The Project Sponsor shall have until 06/30/2016, to complete the project
and work described in Section 4, Project Scope due top easement issues. DNRC may grant an
extension for completion upon request and showing of good cause by the Project Sponsor. A
request for extension submitted less than 45 days prior to the termination date may or may not be
considered.
All other terms and conditions remain unchanged and continue in full force and effect. This
Amendment consists of one (1) page.
To express the parties' intent to be bound by the terms of this Agreement they have executed this
document on the dates set out below.

Contract qualified consulting professional firm(s) to prepare final design plans and specifications.
COMPLETED - February 2012
Project Task # 2
Prepare and submit all necessary regulatory permits; revise final designs if necessary.
UNDERWAY – expected completion May 2015
• Geotechnical investigation regarding park shelter footings - completed January 2013
• Preliminary Design and Hydrologic Report – completed May 2012
• Prepare final design with revised hydraulics – expected completion May 2015
• Submit FEMA LOMC application - expected completion May 2015

Prepare bid package and solicit proposals for construction.

Construct the project, including the following tasks:
1) Construct channel and inset floodplain
2) Construct floodplain revetment
