HomeMy WebLinkAbout14- Wastewater Collection System Facility Plan Update PSA AMENDMENT NO. 1 TO PROFESSIONAL SERVICES AGREEMENT FOR WASTEWATER COLLECTION SYSTEM FACILITY PLAN UPDATE MMI.No.417.072 THIS IS AN AGREEMENT made as of ( QbQ_2 2014,between THE CITY OF BOZEMAN, a Municipal Corporation, P.O. Box 1230, Bozeman, Montana, 59771-1230(OWNER)and Morrison-Maierle,Inc.,P.O.Box 1113,Bozeman,Montana,59771- 1113 (ENGINEER). WHEREAS the parties previously entered into a Professional Services Agreement dated March 17, 2014,herein referred to as the Original Agreement, for professional engineering services for the Wastewater Collection System Facility Plan Update; and WHEREAS,the scope of the Original Agreement included services for the plan update; and WHEREAS, the parties desire to amend provisions of the Original Agreement to include additional services related to the City's Industrial Pre-Treatment Program and flow monitoring. NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED HEREIN, the parties agree as follows: The conditions and provisions set forth in the attached EXHIBIT C-1—SCOPE OF SERVICES FOR INDUSTRIAL PRETREATMENT PROGRAM ASSITANCE, EXHIBIT C-2 — SCOPE OF SERVICES FOR ADDITIONAL FLOW MONITORING, EXHIBIT D-1 -ENGINEERING FEE ESTIMATE FOR INDUSTRIAL PRETREATMENT PROGRAM ASSISTNACE,AND EXHIBIT D-2 -ENGINEERING FEE ESTIMATE FOR ADDITIONAL FLOW MONITORING are hereby incorporated in and made part of this Agreement. Article 1 - Eneineerin2 Services Section 1.3 and Section 1.4 are added to the Original Agreement as follows: 1.3 Services to assist the City with their Industrial Pretreatment Program as identified in Exhibit C-1. 1.4 Flow monitoring services are revised as identified in Exhibit C-2. 1 Article 6 - Compensation For Eniineering Service Article 6.2.4.1 and 6.2.4.2 are added to the original agreement as follows: 6.2.4.1 Payment. The OWNER shall for additional services performed in support of the Industrial Pretreatment Program a total not to exceed$18,458.00 under the direct labor cost basis identified in 6.2.4. 6.2.4.2 Payment. The OWNER shall for additional services performed to provide flow monitoring equipment a total lump sum amount of$3,048.00. Except as specifically amended herein, the Original Agreement shall remain in full force and effect and the parties shall be bound by all terms and conditions therein. The scope of services generally will follow the process identified in the EPA Manual, Local Limits Development Guidance, Chapter 7.2, Detailed Local Limits Re-Evaluation. In addition, specific additional scope items have been added at the request of the City. Services will be provided in a collaborative fashion with the City providing background information and sampling and MMI/HDR providing general assistance, data analysis, computation of MAHLs and assistance with local limits implementation. The services will follow the steps identified in the Local Limits Development Guidance Manual. Step 1: Assess Current Conditions A very brief assessment of current conditions will be completed to provide documentation. The treatment plant has undergone major modifications since the last efforts associated with local limits therefore it is assumed that a full assessment is appropriate at this time. Interviews will be conducted with City Staff to document changes in SIUs or additional IUs that have changed or been added to the system. Initial interviews will be conducted during a project kickoff meeting with follow up interviews via phone if needed. This information will be summarized in a short memorandum. Step la: Review S1U Permits Review the three existing SIU permits and make recommendations for revisions, if necessary, to comply with current EPA requirements. Step 1 b: Evaluate MSU and Lattice Materials Permittina Reauirements Based on the initial review of the SIU permits and the analysis of the sampling data, review the possibility of re-classifying these industrial users so permitting is not required. If this appears possible, a re-classification plan will be prepared. Step 2: Collect and Analyze Data The City will utilize their 2009 Sampling Plan to sample Darigold and the Water Reclamation Facility. A new sampling plan will be developed for the hauled waste from the City's Hyalite/Sourdough Water Treatment Plant for the city to use in sampling this new source. The 2009 sample data will be utilized for all other parameters. Step 3: Recalculate Existing, or Determine New MAHLs The data developed in Step 2 will be utilized to compute Maximum Allowable Headworks Loading for the Pollutants of Concern. Step 4: Recommendations for Local Limits Based on the MAHL, recommendations for local limits will be developed. Step 4a: Review Existing Draft Ordinance Review the existing draft ordinance that adds local limits to the current ordinance and make recommendations for changes based on EPA requirements and recommendations for local limits developed in Step 4. Additional Support Services Additional services in support of the City's Pretreatment Program will be provided on an as requested basis. This may include presentations at public meetings, assistance in response to EPA's audit, response to EPA's review of proposed ordinance changes or other tasks as requested. Services provided include rental of one meter for a period of 2 months and coordination to obtain and return the meter.
