Please see the public comment below. I asked Wendy Thomas about this and this
was her response:
The sign code previously allowed signs that displayed the time and temperature. Based on a court
decision, that found that local governments could not regulate the content of electronic message
boards on signs, the City Commission amended the sign code to prohibit this type of signage. This is
the reason why the sign was approved, and why these signs are no longer allowed per code. Also,
you may remember that last year the N7th TIF Board requested that the City Commission review the
sign code to allow non-conforming signs to be altered without losing their non-conforming status.
The Commission decided to leave in place the language that requires a change in copy to require
that signs be brought into compliance.

Dear Commissioners,
I was frustrated that we were unable to keep our time and temperature sign at the corner of Oak
and 15th Street due to our name change. When we built our building a short five years ago, we
went to great lengths to comply with the sign code and provide the community and our customers
with this service. Since we are now a State charter bank we were unable to keep “Federal” in our
name, thus we were required to change all of our signage. The sign design, shape and location did
not change, only the lettering was being switched out to reflect our new name. However, our sign
company (and myself) was told that we were not “grandfathered” under the new sign code, thus the
time/temp portion of the sign had to be removed. Plus there was no option of applying for a
variance.
I know that the sign was valuable to members of the community because if the time or temperature
was inaccurate we would receive numerous calls. We’ve also received many negative comments
now that the time and temperature has been removed.
As a tax paying member of the community I find it costly and disappointing that such a barrier exists
without means to allow for a variance or exception.
