WJ-1F.RFU\S, At a regular session of the City Commission of the City of Boze- nan, State of Montana, held 011 the 27th day of August, /I..D. 1925, the said City Com- nission duly passed City Commission Resolution No. 52, declaring it to be the inten- t.ion of said City Commission to create a Special Improvement Distri ct to be known "nd designated as Special Improve~ent District No. 252 of the said City, for the pur- ~ose of grad ing and paying wi th two co urse c rushed gravel. macadam pavement, on South 3ixth Avenue from Babcock Street to Olive Street, within said City, Otnd to s pe c ially "ssess the entire cost and expense of making said improvements against the property vi thin said district under and by virtue of the provisions of Sections 52;~5 to t3;~7? inclusive, of the Revised Godes of Montana, 1921, and any amendments thereto, which ;ai<'l City Commission Resolution No. 52 is hereby referred t~ and made a part hereof for further particulars in respect to the boundaries of said District, the es ti ma ted ~ 0 s t of said improvement and the method of assessing the same against the property \Tithin said District; AND WHEREAS, Notice of the passage of City Commissiorl Resolution No. 52 vas duly publish~d in the Republican Courier, a weekly newspaper printed and pub~ Lished in said City of Bozeman, to-wit: In the is sue of September 2, 1925, and by naiHng a" copy of such notice to each person, firm or corporation, or agen t of such ~erson , firm or corporation having pr01Jerty wi thin the proposed dis'trict at his last (nown address upon the same day such notice was first published as aforesaid, and lue proof having been made of the pUblication of Said notice; AND WHEREAS, The only protest against the proposed wort: or against the ex- ,ent .01' creation of said dist,hct, filed within fifteen days after the date of the ~irst pUblication of said notice of the passage of said Resolution of Intention, be- Lng the protest of Mr. R.E. Bodley, in person, Mr. BOdley's frontage amounting to L'75 lineal feet, 0.1' 2(3.6 per cent of the total frontage of 610.7 lineal feet, the 3aid City Commission, being in regular session on the 17th day of September, 1925, it 7:30 o'clock p~m. of said day, at the Commission Chamber in the City Hall Building in "said City Of Bozeman, .the same being the time and place designated for hearing and ~assing upon all protests; and it being the judgment of the City Commission of the Tity of 13 o?: eman' that th~ creation of said Special Improvement District No. 252 was \greeable to the wishes of over sixty per cent of the frontage in the entire district, md to the best interests of the residents and owners of property on South Sixth Avenue from Babcock \0 Olive Streets; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZE- MAN, STATE OF MONTAlTA: Sec. 1- That said Special Improvement District No. 252 of the City of Bozeman, State of Montana, be, and the sam; is, hereby created for the purpose of mald ng the improvements therein as' hereinafter described. Sec. 2. That said Bpecial improvements be, (ind the same are, hereby ord- ered to be made' in said Special Improvement District No. 252 as follows: The grctd- ing and paving with two course crushed e;ravel macadam pavement, on South Sixth Aven- ue from B~bcock Street to Olive Street. Sec. 3. That the entire cost and expense of making the special improve- ments herein set forth in said Special Improvement DistdctNo. 252 shall be paid by Special Improvement District Bonds of the denomination of One Hundred Dollars ($100) each, and in fractions where necessary, to be issued and chargeable against a fund to be lmown a.s Specia,l Improvement District No. 252 Fund; said bonds to be redeem- able at the option of the City of Bozeman, Montana, whenever funds are available for that purpose from said Improvement Dh;trict Tio. 252 Fund; said bonds sbe.l1 draw si m- ~le interest at the rate of six per cent per annum, which shall be chargeable as a part of the cost of said special improvement and shall :run from the date of the reg- istration of said bonds until said bonds are paid, and such interest, from the date of the registration of the bonds until the paymei1t of the firut installment I wi 11 be collected by the Gi ty Treasur er at the ti me of collecting such first installment; that the entire cost and expense of said improvement witbin said district shall be defrayed by a special assessment against the entire district, each lot or parcel of If!.nd within said district bordering or [tlmtting upon said portion of South Sixth Avenue whe rei n,the improvements shall be made, to be assessed for its proportion of such expense. each front fo ot of the cn tire fronthge of such lots or parcels of land within said Special Improvement District:No. 252 bordering or abutting upon said improvement to be assessed for its proQortionate share of such entire cost, exclusive of streets, avenues, alleys and public places; that the amount assessed against each lot or parcel of land shall be paid in equal annual installments extending over a period of five years. Sec. 4.. That the City Engine er be, and he is hereby directed to prepare plans and specifications for the doing of said work and making said improvements. Sec. 5. That the Clerk of the Commission be and he is hereby directed to pub~jsh a notice inviting ~roposals for the furnishing of materials I the doing of the work and the making of the improvements in said Special Improvement District No. 252, referring to specifications on file, by publishing the same in two issues of --- the Bozeman Chronicle, a daily newspaper printed and published in the said City of Bozeman, not lN18 than ten days before the time such bids will be opened, which shall be at a meeting of the City Commission, which shall beheld on Thursday, the 1st day of October, 19;25.
