Bozeman Care Center Z-9549 Planner Morris reviewed the project and noted that, although the proposed parking is inadequate and a bike rack is require, planning staff is recommending conditional approval of the twelve room addition. Fred Shields stated that the two existing domestic water services serving this building must be upgraded to current C.O.B. standards. Also if the existing 6" fire sprinkler is to be extended and utilized in the proposed new wing, it too must be upgraded. He added that the backf]ow/cross-connection deficiencies noted during a recent survey should be considered by the owner at this time for correction. Karen Finke's reviewed written conditions from the Engineering department concerning stormwater drainage and the two way drive access along the west property side. She explained that at the present time, the access will not meet the Zone Code requirements and is not, therefore, acceptable to the City. Craig Brawner asked about the over all parking. Planner Morris indicated that all parking is now across the street in the adjacent church parking lot resulting from a handshake agreement made a number of years ago between the church and the care center. He remarked that the project may hinge on whether the applicant would be able to obtain an revocable parking lease from the church. Craig Brawner commented that the center is not a commercial facility used only on the week days, but that the parking would be used seven days of the week. Since the applicant was not in attendance, Dave Skelton confirmed with Planner Morris that the applicant has been made award of staff and DRC concerns. Chuck Winn moved, seconded by Kurt Albrecht, to recommend conditional approval of the project. The motion carried with a unanimous voice vote of the members present. 2. Cupola PUD Z-9534 Planner Windemaker reviewed the project for a mixed industrial, commercial and residential use PUD on 38 acres at the easterly extension of Mendenhall Ave. She explained that the Planning Staff can not support the variance to construct Phase I foundations at the time of infrastructure improvements. Planner Windemaker noted the numerous physical constraints on the property include: wetlands, high ground water levels, floodplain, steep slopes and soils rated severe for development and indicated that she has received 15 letters in opposition to the request. The concerns range from increased traffic and loss of open space and wet lands to possible negative effects of the proposed uses. She added that some are also concerned about exhaust from semi trucks that would be allowed to run for extended amounts of time. Roger Sicz reviewed written comments from the Street/Sanitation Department. Planner Windemaker also received a memo from the Recreation and Parks Advisory Board with conditions on the project. This included a number of concerns on weed eradication, and trail development details. She has been unable to contact anyone on the board that could help clarify this memo, but will enter them as conditions. Planner Windemaker also read several site specific conditions included in her report. Chuck Winn commented that the access roads needed to be a minimum of 20 feet wide and any road in excess of 150 feet in length to include fire turn-a-round provisions approved by the Fire Department. Rick Hixson went over the engineering conditions for the plan including stormwater drainage and the requirement of a Site Grading/Geotechnical Plan. Project Specific requirements were in three areas: utilities, streets and environmental. Phill Forbes added that Phase II construction must provide a permanent, all- purpose second access to this site and the applicant would be required to obtain written approval from the ditch owners for any alterations. After Dave Skelton explained where the committee is in the review process, commented that several conditions set forth contradict the project. Keith Swenson requested clarification on the memo from the Recreation and Parks Advisory Board. Planner Windemaker commented that the conditions suggested by this board have been included in other conditions, but that she has asked that board for a clarification so theirs is more understandable. Dave Skelton reported to those present that all of the conditions will be given to the planner to be included in the staff report. He said the report can be viewed by the public on the Thursday before the June 20th Planning Board. After a discussion of whether to entertain one or two motions on the project, it was determined to entertain one. Phill Forbes moved, seconded by Chuck Winn, to recommend approval of the major subdivision and PUD with mixed use with the conditions set forth by the DRC. Dave Skelton point out again to the audience that there will be two public hearings for this project because of its nature, one on June 20 before Planning Board and one on July 3 before City Commission. Second Week Review 1. Hauser Building MiSP Z-9563 Planner Arkell was not in attendance, but Planner Skelton presented the report for her. Planner Skelton reported that this is a revised site plan that provided for infrastructure that the