A Major Subdivision Application to allow 47 single family lots and 1
condominium lot in Phase 2 , and 44 single family lots in Phase 3, for a total of
92 lots.
Senior Planner Dave Skelton reviewed the project. He noted that the Committee will be giving
a recommendation to the Planning Board and the City Commission. Mr. Paysek noted he has
conditions from Mr. Sicz. Planner Skelton received a request from Mr. Andy Kerr to not
release the financial guarantee for Phase I because all the improvements have not been installed.
Planner Skelton noted there is a conflict with putting the utility easement along the front of the
lots. Mr. Paysek noted a need for a condition for a front yard easement. Mr. Woodward noted
the water/sewer installation inside the 12' easement is great, however, he is concerned about the
safety of workers digging up the lines and finding an electric cable. He continued the curb box

could be in the normal location, however, the contractor would have to visually inspect all ports
before paving. A discussion on utility easements and how to get infrastructure and services both
in the utility easement without causing safety problems when servicing.
Planner Skelton reviewed Staff conditions (on file at the Planning Office). He commented on
several conditions, including: condition #3 - only single-family dwelling units allowed on this
project except for Lot 16 (the condominium lot); condition #4 - utility must be installed in rear
or side yards unless written approval to place them in the front yard is obtained form all utility
agencies and the Public Service Director; condition #5 - drainage stripes and utility easements
be identified in the homeowner's protective covenants and be identified on the Final Plat as
common open space; condition #6 - the park land for Phase II be included with Phase III in the ..
trail corridor and buffer area and be held in a "perpetual easement" and filed at the Clerk and
Recorder's Office; Condition #8 - a public access easement and/or public linear trail corridor
connecting the East Gallatin Recreation Area and McMhattan Road shall be provided and
installed prior to Final Plat approval (after approval by the City of Bozeman Park Department);
condition#9-the applicant provide documentation of providing water rights, etc., prior to Final
Plat approval; condition #10 - installation of City standard streets including curbs, gutters,
sidewalks, etc., prior to Final Plat approval; condition #11- the applicant improve Story Mill
Road to the north end of Phase III to a Gallatin County paved road standard with review and
approval of the Gallatin Road Superintendent, installed prior to Final Plat approval (a variance
for a less than 24' wide roadway will have to be requested and granted from County
Commission prior to Final Plat approval); condition#12 -the wetlands located on the property
be identified on the Final Plat for review and approval by the City Engineer's Office and Army
Corps of Engineers prior to Final Plat approval; and condition #14 - the applicant be granted
a waiver from the Bozeman Area Subdivision Regulations requiring a second or emergency
access for Phase II.
Mr. Paysek presented his staff report (on file in the Planning Office) including: condition #3 -
waivers from protesting future SIDs or RIDs. Mr. Belden inquired about impact fees. He noted
that since Phase I was built before the impact fees went into effect, it shouldn't be affected. Mr.
Forbes concurred. Discussion followed on street improvements.
Mr. Paysek continued with his conditions: condition#5 - a geotechnical report will be required;
condition #7 - a traffic analysis report is required with minimum requirements; (Mr. Belden
requested a copy of the environmental review that was done.) condition#9 - a 100' continuous
buffer between Phase III development and the existing City Landfill (the Final Plat shall include
a 70' no-build easement buffer strip along the back property lines of lots 15-22 and the 30' wide ..
park strip). Mr. Belden objected to the 100' buffer between the lots and the landfill. He
continued that he is adamant about not "giving" a 100' buffer. Discussion followed on the
buffer. Mr. Forbes stated City staff is equally adamant about protecting the future property
owners; the buffer needs to be there. Mr. Easton inquired why there wasn't a buffer left when
the City built the new cell at the landfill. Discussion continued.
Mr. Paysek continued: condition #10 - a paved 20' roadway with 2' graveled shoulders is

