Chairperson Dave Skelton called the meeting to order. He introduced the first item on the
agenda.
A. FINAL WEEK REVIEW
1. Bozeman Daily Chronicle MaSP Z-9662 (Williams)

- A Major Site Plan Application to allow construction of offices and a
printing facility.
Planner Christopher Williams reviewed the project and listed the following conditions. (1)
The applicant shall comply with the formal spacing requirements as established by Section
18.50.100.D.5.e.i which states, "at a minimum one large canopy tree for each fifty feet of
street frontage". (2) The applicant shall show on the landscape plan the location of all utility
easements. (3) The applicant shall identify the ground cover to be provided in the interior
parking lot landscape islands, which must consist of at least 75% live vegetation. (4) Prior
to final site plan approval the applicant shall make a provision for a 20 foot wide public
linear open space trail corridor as required by the Bozeman Area Master Plan for the
Farmer's Canal along the southern edge of the lot. (5) The applicant shall show -
contemplated expansion areas on the final site plan as the additional square footage may
impact required yard setbacks and necessary parking. (6) Boulevard planting detail shall be
provided and must comply with the Engineering Department standards. Root barrier material
should be used. No plantings shall be allowed in the typical sidewalk location. Conditions
7-11 are standard boiler plate conditions (Staff report is on file at the Planning Office). (12)
That the Final Plat for the West College Minor Subdivision be filed at the Gallatin County
Clerk and Recorder's Office prior to Final Site Plan and prior to issuance of a building
permit. Mr. Coffman raised issue on how he can assure a trail along the Farmer's Canal
when the Bozeman Daily Chronicle doesn't own the land. The newspaper owns up to the
canal. Chairperson Skelton explained the trails system need as described in the Master Plan.
Engineer Rick Hixson presented his department's recommended conditions. (Complete Staff
Report is on file in the Planning Office) (1) Each sheet of the FSP shall be adequately
dimensioned and a legend for all symbols provided. (2) A stormwater drainage/ treatment,
grading plan and maintenance plan for a system designed to remove solids, silt, oils, grease,
and other pollutants must be provided and approved by the City Engineer. (3) No building
permit shall be issued for this project prior to City acceptance of the infrastructure
improvements being constructed under the title of M.S.U. Foundation, Bozeman Daily
Chronicle Project, which are meant to serve this project. Conditions 4, 7, 9, and 11 are
standard boiler plate conditions. (5) Standard raised concrete curbing extending to the north
the length of one parking stall shall be provided in the southwest corner of the parking lot.
(6) Any floor drains proposed for the building interior shall be shown on the FSP. (8) All
existing and proposed utility and other easements must be shown on the FSP. (10) A
Pretreatment Program Sanitary Sewer Survey shall be completed by the applicant and
submitted to the Engineering Department prior to FSP approval. Mr. Hixson explained that
condition #5 needs a raised curb rather than a flush curb. He also explained the need for a
curb cut to allow drainage from the southwest corner of the lot.
City Water Superintendent Larry Woodward presented his department's conditions (complete
Staff report on file at the Planning Office). (1) All water and sewer lines, both existing and
proposed, be shown accurately on the Final Site Plan. (2) All water and sewer mains,
service lines, and easements, both existing and proposed, be shown on the Final Landscape
Plan. (3) size be accurately indicated on all water and sewer lines. (4) All fire hydrants
within 500 feet will be shown or indicated on FSP. (5) Accurate, dimensioned detail of
domestic water meter location on inside of building must be shown on Site Plan. (6)
Accurate, dimensioned detail of fire service riser location inside of building must be shown
on the Site Plan. (7) Plans and specifications for any fire service line be prepared in
accordance with the City's Fire Service Line Policy by a professional engineer and submitted
to the City Engineer for review and approval prior to initiation of construction of the fire
service or fire protection, and that the applicant provide professional engineering services for
construction inspection, post-construction certification and preparation of Mylar record
drawings.
Engineer Hixson noted that a condition #12 will be added to his condition list. It will read,
"A sewer service sample manhole shall be provided on the sewer service. Location shall be
identified on the FSP and a detail for the unit shall be provided to the City Engineer for
review.
Mr. Coffman questioned the linear park condition in Planner Williams's staff report.
Chairperson Skelton explained the trail easement need. He noted that a provision is to be
made along the canal for the Iinear trail. Mr. Coffman inquired about the meaning of
Planner Williams's Condition #5. Planner Williams explained that for every 5000 square
feet of expansion, another 3 feet of setback is required.
Fire Marshall Chuck Winn presented two comments from his department. (His staff report
is on file at the Planning Office.)
Fire Marshall Winn moved, Chief Building Official Poulsen seconded, that conditional
approval be recommended to the Planning Board. Motion carried unanimously by voice
vote.

