Second Week Review 1. Luck Lills Casino CUP Z-9564 Planner Skelton introduced Gerry Gaston representing Lucky Lil' s Casino. He reviewed the project stating that the only change from the previous proposed project is the elimination of the 2nd structure. Planner Skelton had sent a letter to Mr. Gaston last week reaffirming that a 35' setback from the stream is necessary and commented that there does need to be a tie down on improvements for an egress/ingress . Mr. Gaston said that egress/ingress is an existing easement on the adjoining property that has been there a long time. John Paysek asked how the egress/ingress is in relation to the upcoming highway. Mr. Gaston responded that it is already paved and existing and that the highway is upgrading the approach but that they will be improving their own property. Planner Skelton stated that the curb and gutter are already there and that one access is on Saint Estephe Street. Roger Sicz asked about a better access onto Main Street. Planner Skelton said they didn' t want a direct access and there are two accesses onto Saint Estephe and another one onto the adjoining property to the west. Fred Shields stated that the trees needed to be taken out of the sewer easement. Mr. Gaston asked if that meant the trunks and if branches could hang over those easements . Fred Shields stated the trunks . Planner Skelton stated that next week the committee will be making a recommendation which will go to the Planning Board and the City Commission. Mr. Gaston asked if there was anything else that needed to be cleared up by next meeting. Planner Skelton again mentioned that he had sent a letter to Mr. Gaston in which he wanted confirmed that there is no variance with the free standing sign and the stream setback. Planner Skelton asked if there are any improvements on the adjoining property. Mr. Gaston stated that the parking lot goes to within 4 or 5 feet of the stream. Planner Skelton stated that it is an existing condition. Mr. Gaston asked John Paysek to let him know if the state department would want anything else. John Paysek responded by reading condition #13 from the previous conditions to which Mr. Gaston responded that this condition had been meet. Planner Skelton stated he was not sure about the status of the farmer' s canal close to the proposed property. Mr. Gaston stated that in working with the Farmer' s Canal the project would be accepted if there were no holding pond and he believes that this has been worked out. 2 . Heritage Christian CUP & Variance Z-9570 Planner Windemaker reviewed the proposed project with the first phase being new classrooms and the second phase being a gymnasium with a variance of height from 38' to 391 . She asked Ken Van Dyken if phase two was going to be built when they have access to city water and sewer. Mr. Van Dyken responded yes . Kurt Albrecht noted that concerning the expansion he had contacted the architect and was waiting more information from her. He said that the expansion needs to meet building codes and is waiting for information as whether the existing structures meet building codes . John Paysek questioned whether Durston Road is paved to their property. Dave Skelton said the committee needs to look in the old file to see what waivers or conditions were given at the time the existing building was built. Discussion followed by John Paysek, Roger Sicz and Dave Skelton on what may be required concerning any future paving. Dave Skelton questioned if there were any ditches on the property. Planner Windemaker stated there is a ditch on the north property line. John Paysek asked the applicant what kind of canal it is . Mr. Van Dyke stated that it is a drainage ditch for an adjoining farmer. John Paysek asked if they are proposing any change to that ditch. Mr. Van Dyke stated no. Dave Skelton then stated that the school is under the Rae Rural Fire District for fire protection. He asked if the applicant had contacted Tom Kingman, chief of the Rae Fire District. Mr. Van Dyke responded that he thought the architect may have done so. Mr. Van Dyke asked if DurSton Road will be paved to Ferguson. Phill Forbes said is the Delaney project goes through, it will be paved. Dave Skelton asked if paving will be a condition that the committee will require. John Paysek said we require it of other proposed projects . Roger Sicz stated that the key will be the development of the Delaney property as no one wants gaps in the paving done on Durston. Dave Skelton stated that next week' s meeting will be on Wednesday and suggested that Planner Windemaker check the old project file to find any pertinent information concerning the improvements and conditions on Durston. B. Informal Review 1. Manley Development East of Riverside Dr. Planner Skelton introduced Mark Chandler as the representative for this possible project . Planner Skelton passed out a map of the area to others on the committee. Mr. Chandler commented that water and sewer to the site from the city would determine the density of the project . Planner Skelton voiced concerns whether the project would meet requirements for annexation. Roger Sicz commented that it would be tough to have service from his department if they were public streets . Planner Skelton asked if they are planning to get water and sewer service from the Bridger Creek project. Mark Chandler stated that they knew the service would have to cross the river and the property to the south will someday be developed and when it is developed the service would be there to tie into it if the service is put in place in this project. Phill Forbes asked if the area was included in the latest city 20 year planning boundary. He then went to get the map that would show this information. Rick Hixson asked where they thought the project would receive the service. Mark Chandler stated they haven' t looked at all the details until we get the go ahead that it is possible to do this project. John Paysek asked if they were going to connect off of Springhill . Mark Chandler responded that probably. Rick Hixson stated that they would have to have a river crossing and a lift station on the sewer service. Mark Chandler did not think they' d would have to have the lift station. Phill Forbes stated that the property was half in and half out of the 20 year planning boundary and showed the map to Mark Chandler. Phill Forbes asked Mark Chandler if his client was asking for annexation or sewer service. Mark Chandler responded that the client was asking more for city sewer service. Phill Forbes stated the condition of annexation in the future was typical in these circumstances and that as Planner Skelton had pointed out it is unlikely at this time that it would happen as the requirements for annexation will not be meet. Planner Skelton asked if there is any activity toward development in the property to the south and south west and if there was a piece of that property that the client did not own. Mark Chandler stated that there is no activity at this time and that there is a piece that his client does not own. Planner Skelton stated that the policy is to have no leap frog annexation but a planned growth. He commented that the client will probably need to look at suburban improvements with private water and sewer. He also asked the size of the acreage. Mark Chandler stated that it is 180 acres with a creek. Planner Skelton asked if it is Churn Creek and Mark Chandler responded that he was not sure. Mark Chandler asked if anyone is allowed to hook up to sewer without annexation. Planner Skelton stated that it is very, very rare to do so and that there must be extenuating circumstances to do so. Phill Forbes stated that one of the extenuating circumstances is when the project is existing and not proposed, as this development is . Planner Skelton offered to sit down and talk with Mark Chandler about what is needed to have the area rezoned so that a proposed development such as this could take place. Planner Skelton announced that due to the 4th of July falling on Tuesday next week the Development Review Committee is moved to Wednesday next week.
