DEVELOPMENT REVIEW COMMITTEE
TUESDAY,DECEMBER 10, 1996

Vice-Chairperson Chuck Winn called the meeting to order
A. FINAL WEEK OF A TWO WEEK REVIEW
1. Payne/Scenic Developers Annexation A-9606 - (Saunders)
West of South 19th Avenue between Lincoln Road and Stucky Road
- An Annexation application to annex 21.644 acres.
Mr. Winn introduced the project. John Marks joined DRC. Planner Chris Saunders reviewed the
project and discussed the suggested conditions from the Planning Department.
Mr. Marks asked for a waiver on impact fees contingent upon the removal of the existing
building. Planner Saunders noted the impact fees are for streets and fire as the sewer and water
are not to be connected at this time, however a waiver will be considered.
Mr. Marks noted that he has suggested that the City take ownership of the 90'right-of-way to
extend Kagy Boulevard west; he has a purchase agreement for the 45'of right-of-way that
extends into the Payne property to make the right-of-way transfer easier. Public Services
Director Phill Forbes noted that City Engineering will make the decision on the transfer of
ownership of the right-of-way. Mr. Marks asked if Remington Way is to be a straight street or
can it meander. Discussion ensued and DRC consensus was that since it is proposed as a private
street, it could meander. Mr. Forbes inquired if there is a need for the Remington Way easement
at this time -casements are usually granted during subdivision. During the discussion of that
casement,Condition#6 was dropped from the Planning Staffs recommended conditions,
Mr. Marks inquired how to get State funding for signalization for Kagy Blvd and S. 19th.
Discussion ensued on the process,the contact person in Helena, and the first steps.
Streets/Sanitation Superintendent Roger Sicz noted that his department couldn't support any
development west of S. 19th until this intersection is signalized. Mr. Marks inquired if DRC
thought that City Administration would support an SID/RID to install the signal. Mr. Forbes
noted that it may be a topic for the Transportation Coordination Committee to discuss. City
Engineer Craig Brawner noted that an alternative for the interim between now and the signal's
installation might be turn lanes and acceleration lanes.
Water/Sewer Superintendent Larry Woodward noted that his department's conditions are similar

to Planner Saunder's conditions#8 and#9. Mr. Brawner noted that there are sewer and water
considerations from his department,he can provide those conditions this afternoon. Mr. Sicz
noted that his concerns are with signalization and sidewalks.
Vice-Chairperson Winn noted that a staff report will be compiled and sent to the applicant.

B. SECOND WEEK REVIEW
1. Kountz Trailer Kourt Expansion MaSub P-9652- (Williams)
8628 Huffinc Lane
- A Major Subdivision application to allow the subdivision of 27.5 acres to
create 12 new spaces to accommodate I 1 new manufactured homes for a total of
120 homes.
Vice-Chairperson Winn introduced the project. Holly Brown and Ray Center joined the DRC.
Planner Christopher Williams reviewed the application. He noted concerns from last week's
meeting.
Mr. Forbes noted that a financial guarantee needs to be done by the end of December or the full
impact fees will go into effect. Planner Williams noted that the park areas have been plotted,
which was a concern in the informal application.
Mr. Brawner noted that the applicant needs proof of approval from the State for the expansion.
Ms. Brown noted that the State has indicated there is no problem since the sanitary problem has
been resolved. Mr. Brawner noted that there is a need for Sate approval for expansion and gave
Jan Sensibaugh's name as the contact person.
Planner Williams inquired about establishing a time frame for annexation. Ms. Brown noted that
annexation was not wanted by the City last year. She noted that the applicant's property is not
adjacent to the City except across the road. Discussion ensued on signing off on the water and
sewer approvals. Ms. Brown noted that a waiver of right to protest annexation was signed earlier
so that when the City is ready to annex the property,it will be annexed. Chief Building Official
Neil Poulsen commented on the utility inspection requirements.
Mr. Center noted that they have State approval on the extension of the water line. Mr. Brawner
asked how they had pressure tested the lines. Mr. Center noted that they tested from manhole to
manhole on each length installed. Discussion ensued on testing results. Mr. Woodward noted
that there is a lot of water being used by each trailer- $46/trailer average for last month. His
department has a billing ready to be mailed out,just waiting for the computer to be able to accept
the information.
Mr. Forbes moved,Mr. Sicz seconded,that the meeting be adjourned. Motion carried 6 - 0.
