B. INITIAL WEEK REVIEW
3. Cowdrey Apartments #Z-95158 - (Arkell)
504 South 22nd Avenue
- A Conditional Use Permit Application to allow a 24 unit final phase to a
P.U.D. With this application the total number of dwelling units will be 56.
Assistant Planning Director Debbie Arkell presented the project. She stated this project was
previously reviewed through the concept PUD process, but it has now been determined that a
PUD is not necessary becuase not more than 40% of the site is being covered with structures,
and there is no other density regulation in the RO zoning district..
Mr. Sicz stated that the additional traffic will load up the intersection at Koch and Nineteenth.
Planner Arkell expressed concern about the trash enclosure. Mr. Sicz stated that he will send
Mark over to have a look at it.
Mr. Forbes stated that parking needs to be more defined. A separate parking lot accessed from
22nd would be good.
Discussion ensued about access problems with Albertson's egress/ingress.
Mr. Forbes stated that access is not proposed onto Koch, and none would be allowed if the
project is reconfigured. Mr. Sicz stated that in the future there may be no parking allowed on
one side of Koch.
Mr. Woodward stated that the water main cannot go under one building to service the other
building. Also there is a detention pond in the way of the proposed water main. It is also a
long distance from the water main to the eastern-most building. There is a water main on the
other side of Koch.
Planner Arkell inquired if there is sewer service nearby. Also, could the storm water in the
detention pond be dumped into the City's storm sewer.
Ms. Karen Finke stated that she had no problem with that.
Mr. Forbes stated he'd like to see an orientation change to keep the buildings closer to the
mains.
Mr. Woodward stated that sewer shouldn't be a problem as long as there is enough grade to
maintain flow.
Mr. Mabee stated that with the lower level being below grade, there might be a problem for
sewer that would require a pump.
Planner Arkell stated that the new units will have 12 apartments each. She noted that DRC will
make a recommendation to the Planning Board.
Mr. Forbes moved, Mr. Mabee seconded, that the meeting be adjourned. Motion carried
unanimously by voice vote.

2. Rocky Mountain Roasting MiSP/DEV #Z-95142 - (Patterson)
7th and Main
A Minor Site Plan Application to allow the construction of a 3200 square
foot bakery/coffee shop with 400 square feet of support office space and
associated parking.
Planner Dean Patterson presented the project. Discussion ensued on the variance granted
by the City Commission. Planner Patterson stated that the applicant is applying for a deviation
for a 5' encroachment into the Main Street frontyard. He further stated that the Main Street
entrance has become problematic for DOT. The proposed parking is adequate. The parking lot
drains to the west to a catch basin. The applicant plans to build around the trees. The project
needs an irrigation plan and there needs to be drainage through the parking lot landscape area.
Planner Patterson continued with a suggestion that some sort of tree protection plan be
considered. Other issues include snow storage, power poles in the alley, light standards too
close to parking stalls, and grease traps for the bakery.
Chairperson Skelton stated DRC's purpose to Mr. Delaney.
Planner Patterson explained the elevations. He requested that Mr. Delaney bring more
detailed elevations.
Mr. Paysek stated Engineering's concerns with retention and the parking lot catch basin,
and asked if retention or detention will be provided on site. He raised concerns about traffic
around the power poles in the alley. Montana DOT is requiring curbs around the power poles
with three feet of clearance on either side, or eliminate the poles. Discussion ensued on moving
the power poles and which one to move. He went on to note that 12' of drive space is needed
for each lane in the alley.
Mr. Delaney explained that he used the same design as used across the street at the Me
and Jan's Gas Station. He noted that one pole could be removed, according to Montana Power,
if the other were braced.
Chairperson Skelton suggested that Planner Patterson and Intern Planner Christopher
Williams work out the alley problem between the two business, as the Holiday Station across
the alley is in the planning cycle, also.
Mr. Rob Bukvich stated that a traffic island will need to be constructed in the access
entrance to restrict incoming and outgoing traffic to right-in/right-out only. It needs 100 sq. ft.
and the power pole cannot be located within in it. He inquired if the alley was Mr. Delaney's
property. Mr. Delaney responded that the alley belongs to the City. A discussion ensued on
pole removal and MDOT's concerns.
Mr. Paysek stated that the engineering department would have to encourage right turn
in and right turn out at the property accesses. Mr. Sicz stated he has a concern about allowing
a left turn from either access as there is already a problem with the left turn into Blockbuster.
Chairperson Skelton suggested that since there is a problem with left turns into Blockbuster, the
City should close access to Main Street.
Mr. Chuck Winn stated that the Fire Department's main access would be from Main
Street unless adequate access is made from the alley. This could be a problem as the alley
would need to be improved to be 20' wide for each lane.
Chairperson Skelton suggested that Planner Patterson, Mr. Delaney, Mr. Bukvich, Mr.
Paysek, and Mr. Winn meet before next week regarding access.
Mr. Delaney stated that due to the way Blockbuster is built, the alley is only a 20' alley
at the northwest comer. The alley is a 24' on the east side
Mr. Larry Woodward inquired if the City and MDOT were going to allow pavement cuts
for sewer. He stated that there is an old house water main, but not a six inch main. He also
noted that two water lines are needed if sprinklers are used. Mr. Winn noted that sprinklers can
mitigate fire access problems.
Mr. Sicz stated that there may not be enough snow storage area. Snow removal may
need to be conditioned. Mr. Paysek stated that snow could be stored in the southwest comer.
Mr. Sicz went on to note that there may be a need to install a stop sign at the comer of the
Dollar Store to ensure safety of people crossing the alley.
Mr. Bukvich stated that the storm water drainage cannot be into the MDOT drainage
system on Main Street.
Mr. Woodward inquired if the street cut moratorium applied to Main Street.
Discussion ensued on having access through the alley and right turns from North 7th.
Mr. Delaney discussed safety concerns. Mr. Forbes stated a concern about people trying to go
north from the site. Mr. Delaney stated that they anticipate that most people will get coffee
when they come into town from the west and north in the morning, not when they leave in the
evening when they go north.
Chairperson Skelton inquired if there were any traffic flow patterns generated and if they
could be presented by the next meeting. Next week DRC will look at this project again. He
suggested that Mr. Delaney have information for the packets which are sent out on Thursday.