required and will be extended to the northern end of the property in Phase III. Discussion
ensued on paving, shoulder width, and the reality of installation of a standard roadway. Mr.
Belden noted the creek would have to be moved to get the required 24' roadway. Mr. Brawner
inquired about the septic system condition. Mr. Easton will investigate its condition. Mr.
Paysek noted the City is concerned about providing adequate access. Mr. Belden inquired if the
condition could be worded similarly to the same condition in Phase I. Discussion continued.
Mr. Paysek continued: condition #11 - a 60' road right-of-way from Story Mill Road to the
northerly terminus of the proposed subdivision; condition #12 - recommending guardrails be
installed, if so, to MDOT standards and a detailed guard rail analysis; condition #14 - looped
water system; condition#15 - requesting a 20' wide sewer easement between lots 21 and 22 in
Phase III. Discussion ensued on the need for the easement. Condition#16 - the developer shall
complete an application for sewer service and be retroactively responsible for sewer service
charges from the time of the connection to the application approval; condition #19 - show a
clear location of existing and proposed sewer and water mains and easements as well as existing
fire hydrants and proposed fire hydrants. Planner Skelton inquired about the monitoring wells.
Mr. Paysek stated that condition #8 covers them.
Mr. Woodward stated that Mr. Paysek covered his concerns. Mr. Belden would like condition
#23 of Mr. Paysek's report to allow the use of contours in Phase III. Mr. Forbes inquired if
there is any encroachment into the flood plain. Mr. Belden indicated on the map one place
where it encroaches and how he planned to accommodate it. Mr. Brawner stated there should
be a condition including A, X, and floodway. Mr. Brawner and Mr. Belden discussed flood
plain information.
Mr. Paysek read Mr. Sicz's comments for the March 5th Planning Board.
Planner Skelton will compile staff comments for Planning Board on March 5th.

- A Major Site Plan Application to allow the construction of three 5000
square foot retail/office buildings.
Planner Dave Skelton presented the project. It is the Walker property on Springhill
Road/Frontage Road/ Interstate 90 intersection. In discussions with the applicants, he has
convinced them to share accesses between the lots. The property is outside City limits.
Mr. Woodward stated the sewer would require a main extension and three stubs. Discussion
followed on sewer/water. It was decided the water supply in the area is a community water
supply.
Mr. Paysek inquired if the streets were to be public or private. Planner Skelton stated they are
to be private.
Mr. Winn moved, Mr. Hixson seconded, the meeting be adjourned. Motion carried
unanimously.

- A Major Site Plan Application to allow the construction of a mini-storage
warehouse facility.
Planner Dean Patterson reviewed the project. He distributed a letter from Mr. Turner (on file
at the Planning Office) concerning access.to Rouse. Planner Patterson presented the conditions
of the Planning Office. Condition #1 -- only one access onto N. Rouse will be allowed by
MDOT. Conditions #245 deal with FPS specifications. Condition #6 spells out parking
requirements. Conditions #7 - #9 are concerned with curbing, vegetating storm drainage areas,
and disposing of the asphalt paving spoils located on the property. Condition #10 speaks to the
Improvements Agreement to guarantee the installation of on-site improvements. Conditions#11
insures the length of the validity for the security of the on-site Improvements Agreement and
the time limit for completing on-site improvements. Conditions #12 and #13 are standard boiler
plate conditions. (The full text of the conditions is on file at the Planning Office.)
Mr. Hixson reviewed his departments conditions (on file at the Planning Office). He stated that
several were boiler plate, however, there are some of the others are as follows: The water has
to be looped. The site has to have adequate drainage. Adequate utility and other easements
must be shown on the FSP, with proof of recordation. Infrastructure must be installed as to
City, State, and Federal requirements. Flood plain information needs to be accurately depicted
on the Site Plan. Waivers for right-to-protest have to be supplied for orderly and necessary
street improvements or signalizations.
Mr. Springer asked if water and sewer main extensions have to be done before building permits
will be approved. Mr. Hixson answered affirmatively. Mr. Springer stated that DRB want them

to save some trees, however, the trees are diseased, dead, and/or old. They are not worth
saving.
Mr. Woodward presented his departments conditions (on file at the Planning Office). He noted
the cost of the application for connecting to an existing sewer main and the gravity portion of
the existing sewer main to be inspected by television inspection and a copy of the video be
furnished to the City of Bozeman. He stated the rest of the conditions were boiler plate.
Mr. Winn summarized his conditions stating the sprinklering requirement and the need for knox
boxes. He asked for the location of the second access. Discussion ensued on the accesses. Mr.
Morley stated that the snow removal area will be moved to accommodate the new second access.
Mr. Hixson noted that any approaches have to be approved before installation.
Mr. Mabee noted that'frost footings have to be installed in some buildings.
Mr. Winn moved, Mr. Forbes seconded, to recommend conditional approval to the Planning
Board with conditions from DRC. Carried unanimously by voice vote.

There were no conditions from Engineering. Mr. Mabee stated that anything to do with building
issues would be dealt with at the final plan review.
Mr. Hooper, a visitor in the audience, asked if the State has issued a liquor license for this site.
Chairperson Skelton allowed the question and responded that the State had not and wouldn't
issue it until the project receives approval.
Planner Patterson moved, Mr. Forbes seconded, the project be approved subject to the
conditions by the DRC. Motion carried unanimously by voice vote.

