A. Final Week Review
1. Heritage Christian CUP and Variance Z-9570
Planner Windemaker reviewed a question raised by Phill Forbes and
noted the Waiver of Right to Protect Creation of Special
Improvements RIDS has already been filed. She stated that Sam
Gianfrancisco has two conditions pertaining to the paving of
Durston Road to county standards and that the County Health
Department had a condition. She then reviewed the planning
conditions for the proposed project.
Dave Skelton questioned the condition of starting paving at the
end of the current paving instead of closer to the property.
Planner Windemaker indicated that Sam Gianfrancisco had indicated
that the paving needed to be continuous and not broken up with
gravel .
John Paysek stated the the waivers should also included the
traffic light at Durston and 19th. Planner Windemaker replied
that another one will have to be filed.
Planner Windemaker stated that condition #7 and #8 of the staff
report will be eliminated as they are included in Engineering' s
conditions .
Planner Windemaker asked if the Montana Power Company lights have
been meeting the light standards . Dave Skelton replied that they
have not. Planner Windemaker then read the condition included in
the Staff Report concerning lighting.
Dave Skelton stated that the committee is asking for street
frontage trees that will be on the property and not in the public
right-of-way.
Kurt Albrecht reviewed the building code conditions for this
proposed project.
John Paysek reviewed the conditions from engineering.
Planner Windemaker asked if a condition about annexation taking
place prior to water and sewer hook up needed to be included.
Dave Skelton stated that at other times a waiver to protest
annexation was given by applicants . Dave Skelton commented that
it is good to have the condition that before city water and sewer
are hooked up there must be annexation. He advised the applicant
to go over any concerns they have on the conditions with Planner
Windemaker before the Planning Board meeting July 18 .
John Paysek moved, seconded by Chuck Winn, to recommend
conditional approval of the project with the conditions of the
staff with the one additional condition that tie in to city water
and sewer cannot be done000 without annexation. The motion
carried with a unanimous voice vote of the members present.
2 . Lucky Liles Casino CUP Z-9564
Planner Skelton reviewed this project and the conditions . He
pointed out that a representative from Gaston Engineering, Mark
Iwaniah was in attendance. He stated that he had done an on-site
inspection the morning of the meeting and noted the existing
asphalt and mature trees on the location. He stated he was
concerned as to the relocation of the stream ditch in relation to
the trees . He reviewed the conditions of the staff report and
noted that there is one tube light allowed on the facia of the
sign and still wonders about the placement of that tube. Planner
Skelton pointed out conditions #4 and #5 which concern culverts ,
stream ditch, and holding harmless the City of Bozeman concerning
the ditch. He reminded the representative that there needs to be
a 35' set back on the North East corner of the parking area and
that the parking was not to encroach onto this stream set back.
He also voiced concern as to the topography in relation to the
stream ditch. He stated that the site grading plan will have to
be very accurate and that an on-site inspection may have to be
done to see that the plan is followed.
Fred Shields commented that the trees in the sewer easement were
not addressed in any of the conditions .
Planner Skelton asked if the second access on St. Estephe will
work for fire and Chuck Winn responded in the affirmative.
John Paysek reviewed the conditions from engineering and stated
that they are consistent with the conditions from the previous
review although some have been added. One of those added
included that the driveway be paved from the South East corner of
the project to U. S . Highway 191 and that the curbing, asphalt and
any other state requirements will need to be in place. Added to
condition #20 was that an encroachment permit to work on U. S . 191
will be needed.
John Paysek moved, seconded by Kurt Albrecht, to recommend the
proposed project with the conditions as outlined to the Planning
Board and City Commission. The motion carried by unanimous voice
vote by the members of the committee present. Planner Skelton
reminded that the proposed project is scheduled for the city Aug.
7 and for the Planning Board on July 18 .
B. Initial week Review
1. Lockwood Building MiSP/COA Z-9584
Planner Windemaker reviewed the proposed project on the corner of
Beall and Bozeman having an apartment on the first floor and
offices on the second. She noted that the applicant will be
purchasing three parking spaces from the parking commission for
the office and having two spaces for the apartment. Dave Skelton
asked if there was anything of concern.
John Paysek asked if there was existing sidewalk. Fred Shields
replied that there is a curb walk on Beall, and a boulevard and
sidewalk on Bozeman.
Fred Shields also noted that the water crosses this lot to the
building on the west and that he had located the line easement on
the site today. Water service will be located under the garage
and that will not be acceptable. He stated that there is a 20'
easement and the water line and sewer line do not stay in the
easement and will have to be relocated for this proposed project
to work.
Dave Skelton stated that an easement of 20' will work and
questioned if an easement has been filed for that. Fred Shields
stated that Phill Forbes was going to check with Robin Sullivan
to see if an easement had been filed.
