HomeMy WebLinkAbout11-13-14 Packet Materials for Cemetery_Land_Commision_Resolution_No mjoEdits/ COMMISSION RESOLUTION NO. ____________ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, TO DESIGNATE THE CITY OWNED LANDS EAST OF GOLF WAY, WEST OF HIGHLAND BOULEVARD, SOUTH OF THE LINDLEY CENTER BUILDING AND NORTH OF ELLIS STREET, +/- 27 ACRES, AS CEMETERY LAND. THE LAND MAY BE UTILIZED FOR PARK, RECREATION AND OPEN SPACE PURPOSES UNTIL NEEDED FOR CEMETERY USES. WHEREAS, in Resolution No. 1043 the City Commission of the City of Bozeman, Montana agreed to acquire land from the Benevolent Protective Order of Elks Lodge No. 463 for the purposes of open-space, park, recreational and cemetery use; and WHEREAS, in Resolution No. 1062 the City Commission of the City of Bozeman, Montana entered into the agreement for the purchase of lands from the Benevolent Protective Order of Elks Lodge No. 463 for cemetery and park purposes; and WHEREAS, the Cemetery Advisory Board recommends designating the specific future use of the property addressed in this resolution as City Cemetery to ensure adequate space for future Cemetery expansion. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 The City owned land East of Golf Way, West of Highland Boulevard, South of the Lindley Center Building and North of Ellis Street, +/- 27 acres, is designated as City Cemetery land to be used for future City Cemetery purposes. Section 2 Approximately 28.8 acres of the total property originally acquired for purposes of open-space, park, recreation and cemetery, from the Benevolent Protective Order of Elks Lodge No. 463, is currently used as a recreation facility with lighted softball diamonds, fenced off-leash dog parks, trails and a play structure. Section 3 Approximately five (5) acres to the north of the ~27 acres addressed in Section 1 and which shall include the Lindley Center, will remain as Park, Recreation, Open Space and Cemetery Land. Section 5 No permanent structures or structures of any kind that would prevent future cemetery use shall be constructed upon the +/- 27 acres addressed in section 1 of this Resolution. Section 6 Until which time the City property referenced in Section 1 of this Resolution is needed for City Cemetery uses it will continue to be utilized and managed as Parks, Recreation and Open Space lands.