Planner Chris Saunders reviewed the project. He noted a few minor conditions (on file at the
Planning Office). There was discussion on the type of lighting to be used.
Ms. Finke stated the applicant was to use standard water meters and install a service manhole.
Mr. Woodward stated most of his conditions were boiler plate, however, condition#5 states that
permission from the City Commission is needed to obtain sewer service outside City limits
(complete set of conditions on file at the Planning Office).
Mr. Forbes reminded the Committee that the entire subdivision was granted approval for sewer
hook-up when the subdivision was approved.
Planner Saunders relayed Mr. Gianfrancisco's conditions on the roadway being a standard 24'
and paved. Mr. Horton stated that Mr. Gianfrancisco hadn't said anything about a cul-de-sac,
though, he is willing to pave the roadway the extra 4'. Chairperson Skelton stated that boiler
plate improvements agreement will be conditioned for doing the paving. Mr. Winn noted there
appears to be room for a fire truck to turn around. Mr. Brawner stated that if this is a platted
street and a cul-de-sac was planned, then it should be included. Chairperson Skelton suggested
graveling the cul-de-sac as has been done in another similar situation.

Chairperson Skelton asked for a decision on the application. Planner Saunders moved, Mr.
Forbes seconded, conditional approval of the project. The motion carried unanimously.
Chairperson Skelton reminded the applicant if there is to be an appeal of the decision, the appeal
must be made by Friday afternoon.

- A Major Site Plan Application to allow the construction of a 69 unit motel.
Assistant Planning Director Debbie Arkell reviewed the project. This Committee will be making
a recommendation to the Planning Board. The Planning Staff found that the application complies
with the requirements of Chapters 18.30, Bozeman Zoning Code, and 18.43, Entryway
Overlay, and with Section 18.52.030F, site plan review criteria, and is recommending
conditional approval of the project. Planner Arkell reviewed the Planning Staff s recommended
conditions. The Planning Office received a letter from Berg, Lilly, Andriolo, and Tollefsen,
attorneys for Best Western Grantree Inn in protest of this project and with a request that the
project be denied. Planner Arkell read the letter into the record.
Mr. Paysek, in his presentation of Engineering Staff s conditions (on file at the Planning Office),
concurred with Planner Arkell's condition regarding improvements at the intersection of North
7th and Baxter Lane. He stated that his greatest concerns were with the proposed sanitary sewer
lift station and forced main, the looping of the water main, curbing and pedestrian facilities
within the site and along Baxter Lane, and the need for executed Waivers of Right to Protest
Creation of SlDs. He has a concern about requiring the installation of sidewalks along Baxter
Lane. Mr. Brawner stated though he is in support of sidewalks, he doesn't want a sidewalk that
goes nowhere. Planner Arkell rescinded her sidewalk condition #le, as Engineering condition
#11 is more appropriate.
Mr. Woodward stated that Mr. Paysek had covered all of his concerns and conditions.
Mr. Brawner added a condition to require a hydraulic analysis of water and waste water to be

provided by the applicant's engineer to his office. The analysis must show there is adequate
capacity for water. Mr. Paysek added a condition that, for approval, the analysis must also
ensure that the project does not create a sewage problem for any of the downstream businesses.
Mr. Forbes requested that Mr. Paysek's condition #12 also include a waiver of SIDs for
improvements to N. 11th. The applicant must also provide adequate easement for N. 11th. The
easement as shown on the site plan is acceptable, but has to be dedicated.
Mr. Bukvich noted the reason that no requirement for improvement to the N. 7th/Baxter Lane
intersection was required when Grantree Conoco was constructed was to wait and see what
would happen to traffic when N. 19th was in service. The study by Morrison/Maierly shows
that the problem still exists. His department wants the problem addressed.
Mr. Bell asked if water looping will be required regardless of the result of the hydraulic study.
Mr. Paysek answered affirmatively. He continued that the City needs to be sure there is
adequate flow to meet fire flow needs, and a loop is needed to provide multiple water sources
and circulation, to avoid the loss of residual chlorine and stagnation.
Mr. Winn noted his department would require on-site fire hydrants. Mr. Rand indicated there
are two on the site plan, though they are hard to locate. Mr. Winn stated the number of
hydrants will be determined by the square footage of the building, and the location of the
hydrants must be approved by the fire and engineering departments during water plan and
specificaiion review.
Mr. Paysek moved, Mr. Forbes seconded, to recommend conditional approval of the project to
the Planning Board with the conditions outlined and modified by the Committee. Chairperson
Skelton commented that when an artificial lot is created, the developer has a responsibility to
ensure new infrastructure will accommodate growth in the community. Chairperson Skelton
added a conceptual plan for the remiander of the property and how the infrastructure for this
artificial lot fits in with the future development of the remainder of the site should be submitted
to ensure the proposed infrastructure is adequate. The motion carried unanimously by voice
vote.