Chairperson Dave Skelton called the meeting to order. He commented that the Theisen needs
to deal with fire and building concerns as these concerns will be conditions of approval. The
applicant will seek approval of the conditions from Phill Forbes.
A. FINAL PROJECT REVIEWS
1. Atlantic Holding Co. MiSP/COA #Z-95153 - (Williams)
316 E. Babcock
- A Minor Site Plan Application to allow the revitalization of existing
buildings to include a restaurant and offices, awnings, facade changes, and related
site improvements.
Intern Planner Christopher Williams presented the project.
Mr. John Paysek stated the Engineering Department's concerns (on file at the
City/County Planning Office). Item#10-dealing with floodplain issues-is most important. Other
concerns were item #6-a sewer service sample manhole provision-and item #11-roof and surface
run-off issues.
Mr. Larry Woodward stated that the run-off drain pipe may be connected to the city's
sanitary sewer; if it is, it must be redone as it cannot be connected there.

- A Conditional Use Permit Application to allow an existing home to be used
as a four person intensive therapeutic youth group home the same as is currently
operated at 1808 South Rouse.
Planner Christopher Williams presented the project. Chairperson Skelton stated that DRC
is to make a recommendation to the Planning Board. Mr. Williams stated that there were no
exterior changes planned. The parking lot is now paved.
Mr. Forbes inquired about the age of the youth to be housed.
Mr. Williams stated that the youth were to be under the age of 18 and will not be
allowed to drive or have vehicles at the home. The home must be licensed by the State and
inspected by the State. It is classified as a residential use.
Mr. Winn stated that he would be doing the fire inspections.
Mr. Mabee stated that he needed more information before he can make a decision. Such
as, will the occupants be ambulatory or not. Construction was begun without a building permit,
but they have since applied for one. A staff of four will require the installation of an additional
bathroom. Fire exits will have to be addressed. City inspectors have to approve prior to
occupancy.
Mr. Sicz expressed concern about egress.
Mr. Forbes stated that the applicant will have to ask the county sanitarian to evaluate the
septic system.
Chairperson Skelton stated that this project will be revisited next week.
