A. Final Week Review
1. Blackwood II Z-9523
Planner Morris reviewed the project and distributed the
revised water and sewer plans . He introduced Gerry Gaston, Gaston
Engineering, who explained the proposal .
Fred Shields questioned whether the proposed water booster
pump system would activate in the event of a main water shut down.
Gerry Gatson responded that a booster pump is not proposed as there
is no potential for water back. He indicated that the pressure
tank would be used only for storage. Kurt Albrecht remarked that
a pressure tank cannot be used in lieu of a properly sized water
service line.
Fred Shields indicated that he would need more time to review
the plans as he hasn' t had a chance to review them. John Paysek
added that Rob Bukvich, Montana Department of Transportation, will
require at least two weeks time to review them. Dave Skelton
remarked that if, after a week, Fred Shields is satisfied with the
water and sewer plans or is ready to make a decision, the State' s
review should not cause a major delay.
Dave Skelton commented that the DRC will make a final decision
on the project next week. He asked the Committee Members to call
Planner Morris with any major items of concern resulting from the
review of the new water and sewer specifications .
2 . Jackpot East SUP Z-9540
Planner Windemaker addressed the Staff Report sent to the
Development Review Committee regarding five zoning regulations that
have not been met and need to be corrected prior to Final Site Plan
approvals well as four Boiler Plate Conditions .
Fred Shields reviewed written comments from the Water/Sewer
Department dated May 22nd.
Kurt Albrecht stated Fred Shields concerns appeared straight
forward.
Dave Skelton asked for a motion.
Chuck Winn moved and seconded by Phill Forbes, to recommend
approval of the proposal with the conditions set forth by the
Planning Staff and the DRC. The motioned was approved.
3 . HRDC Major Site Plan - Z-9553
Planner Arkell announced the project location and reviewed
written concerns and recommendations from her Staff Report to the
DRC dated May 23 , 1995 .
Fred Shields stated the same standard Boiler Plate conditions
apply as written from the Water/Sewer Department .
Planner Arkell stated the City Park has reviewed the types of
trees to be located at this location and John McNeal advised they
were acceptable.
Phill Forbes stated he would like an application to address
the parking situation.
Fred Shields stated one service to two buildings in not
acceptable. He also stated that regulations state that a new
street can not be cut for seven years and Phill Forbes stated there
would be no lifting on a moratorium regarding the street.
Dan expressed his concern that if there needed to be one
service to one building, and the street could not be cut to
accommodate these conditions then a tri-plex would have to be built
and the tri-plex would not meet the zoning codes .
Dave Skelton asked for a motion.
John Paysek moved, and Kurt Albrecht seconded, for approval
with the recommendations of the DRC. The motion carried with a
unanimous voice vote of the members present.
B. Second week Review
1. Cupola PUD Z-9534
Planner Windemaker addressed the need for each phase of the
project to have the ability to stand on its own and handed letters
to Fred Shields and Phill Forbes regarding same concerns .
Planner Windemaker address the point that all attempts must be
made to minimize the conflicts over the industrial and commercial
usage, the time needed for each improvement and the need for weed
control for grading areas .
Planner Windemaker expressed her concern for week control for
grading areas .
Rick Hixson question the applicants intent to submit storm water
and grating plans for each building site as it comes up or one
master plan for all .
Roger Craft informed the committee the plans were designed as
a whole, however individual plans will be submitted for each phase.
Lanette Windemaker voiced concern regarding the dead end.
Chuck Winn informed the Planning Staff that anything over 150
feet needs a turn around.
Roger Craft noted the applicants plan to install a sprinkler
system for the entire subdivision and thinking of individual
sprinkler system for the residential area. Chuck Winn advised the
Staff that he sees no problem and can work with the applicants
plans for fire vehicle accessibility access it.
Rick Hixson brought attention to Phill Forbes regarding the to
the outstanding right of way on Highland Boulevard showing a 75
foot arterial opposed to the required 90 foot . Phill Forbes stated
the City Commission will make their decision based upon the
Planning Staff' s recommendation.
Fred Shields noted he had several unresolved questions
and would like to meet with the applicant to resolve them
C. Initial Review
1. Bozeman Care Center Z-9549
Planner Morris stated the application was for a Conditional
Use Permit for an additional 12 unit wing located west of Villard
Street and 5th in the conservation overlay district, and will,
expand the existing building by 5114 feet.
Planner Morris noted the parking off the back side of the
existing building was substandard, and the applicants need to apply
for a deviation to allow property encroachment to the rear set-
back.
Planner Morris questioned the requirements needed for the 15%
expansion. Dave Skelton advised Planner Morris that the DRC will
act as an advisory capacity only.
Kurt Albrecht noted the lack of protection of the existing
windows . Regulations require 3/4 hour protection on the existing
windows as a fire protection.
D. DISCUSSION ITEM
1. SERVE YOURSELF FURNITURE STORE - C-9505
Planner Arkell announced the application for a multiple
variance permit for the building of an additional structure. A
variances is required due to the nonconforming parking and
accessibility. Planner Arkell noted the additional 7000 square
feet added to the building will reduce the parking from 69 plus 3
disabled parking spaces to 42 plus 2 spaces and the applicant does
not wish to landscape the north end as that area houses the plowed
snow.
Planner Arkell advised the Committee the applicants were given
the a variance to use the existing parking lot and the applicants
would like to carry over the variance to be included into their new
plans .
Phill Forbes voiced his concern that the transportation is
coming close to overlaying Durston with the addition of 71, to the
existing 1818" sprinkler system .
Fred Shields voiced concern regarding the ongoing problem of
traffic cutting through the store' s parking lot on Durston to get
to 7th in order to beat the light.
Planner Arkell noted pedestrians are a major concern at that
light as well and the owner does want to cut the traffic, however
the owner does not want to get rid of his now removal area.
