Members Present: Dave Skelton, Neil Poulsen, Rick Hixson, Larry Woodward, Roger Sicz, Phill Forbes, Chuck Winn Staff Present: Chris Saunders, Carol Schott Visitors Present: Keith Belden, Gail Schontzler, Chairperson Dave Skelton called the meeting to order. A. FINAL WEEK REVIEW 1. Babcock Meadows MaSub - Amended Phase I & Preliminary Plat Phase II P-9636 Babcock Meadows Subdivision Variance C-9613 - (Saunders, Hixson) 3100 Block West Babcock Avenue - A Major Subdivision Application to amend phase I and establish phase II, and a Zoning Variance Application to create 16 zero lot line townhouse lots with 5' side yard setbacks in lieu of 8' side yard setbacks. Chairperson Skelton introduced the project and noted that the DRC is to make a final decision on P-9636 and send a recommendation on C-9613 to the City Commission. Planner Chris Saunders presented Planning Staff's conditions (on file in the Planning Office). Project Engineer Rick Hixson presented Engineering Staff's conditions (on file in the Planning Office). Street/Sanitation Superintendent Roger Sicz noted that Engineering covered the paving requirement that his department will require. Chairperson Skelton inquired if Parks/Rec Department had addressed parks in that area. Mr. Sicz noted that Mr. McNeil had offered no comments. Planner Saunders noted that in previous weeks' discussions, the concern for traffic congestion on Durston and 19th has been mentioned. He noted that the applicant has offered to mitigate the problem in Phase II. Mr. Sicz noted that traffic on both Babcock and Durston needs to be kept at level C. Discussion ensued on the capacity of Lot 63 and the traffic that capacity would generate. Discussion followed on the number of multi-family units that can be built on the property. Chairperson Skelton added "3 to 5" between " All residences shall be single-family or" and "multi-family structures" in the amended covenants Section VI. Land Use Regulations, part 3. Public Works Director Phill Forbes noted that he is confident that an SID will develop in the near future for the improvement of Durston and Babcock Streets. He continued that the excess in traffic above level C is a matter of degree, as Mr. Belden had noted. Water/Sewer Superintendent Larry Woodward noted that the build out will be limited by the size of the services installed. Mr. Hixson moved, Mr. Sicz seconded, that P-9636 be approved as per DRC conditions. Motion carried unanimously by voice vote. Chairperson Skelton inquired if there were any comments to be made on the variance. Planner Saunders noted that the variance isn't needed as there is enough square footage to build this development out by altering lot lines and/or dropping one townhouse and altering lot lines. He continued that Planning Staff is not supporting the variance at this time as it is not a physical hardship, and, as long as there are changes to be made in lot lines and services, the lots should be made to comply. Chairperson Skelton was concerned with using Phase II as a buffer to Phase I. Planner Saunders noted that a neighbor had come in to discuss the project. He continued that the applicant may be able to mitigate some of the neighbor's concerns with landscaping and fencing. Mr. Belden asked for clarification of Mr. Hixson's condition #2. Mr. Hixson explained, then added "applicable" between "All other" and "conditions" in condition #2. Mr. Sicz recommended that street impact fee monies be used for signalization improvements. Mr. Sicz moved, Planner Saunders seconded, that the meeting be adjourned. Motion carried unanimously by voice vote.