B. INITIAL WEEK REVIEWS
1. Diamond Estates MaSub P-9635 - (Saunders)
4521 Durston Road
- A Major Subdivision Application to subdivide the southern portion of
the parcel, 5.779 acres, into 9 lots for single family development and the
remaining northern portion, 14.178 acres, will be considered Lot 5 of Block 1.
Planner Chris Saunders presented the project. He distributed a master plan for the whole
property. He noted that currently the City doesn't master plan County District 1, however,
the Planning Office suggested an informal master plan for transportation. He explained the
minor collectors, minor arterials, and local street (Meagher) through the subdivision.
Planner Saunders explained the project. He noted that the water line will be excessively
long. A temporary park access easement should be granted until Meagher Street or Oak
Street is completed in this area, which will allow access from either of them. He continued
that the park is currently shown in the northeast corner and is 2.195 acres. He also noted
that access to Durston Street will be at an angle. He continued that the area is zoned for R-
3A. He inquired if there needs to be an encouragement for one inch stubs.
Planner Saunders identified seven issues preliminarily identified by Planning Staff:
(1) Waiver of secondary access from the subdivision
(2) Waiver of deadend water main extension
(3) Adequacy of temporary turn around and access easement to the park
(4) Location of the park land
(5) Review of the Concept Plan submitted with the plat - location of cross streets
(6) Duplex possibilities for the lots with R-3-A zoning, provision of adequate service stubs -
should we request I" stubs, meters can be smaller if needed?
(7) Adequacy of the access to Durston with the proposed angled intersection.
City Engineer Craig Brawner noted a need for a condition to limit the lots to duplexes rather
than townhouses.
Mr. John McNeil of the Parks Department asked if there had been any discussion on the
irrigation ditch. Planner Saunders explained. Discussion ensued on the transferring of water
rights. Mr. McNeil wants the ditch abandoned. He noted that Planner Saunders will need to
establish who has water rights in that ditch, and if not abandoned, who will maintain the
ditch should flooding or other disaster occur. Discussion ensued on the ditch crossings on
Durston and the possibility of relocating of the ditch diversion point.
Project Engineer Karen Finke noted that storm water retention/detention fat;ilities need to be
shown.
Chairperson Skelton inquired about the Recreation Board's thoughts on a transfer of this park
acreage to Rose Park. Mr. McNeil explained that the City Commission is reluctant to do
that kind of transfer.
Discussion ensued on the location of the park. Mr. McNeil suggested using the ditch
easement for the park access easement.

C. INFORMAL REVIEW
1. Chuck Hinesley
Planner Debbie Arkell introduced Mr. Chuck Hinesley and explained that the proposed
project is located west of and adjoining Greenway Subdivision and north of Willow
Subdivision. The property is in County Zoning District #1. She asked Mr. Hinesley to
explain his proposal.
Mr. Hinesley explained that he wants to annex and change the zoning to R-4 and build 8-
plex condominiums in three phases on the northwest 1/3 of the property. The remainder
would be individual lots. He stated the concept is to build housing that blends with the area
and provide affordable housing.
Chairperson Skelton suggested that he gain access to subsidy bonuses by doing his project as
a PUD. Discussion ensued on that topic. City Engineer Craig Brawner noted that this
project would require annexation before being considered for approval.
Planner Arkell noted that Villard and Michael Grove would be public streets. She also noted
that the internal streets for the condos would be private driveways. Mr. John McNeil from
the Parks Department noted that the park needs to be moved to Lots 10 and 11 to match the
park with the land to the south.
Water Superintendent Larry Woodward asked Mr. Hinesley how he proposed to run the
water and sewer lines. Mr. Hinesley unrolled the site plan and discussion ensued on it.
Mr. Woodward commented on main sizes. Mr. Brawner commented that the overall water
looping looks good.
Chairperson Skelton asked how he plans to do the phasing. Mr. Hinesley explained that he
wants to put in the public streets, then do phase 1. He would then tie into the utilities and
build phase 2 and the same with phase 3. He explained the storm water drainage.
Planner Arkell explained that Staff probably can't support the R-4 zoning, but suggested that
he propose it that way and let the City Commission determine the zoning. Chairperson
Skelton suggested Mr. Hinesley plan a dense core (R-4) with less dense edges (R-3) to buffer
the adjoining properties. City Engineer Craig Brawner suggested that Mr. Hinesley avoid T
intersections, such as those proposed at Villard and Michael Grove
Mr. Brawner stated that Villard will eventually connect to Valley Drive, and the City will
require either a direct or curvilinear alignment of Villard and Michael Grove, noting the
proposed T intersections do not work well. MR. Hinesley expressed conctrn with a 4-way
intersection of the 2 streets. .
Planner Arkell asked Fire Marshal Chuck Winn about the accesses to the 8-plexes. Fire
Marshall Winn explained that the driveways are 30 feet wide, and he could see no problems
with the project.
City Engineer Brawner noted that a portion of the development is in a sewer payback area.
Also a retention/detention pond will have to be on a commonly owned lot.
Water Superintendent Woodward noted that the water will have to be looped with phase 1.
Discussion ensued on the looping possibilities. Water Superintendent Woodward noted that
the water cannot deadend at Villard due to the length of the line.
Fire Marshal Chuck Winn noted that he is trying to keep from splitting the property into two
pieces due to safety features. Discussion ensued on the intersection of Villard and Michael
Grove and slowing east-west traffic.
Mr. Hinesley stated he plans to tube the irrigation ditch. Chairperson Skelton commented
the Soil Conservation Service has indicated they will no longer permit the relocation or
tubing of irrigation ditches.
City Engineer Brawner moved, Mr. McNeil seconded, that the meeting be adjourned.
Motion carried unanimously by voice vote.