previous plan did not. He said the sewer and water line are now in the plan as well as an indication of the placement of the fire hydrant, but there is no indication of a clean out. He also commented that there is a contradiction of the North East corner and a floor plan is needed showing the meter location detail. Kurt Albrecht questioned the wall 15 feet off the southeast property line. Planner Skelton pointed out that is a retention wall. Karen Finke reported that she has not received the calculations, but the applicant stated that he had the calculations and would remit them to her. When asked what the purpose and use of the building would be, Larry Hauser stated it was for office and warehouse. Planner Skelton said the Development Review Board is also looking at this and that there is no variance involved. Dave Skelton asked one of the applicants to attend next week as there would be more questions. Initial Week Reviews 1. Danhot CUP Z-9557 Planner Windemaker reviewed this PUD request for a tri-plex in a B-2 Zone at 116 N. 8th. Planner Windemaker reported the plans are still showing steps into the city right-or-way and that parking comes in from an unimproved alley. She said the committee will want to look at what they want to do with it, i.e. pave it, etc. Fred Shields asked if it will be built with a crawlspace or basement. Planner Windemaker thinks it will be a crawlspace but has no indication at this time. Fred Shields stated that it will make a difference on installation of a water meter. John Paysek questioned if the south side line on the plan is a wall as he wondered how it will impact the property to the south. Planner Windemaker stated that part of PUD proposal was to allow stacking for the parking. 2. Carkeek Z-9547 Planner Skelton reported that Ray Carkeek has responded to concerns on Phase I. He said it is has been reduced from 19 to 16 condominium units with a spa to be used by only association members, a golf course is on the north half, and a single family residential lot is on the east. Planner Skelton stated the parking has been changed so they are not backing out into one another, but he still has a concern on the number of driveways backing onto Boryland Rd, however this group does not do the architectural aspects of projects. He commented that there are still several things that have to be done before this project can be approved. Fred Shields asked if the parking area of golf carts opened to the garage. After being told it did, he commented that it makes it very hard to get water service installed in that situation as they do not go under them. Craig Brawner asked if the water and sewer are stubbed up to the property line. Keith told him that they are. Phill Forbes asked about the existing storm inlet and Keith commented that at the connection of the drive way and inlet he has been told there is a grate that can be put in it to correct the problem. Phill Forbes stated that he knows about the grate and that the application did not turn out very well in locations that he is aware of. Dave Skelton stated that this committee still needs a letter from the Design Review Board for the Bridger Creek Subdivision Phase I. Fred Shields asked if it will be constructed on slabs or have a crawlspace. Ray Carkeek said it will be on a slab. A recommendation will be made in two weeks. Fred Shields asked if the applicant is proposing to phase this project or build it all at the same time. Ray Carkeek replied it would depend on financing. Initial Week Review and Discussion Item 1. Ponds Edge Major Site Plan Z-9556 and Ponds Edge Preliminary Plat Planner Skelton reported that this is a minor subdivision requesting a variance and a major site plan for 16 duplexes north of the Wildlife and Parks Fishing Ponds and east of Fowler Ave. He noted the original application was denied because of being too close to the fishing ponds, but there is a land exchange in the process to take care of this problem. He stated that pivotal to the approval of this subdivision is the Kim Walker property on the east as this will be a secondary access. Planner Skelton is receiving input from neighbors. He is still recommending that West Babcock be improved before any more subdivisions are approved in this area. He noted that question about SIDs will again come up when making this recommendation. Fred Shields pointed out that the water line is too long for a dead line. He and Craig Brawner suggested several possibilities to make this water line better designed. Comments on continuing a broad boulevard or tapering down of the road were made by Planner Skelton, Craig Brawner. John Paysek voiced concern that there seems to be a non-standard connection at Fowler and Ravalli. Phill Forbes commented that there are no interior sidewalks planned and that Mike Delany has offered to give the 33' easement to the city with the ditch to remain in private ownership. Planner Skelton pointed out that the preliminary plat has no access to lot 2 for sewer and water and therefore, the applicant is asking for variance for the easement. Craig Brawner commented that it is a poor way to get sewer and water to the lot.
