Chairperson Dave Skelton called the meeting to order.
A. INFORMAL REVIEW

Historic Preservation Officer Derek Strahn presented the project. He noted that a CUP had
been granted on this project several years ago. Mr. Gerster is proposing to buy this property
and wants to expand upon the original CUP. Mr. Strahn noted, also, that Planning Director

Mr. Pertzborn reviewed the old CUP. He noted that the old CUP allowed street parking and
wanted to know if those parking spaces are still available. Chairperson Skelton responded
that on-site parking would be required unless Mr. Gerster applies for and is approved for a
deviation. Mr. Pertzborn noted that his client wants to avoid building the 9-car parking lot
at this time. He is negotiating to buy a 50' strip from Montana Power. Chairperson Skelton
noted a concerned with encouraging the parking on the street, especially when it is so
narrow.
Mr. Pertzborn noted that the street was vacated a few years ago and ends in a kind of cul-de-
sac. He continued that he's trying to avoid any surprises in the Project Review process. He
doesn't want to pay for the paving of the street, curbing, and sidewalks.
Mr. Woodward noted that the street is full of infrastructure. He continued that the project
will probably require a odwardrger water service noted that grease traps. Discussion ensued on the there needs to be a study of the number of e

suggested that Mr. Pertzborn visit with Planner Chris Saunders about impact fees.
Mr. Forbes noted that the street needs to be developed to the current level of service. Mr.
Pertzborn inquired of the City's use of the Haines Building. It is used for storage.
Discussion ensued on the state of the finish on Aspen Street. Chairperson Skelton suggested
that since Mr. Gerster plans to put in the parking lot within a year, it is possible, with a
financial guarantee-upon the approval of the Site Plan, to do it all with one application.
Mr. Pertzborn noted that he may be coming in with a Phasing plan, also.
Discussion ensued on the need for the 50' strip of parking space. Mr. Forbes commented on
the type of street that will be required. Mr. Pertzborn asked for an estimate on the paving.
Mr. Paysek estimated the cost to be about $22,000, without curbing and gutter work.
When asked about the demolition of the carriage house, Mr. Pertzborn stated that his client
would like to just gut the building and then remodel it, however, Mr. Pertzborn isn't sure the
structure is sound. If not, then they will build a new structure. Mr. Woodward noted that a
new structure would require new sewer and water hook-ups. Discussion on the number of
bathrooms to be included in the two buildings.
Mr. Paysek noted that some sidewalks will be required from the parking lot to the buildings
and on the street. Mr. Pertzborn inquired if the seven street parking spaces are still available
to Mr. Gerster. Mr. Strahn noted that Planning Director Epple had said that he thought they
would be available to the new owner.
Mr. Paysek discussed plumbing code requirements.

Historic Preservation Officer Derek Strahn presented the project and introduced Mr. Robert
Dougherty. Mr. Strahn noted that Mr. Dougherty is proposing to subdivide the property into
three lots. Mr. Dougherty noted the changes made since DRC last saw the project -
including the parking configuration and the water/sewer lines. He asked for comment on
these items. He also noted that the owner wants to keep the proposed gate on the fence
dividing lots 1 & 2 for maintenance. The tenants would not have access to it.
Chairperson Skelton noted that the driveway is required to be wide enough for two-way
traffic. He is uncomfortable with two-way traffic in the narrow entrance on Rouse Avenue.
Discussion ensued on reasons to leave the driveway as is - the main reason being that two
large trees would have to be removed.
Mr. Dougherty explained that there is a 4-plex located on the property now. The parking for
it is bad due to lack of paving. Planner Patterson suggested a well around the tree, then
widen the driveway.
Mr. Strahn noted that Mr. Dougherty will need to apply for a deviation for the 4-plex as it is
a non-conforming structure in a "R-3a" zoning district. Planner Patterson noted that parking
may require another deviation application.
Chairperson Skelton asked for discussion on the water/sewer. Mr. Woodward disagreed with
the location of the water service on the plan. Mr. Dougherty noted that he would check on
the location with Mr. Woodward at a later date. He continued by asking about the
availability of water service under Rouse Street. Mr. Woodward noted that it could be
tapped into. Mr. Dougherty inquired about installing a utility sink in the garage - would it
have to have a separate water/sewer service? Mr. Woodward responded that it would.
Chairperson Skelton asked DRC about the one-way driveway and the shared access. Mr.
Forbes inquired about parking for the cabin and the access. Mr. Dougherty noted that
parking is achieved by driving through from Perkins Place to the parking space. Mr. Forbes
noted he had no problem with it being a single access for the cabin. Chairperson Skelton
asked DRC about the gate. The members concluded that they were not in favor of through
traffic.
Mr. Forbes noted that he is in favor of a full width driveway on Rouse.

B. INITIAL WEEK REVIEW
1. Northern Lights MiSP #Z-9633 - (Arkell)

- A Minor Site Plan Application to allow construction of a storage
addition, re-build upper deck and stairs, and add 5 new parking spaces.
Planning Director Andrew Epple presented the project. The proposal is to expand the
building, rebuild the upper deck and repair the stairs, and add five parking spaces.
Mr. Woodward noted that the original building was required to put in a fire line. Mr. Winn
confirmed that no fire line was put in. He continued that the basement probably isn't
sprinklered. Discussion ensued on the existing water service and the needed service.
Mr. Paysek noted it is an opportunity for obtaining a Wavier of Richt to Protest on paving of
W. Babcock.
With the exception of the status of fire line and sprinkler situation, DRC Members felt the
project posed few, if any, problems.

C. MODIFIED SITE PLAN REVIEW

Proposed revision of previously approved Minor Site Plan condition of
approval.
Planner Dean Patterson presented the details of the modification in a memo. (complete text
on file at the Planning Office.) Discussion ensued on ways to widen the easement as only
7.5' is available between the house and the property line. Planning Director Epple noted that
joint access would eliminate the need for a deviation. Planner Patterson noted that Mr. Winn
expressed no problem with the existing situation. Mr. Forbes would like to see the building
turned and a regular drive installed from Lamme. Planning Director Epple noted that Mr.
Forbes's idea may be the best and the applicant could build a shared access with his
neighbor. Discussion continued. Discussion followed on the alley ownership problem.
Planning Director Epple noted that Mr. Forbes's suggestion puts the solution in the hands of
the applicant, where it should be.
Mr. Forbes noted that there are a number of 8-9' driveways that were installed around
houses to the garages all over Bozeman. Discussion ensued that the applicant needs to have
at least 10' for the driveway. Planning director Epple suggested a re-write of the condition
that the applicant either prove ownership of the alley or turn the garage and put in a joint
access at least 10' wide from the front of the house.
Mr. Forbes moved, Mr. Paysek seconded, that the original condition have added to it, "if
legal access from the alley cannot be established, then the building shall be reoriented so
access to the garage is from the south and a driveway shall be constructed at least 10' wide
with an easement for joint access recorded with the Gallatin Clerk and Recorder, with the
parking and access plans to be approved by the Planning Office. Planning Director Epple
inquired if this will affect the DRB. Planner Patterson stated that he would take this project
back to them.
Motion carried unanimously by voice vote.
