RESOLUTION NO. 34.
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
AUTHORIZING AND EMPOWERING Trill MAYOR AND CITY CLERK OF SAID CITY TO
EXECUTE A CONTRACT ON BEHALF OF THE CITY OF BOZEMAN WITH MARY D.
SHRIVER FOR THE PURCHASE OF A PORT ION OF I,OT 4, BLOCK 1 OF BABCOCK
ANTI DAVIS ADDITION TO THE CITY OF .BOZEMAN, MONTANA.
BE IT RESOLVED BY THE COMMISS ION OF THE CITY OF BOZEMAN:
That whereas, an application has been made to the City Commission of the
City of Bozeman by Mary D.
Shriver for the purchase of the following described real
estate, to-wit:
All that portion of Lot 4, Block 1, of Babcock & Davis Addition
to the Town (now City) of Bozeman, Montana, included within the
following metes and bounds, to-wit: Beginning at a point in
the east line of Lot 4, Block 1,
of Babcock and DaviB Addition
to the Town (now City) of Bozeman, said point being 117 feet
south of the northeast corner of said Lot 4;
thence south along
the east line of said Block 1, 30 feet; thence west parallel
with the north line of said Lot 4, 110 feet, more or less, to
the west line of said Block 1, 30 feet; thence east parallel
with the north line of said Lot 4, 110 feet, more or less,
to
the place of beginning.
And whereas,
the said Mary D. Shriver has agreed to pay therefor the
total 8um of $240.00 as follows:
the sum of $40.00 down upon the execution of A
Contract for the purchase of the same and $20.00 per month" ::JUch monthly payments to
begin J"uly 1, 1924, and to continue until said purchase price of $240.00,
together
with interest at the rate of six per cent per annum on the sums from time to time
remaining due, ahall have been pa~d;
And whereas,
it appears to the best interest of the City that a sale of
said real estate should be made upon said terms;
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
Bozeman, Montana, that the Mayor and City Clerk l)e authorized and empowered to en-
ter into a contract on behalf of said City of Bozeman with the said Mary D. Shriver
for the purchase of the above described real estate upon the terms above set forth.
Said contract to provide that in the event the said Mary D.
Shriver defaults in the
making of any monthly payment for a period of thirty days that said contract may be
null and void at the option
of the City of Bozeman and all payments made thereon
forfeited.
Passed by the CityCommiBSion of the City of Bozeman, Montana, and
approved by the Mayor of said City this 8th day of May, 1924.
