DEVELOPMENT REVIEW COMMITTEE MINUTES - JULY 25, 1995

Final Week Review - Countryside PUD MaSub P-9530
Planner Skelton reviewed the proposed project as a subdivision PUD
for the purpose of relaxing the street standard. He reviewed the
conditions including new ones concerning the placement of the park
area which the Recreation Department had sent in a memo to him.
Planner Skelton is electing to allow the developer to work out the
details with the City Commission and the Parks Advisory Board.
Planner Skelton stated that another condition of concern is -
gaining access to the property from Fowler. The condition is
asking for 60 , right-of-way and the street standard will be the
same north to West Babcock of 321 . He noted that with the Pond' s
Edge proposed project a condition included 60' ri.ght-of-way across
the Delaney and Montana Department of Wildlife, Parks , and
Recreation and that the sj'�Lmeis being asked of this project. He
stated that it could be a u£ik`l.ity
Planner Skelton stated that the sidewalk from Ravalli north to West
Babcock is only 3' wide with the street 32 ' wide . He stated that
5' curb sidewalk on both sides of the private streets are to be
provided and that they are not to be boulevard sidewalks , he
continued with the conditions stating that access is to be provided
to pedestrians to the fishing ponds and that most of this is
referenced in the Homeowner Covenants documents .
P1a ner Skelton stated that the side of the private street on which
the No Parking signs will be placed is left to the applicant to
decide and the snow removal area on the private streets also need
to be designated on the final plat. He noted that one of the
conditions will require the homeowners to create their own Design
Review Board to create the accepted color palate for the buildings
in the subdivision. Planner Skelton commented that he would
entertain discussion by Lonny walker concerning this condition and
if he is adamant he might consider removing this condition.
Planner Skelton stated that the landscape trees are being called
Street Scape trees and not boulevard trees as they will be inside
the sidewalks .
Planner Skelton stated that condition #12 addresses having single
family homes on the east side of the proposed project instead of
the duplexes as shown on the plan. He said a screening fence is
also to be placed on the ease side with the design given to
Planning to work between the developer and the homeowners .
As previously noted, Planner Skelton pointed out that condition #13
concerns the park land on the south end.
Planner Skelton asked Fred Shields if the utility easement needs to
be increased. Fred Shields stated that all water not in the public
right-of-way needs to be in a 30, utility easement with no trees in
the easement and all water and sewer lines are to be clearly
indicated on the final landscape plan. He said Montana Power will
need to be asked for the size of easement they will need. Fred
Shields also stated that the water and sewer needs to be adequately
looped and fully usable as well as tested and fully acceptable by
the City of Bozeman before building permits will be issued.
Roger Sicz stated that he would still like to see the standard
street in this area. He said another concern is the open ditches
and would like to see on the deeds who is responsible for the
ditches . Planner Skelton said that was a good comment and should
be included on the Home Owner' s Association. Roger Sicz stated
that the ditches need to be documented on who is responsible for
any overflowing.
Chuck Winn submitted a copy to Planner Skelton of the letter he had
written to Lonny Walker.
Planner Skelton asked if the committee had talked about the
alignment between the two adjacent properties . He wondered if the
committee was in a position to look at the two plans to see if
they are concurrent. Bruce Foley stated that the two projects are
concurrent. Planner Skelton noted that both projects have the same
designers .
John Paysek reviewed the engineering conditions stating that the
majority are typical . He did point out that #19 concerning the
sidewalks is one of the special conditions for this project . #19
outlines the conditions that within three years of plat approval
sidewalks on both Countryside East and Countryside West are to be
complete. The sidewalks to Ravalli north to Countryside West and
Countryside East on the back of the lots are also to be done with
the property owners to be responsible for the front sidewalks .
Bruce Foley stated that he understood the sidewalk along the north
end but stated it seemed in order to be consistent on the east side
to have the private owners responsible for that sidewalks . John
Paysek confirmed that he was talking of the back side of the lots
that the developer was to be responsible for. Bruce Foley stated
that it seems to be inconsistent to ask Lonny Walker to do this .
John Paysek stated that because the city has no jurisdiction on
private streets this was the reason for this condition. Planner
Skelton stated that he thought it would be o .k. although there may
be a problem with the curb cut but it could be in the home owner' s
covenants to install the sidewalks .
John Paysek stated that engineering will probably not be out to
perform inspection on the private streets and therefore could not
guarantee that it would not be done on the private streets . Phill
Forbes stated he thought the conditions were o .k. as written as in
the recent past the committee has stated that sidewalks will be
provided by the developer, period.
John Paysek stated that condition #21 is placed to discouraged any
public flow of water across the streets . He said valley gutters
will not be allowed except at the intersection of East Countryside
Dr. and Ravalli to channel flow to the north _ He stated that
condition #22 is similar to Fred Shields concerning the water and
sewer line placement.
Planner Skelton stated that the developer needs to double check on
any waivers on zone amendment on West Babcock and Fowler as well as
waivers on signalization on those two streets . Phill Forbes stated
that Fowler needed to be added to condition #15 .
Bruce Foley asked about the particular payback stated in the
conditions and after some discussion between Fred Shields , Phill
Forbes, John Paysek and truce Foley it was decided instead of
stating"662 it should say 622 .
Planner Skelton stated that the committee is typically still
recommending that no improvements be allowed until improvements to
West Babcock be done.
John Paysek moved, Seconded by Fred Shields, to recommend
conditional approval of the project with the condition outlined by
DRC. The motion carried with a unanimous voice vote of the members
present.
