Chairperson Dave Skelton called the meeting to order.
A. ONE WEEK REVIEW
l. Northern Energy Temporary Use Application#R-9614- (Epple)
2400 North Seventh Avenue
- A Temporary Use Application to allow the use of a temporary office
building while the demolished building is being repaired and to allow a discussion
of the re-development of the property.
Planning Director Andrew Epple introduced Jay Cook and Darrel Behrent,who joined
DRC. He noted that this application has two prongs. The first is for a Special Temporary Use
Permit for the mobile office that is located on the property. The second is to re-establish the
business which will require a CUP application because the business is a non-conforming use in an
M-1 zoning district and the initial assessment indicates more than 50%damage to the structure or
structures housing the non-conforming uses. Therefore,he is requesting informal comments from
DRC for the probable CUP.
Sewer/Water Superintendent Larry Woodward inquired where services for water and
sewer would originate, indicating they would be necessary. Mr. Cook stated that the present
building is on a well and septic system, and that the exact location would need to be determined.
Thus far, there are no services to the mobile office.
Chief Building Official Neil Poulsen asked how far the mobile office is from the storage
tanks. Mr. Cook noted that it is well over 200', and it is 35' from the bottle dock. Mr. Poulsen
noted a concern with the fill area being in a hazardous location according to Building Code.
Discussion ensued on Building Code requirements.
Chairperson Skelton inquired about the time frame for the Special Temporary Use Permit.
Planning Director Epple stated the applicant plans to be back in business in six months. He
continued that sanitary services may need to be hooked up and a condition on the special
temporary use permit will be that the applicant meet all Health Department regulations.
An informal discussion on the CUP for the repair of the building ensued. Mr. Behrent
asked for a copy of the ordinance on the damage conditions that require a CUP.

B. ONE OF A TWO WEEK REVIEW
1. Payne/Scenic Developers Annexation#A-9606 -(Saunders)
West of South 19th Avenue between Lincoln Road and Stucky Road
An Annexation application to annex 21+acres.
Mr. John Marks and Mr. Gene Payne joined DRC. Planner Chris Saunders presented the
application and corrected the acreage to 21+acres. He noted that the primary access will be from
Remington Way and an extension of Kagy Boulevard.
Streets/Sanitation Superintendent Roger Sicz noted that the number of cars entering North
19th Avenue from the west is an issue and there is a need for signalization to allow access onto
the 45-50 MPH street. Discussion ensued on the developer installing the signal in lieu of impact
fees. Superintendent Sicz noted that street improvements need to be done to accommodate the
signalization-turn lanes for example.
Discussion ensued on who would pay -those who have signed waivers and new
developers - and what triggers will indicate the need for signalization. Superintendent Sicz noted
he is in support of no further development west of 19th and south of Kagy until signalization and
street improvements have been done.
Planner Saunders noted that another question to be answered is sewer trunk line capacity.
Discussion ensued on sewer trunks and capacities and probable hook up sites to the trunk lines.
Mr. Marks clarified that signalization and sewer/water are part of subdivision and not part
of annexation. Chairperson Skelton explained that the discussion is to inform the applicant of
future problems.
Planner Saunders noted that easements for Kagy will have to be given. Mr. Marks noted
that the applicants would like to dedicate the right-of-way to the City. Public Works Director
Phill Forbes noted that would require the construction of the improvements before the dedication
will be accepted.
Discussion ensued on looping the water. Superintendent Woodward noted that the
primary water main needs to be extended to the church property. City Engineer Craig Brawner
noted that the water main has to be installed to fit the Master Plan, which will serve the whole
area. Discussion ensued on paybacks for oversizing of mains.
City Engineer Brawner asked when zoning will be decided. Planner Saunders noted it will
be done at the same hearing as the annexation and master plan applications early next spring. He
continued with a summary of the proposed zoning.
Mr. Marks stated that a study by C&H Engineering indicates there is adequate sewer
capacity in the North 19th Avenue sewer main for the 2 1+ acres being annexed. He inquired if
the City has pursued getting easements through the MSU Properties for the trunk line west of
North 19th Avenue. Public Services Director Forbes noted with the current squabble between the
Department of Lands and the State Lands Board,the easements have not been pursued.

C. INITIAL WEEK REVIEW
1. Kountz Trailer Kourt Expansion MaSub Preliminary Plat#P-9652- (Williams)
8628 Huffine Lane
- A Major Subdivision application to allow the subdivision of 27.5 acres to
create 12 new spaces to accommodate 11 new manufactured homes for a total of
120 homes.
Planner Christopher Williams presented the project. Planner Saunders noted that all 120
units have to have functional water/sewer by January 1, 1997, or impact fees will go into effect.
City Engineer Brawner noted that the sewer bottleneck is to be remedied or a financial
guarantee presented before any of the 120 units use City sewer services. He continued that with
the previous agreement there are easements for the extension of Ferguson Road,however, a
waiver of right to protest street improvements is needed with the annexation. He also noted that
annexation should be required within a certain time limit. Public Service Director Forbes noted
that it should be a part of the record that the applicant isn't trying to avoid fixing the bottleneck,
he's trying to negotiate how it is done.
Chairperson Skelton asked when the 12 lot expansion came into play. City Engineer
Brawner noted that the applicant has been interested in expansion since the beginning of the
mobile home park several years ago.
In other business, City Engineer Brawner noted that he needs comments from the other
departments by tomorrow on Safeway's request to vacate North 5th Avenue.
Superintendent Sicz moved, Project Engineer Karen Finke seconded, that the meeting be
adjourned. The motion carried 6 - 0.