2 . Happy Hours CUP Z-9569
Planner Arkell reviewed for the committee that the City
Commission has denied the parking variance for this proposed
project and the applicant is now looking at just using the main
floor and not the basement which would reduce the parking they
would need to five plus one American Disabilities Act place plus
two for the apartment that will remain on the second floor. She
stated that the commission may approve the center if they find
that the present proposal meets traffic and pedestrian traffic
needs . She noted that day care centers are conditional uses
based on traffic, and pedestrian circulation. Planner Arkell
also noted that the city is interested in seeing a day care for
children with special needs .
Planner Arkell stated that the Design Review Board will be
looking at this proposed project due to the fence and ramp on its
July 25 meeting.
Kurt Albrecht asked how many children will be served by the
proposed project. Planner Arkell replied that the number has not
been finalized but that the number will be reduced due to the
reduction in floor space. Kurt Albrecht noted that this project
will be a change of occupancy and Planner Arkell concurred.
Chuck Winn asked what special needs children are and Planner
Arkell responded that they are developmentally disabled or
emotionally disabled children. She also reviewed the square
footage of how many children they may have. Chuck Winn asked if
the Department of Family Services talked about the basement and
Planner Arkell replied that they have already given their
approval of the project to the applicant.
Kurt Albrecht asked what ages would be using the building and
asked about the large motor area in the basement. Planner Arkell
responded that the ages will be anywhere from infant to age 9 or
10 and reminded the committee that although the plans the
committee received include the basement that after the Monday
night meeting the applicant now plans on only using the main
floor and not the basement. Georgiann Youngstrom noted that
large motor area does not necessarily mean only for special needs
children. She said preschool children are all referred to
activities for the large motor muscles and not just special
needs .
Planner Arkell asked that comments on future use of the basement
would be appropriate. Dave Skelton stated that the committee
will be making a recommendation on this proposed project .
3 . American Bank MaSP Z-9568
Planner Skelton noted that he had asked Rob Gilbert to be here
for the meeting today, but he is not in attendance.
Planner Skelton pointed out that the proposed project is to add
two structures . One includes removing Petcetera and adding a
covered parking area and the other included building a 4, 800
square foot professional building. Kurt Albrecht asked if there
is perpetual parking in that area and Planner Skelton stated he
will do parking space numbers .
Kurt Albrecht asked if they are building across the property
line. Planner Skelton also voiced concern that the plans looked
as if they were and that the applicant would have to show that
they own both properties and will require a deed restriction to
sell the lots jointly.
John Paysek noted that he has not seen much parking out at the
existing building.
Fred Shields asked if the covered building was just for parking.
Planner Skelton stated that was how he understood it. Fred
Shields asked if it is designed for a 2nd floor to be added later
as if it is there needs to be the water and sewer plans included
now.
Planner Skelton asked if retention ponds are allowed now along
West Main. John Paysek replied that he didn' t know. Chuck Winn
stated that he will have questions next week.
John Paysek stated that the corner by Red Barn at the North East
corner looks tight for turning radius . Planner Skelton asked if
it is a shared ingress/engress with Red Barn. John Paysek
pointed out that the entry between the two buildings needs to
have handicap parking and entries to the west. He also commented
that he didn' t know if sidewalk, curb, and gutter will be
required on Babcock. Chuck Winn commented that there is a big
ditch on the property.
Planner Skelton asked if the outside of the building was for car
tellers and if there would be stacking of cars as if there is
there may be conflict with the west building.
Planner Skelton stated he will meet with Rob Gilbert to express
concerns regarding who owns the property and the loss of parking.
C. Informal Review
1. walker Property Sub/ PUD
Planner Skelton reviewed that this is located at Springhill Road
and U. S . 10 by the 19th interchange and will access city sewer
but will have private water. He stated that the proposed project
will be neighborhood uses and commercial uses . There will be
food services on the west side of one of three structures with a
drive up window. He wondered if that area will allow for back up
and stacking of cars . John Paysek pointed out that there may be
back up onto parking stalls .
Planner Skelton also asked engineering about the driveways on
Reeves Road noting that they are skewed and not directly aligned.
Ben Lloyd pointed out that after the meeting with Planner Skelton
concerning this proposed project he did some checking and found
the structure is not a transformer that will have to be moved
rather it is a junction cam.
John Paysek stated that if the south street is dedicated as a
public street rather than a shared access, the access needs to be
perpendicular. Planner Skelton noted that Reeves will remain a
shared access and private. John Paysek then stated that even if
it is shared access he would like to have the access
perpendicular.
Planner Skelton stated that they needed to look at the multiple
use, retail/commercial uses for the parking needs . Ben Lloyd
stated they are dedicating more parking for snow removal .
Fred Shields stated that if using city sewer and private wells,
no matter how many wells, there will have to be meters into each
building as the used water will go into the treatment program of
the city. He also asked for a location map. Ben Lloyd stated
that all three buildings are one-story.
Ben Lloyd pointed out that they had looked at a number of site
plans for this project but felt this one had addressed proximity
questions . Kurt Albrecht stated that as close as the buildings
are the building code will require a one hour wall.
Planner Skelton stated that Sam Gianfransico from the County
transportation will need to be included in the proposed project
since it is out of the city limits concerning the traffic
patterns and accesses .
