As!described!in!our!proposal,!we!have!successfully!completed!housing!needs!studies!and! housing!plans!in!Colorado,!New!Mexico,!and!in!Montana!for!the!City!of!Bozeman!in!2013.!!In! particular,!we!believe!our!previous!work!in!Bozeman!provides!us!with!extensive!data!and! knowledge!of!the!City’s!regulations!related!to!affordable!housing,!as!well!as!acquaintance!with! the!Community!Affordable!Housing!Advisory!Board!(CAHAB)!and!many!individuals!in!the!public,! nonprofit,!and!for]profit!sectors!in!Bozeman!which!allows!us!to!immediately!engage!with!the! core!tasks!at!hand.!! ! Our!proposed!team!has!over!35!years!of!combined!experience!with!land!development,!land!use! regulations,!building!codes,!housing!construction,!development!finance,!home!loans,! government!operations!and!nonprofit!management!–!not!only!as!consultants!but!also!as! practitioners.!We!have!helped!to!start!up!major!land!developments,!built!homes!and! apartments,!and!implemented!special!needs!housing!programs.!! ! Werwath!Associates!is!consulting!firm!founded!in!1983.!Our!main!focus!is!to!help!communities! substantially!increase!the!availability!of!decent,!affordable!housing!primarily!through!setting!up! programs!such!as!financing!for!first]time!homebuyers,!financing!and!development!of!affordable! rental!projects,!and!zoning/building!regulations!appropriate!for!local!conditions.!!The!following! are!selected!examples!of!our!work.!!! City!of!Santa!Fe,!NM!2005?2014! Programs!evaluated:!!Inclusionary!zoning!ordinance!enacted!in!1998,!which!required!that! roughly!16%!of!new!homes!for!sale!in!all!housing!developments!to!meet!affordability!guidelines! for!prices!and!buyers’!incomes.!(Werwath!Associates!drafted!the!1998!ordinance!and! accompanying!administrative!procedures!after!completing!a!feasibility!and!needs!study).!! Findings:!!The!ordinance!was!found!to!be!administered!effectively!and!adding!to!the!supply!of! affordable!housing,!with!most!builders!and!developers!having!accepted!it!as!a!fact!of!life!and! built!the!requirements!into!their!financial!pro!forma!and!pricing.!Based!on!input!from!builders,! developers!and!City!staff,!modifications!were!recommended!to!make!compliance!easier.!! Results:!!The!findings!were!ignored!for!political!reasons!and!the!City!adopted!a!new!inclusionary! zoning!ordinance!that!was!not!founded!on!assessment!of!current!programs.!The!new!ordinance! contained!policies!that!were!not!supported!by!our!study—most!notably!a!30%!requirement!for! affordable!homes—and!was!suspended!in!2012!and!eventually!amended!in!2012!as!a!result!of! non]production.!We!served!as!advisors!to!the!City!during!the!amendment!process.!! Regional!Housing!Alliance,!Durango!CO,!2007?2014! Programs!evaluated:!Subsidized!home!construction,!subsidized!rental!construction,!down! payment!assistance,!land!development,!inclusionary!zoning!(IZ).!!! Key!findings:!A!recently]established!Regional!Housing!Authority!should!(1)!start!a!program! offering!affordable!2nd!mortgage!loans!to!lower]income!homebuyers,!(2)!spur!the!production!of! more!affordable!rental!and!special!needs!housing,!(3)!help!create!an!affiliated!nonprofit!to! expand!fund!raising!and!operational!capabilities,!and!(4)!design/administer!an!inclusionary! zoning!ordinance!for!the!City!of!Durango.!! Results:!The!homebuyer!loan!program!was!started!and!has!since!made!over!110!loans.!!A!60] unit!rental!project!is!now!being!built.!!The!affiliated!nonprofit!was!created!and!has!raised!over! $5!million!in!grants!for!these!efforts!with!our!assistance.!!Werwath!Associates!drafted!the!IZ! ordinance!and!administrative!procedures!after!an!extensive!feasibility!study!that!included! extensive!input!from!builders!and!developers.!!Werwath!Associates!remains!a!consultant!under! a!small!retainer!contract!to!advise!and!assist,!primarily!with!inclusionary!zoning!administration.! The!Housing!Trust,!Santa!Fe,!NM,!2013?2014!(RE!major!land!development!with!IZ!rules)! Issues/Programs!Evaluated:!!Evaluation!of!the!finances!and!feasibility!of!continuing!to!build!out! this!nonprofit]owned!land!development!encompassing!over!1,000!acres,!with!over!3,000! housing!units!completed!to!date.!Created!by!the!City!of!Santa!Fe!in!1991,!TCC!has!self]imposed! “inclusionary!housing”!price!caps!on!40%!of!homes!built!along!with!flexible!PUD!subdivision! regulations!that!help!reduce!building!costs.!!! Proposal!to!City!of!Bozeman!from!Werwath!Associates!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!Page!7! ! ! Key!findings:!!The!operation!has!been!successful!to!date,!but!weak!conditions!in!the!local!real! estate!and!financial!markets!called!for!temporary!suspension!of!operations.! Results:!!Following!our!recommendations,!operations!were!downsized!to!minimize!overhead! costs!in!the!interim,!awaiting!better!market!conditions.! Southern!Ute!Indian!Tribe!2013?2014! Issues/Programs!Evaluated:!!Demand!among!approximately!1,200!enrolled!tribal!members!for! new!homes.! Key!findings:!!There!is!demand!for!approximately!15!new!homes!a!year.!The!tribe!news!to! expand!one!or!more!current!subdivisions!to!create!more!lots.!!!! Results:!!Currently,!the!tribe!is!proceeding!to!create!new!house!lots!and!is!launching!an! internally]funded!home!purchase!mortgage!product.! Rio!Arriba!County!and!the!City!of!Española!NM!2013?2014! Issues/Programs!Evaluated:!Homeownership!assistance,!subsidized!rentals,!home! rehabilitation,!special!needs!housing,!weatherization!and!housing!development,!zoning!and!land! use!and!development!constraints.! Key!findings:!Lack!of!affordable!housing!production!due!to!land!use!constraints!and!local! capacity,!lack!of!homeownership!counseling!and!training!programs,!lack!of!home!rehabilitation! program!or!capacity,!lack!of!appropriate!ordinances!and!regulations!to!encourage!affordable! housing!construction.! Results:!Municipal!affordable!housing!plans!are!awaiting!adoption!pending!approval!of!enabling! ordinances!by!the!New!Mexico!Mortgage!Finance!Authority.!! City!of!Las!Vegas!NM,!2011! Results:!Adopted!municipal!affordable!housing!plan!and!ordinance!governing!municipal! contribution!to!affordable!housing!projects.!Provided!specific!recommendations!for!Trust!Fund! creation,!development!recommendations!for!town]owned!land,!homeownership!program! development,!transfer!tax!dedication,!and!creation!of!a!housing!staff!position!within!Town!of! Policies!Related!to!Affordable!Housing!(the!“Evaluation”)!has!over!35!years!of!consulting!and! project!management!experience!in!affordable!housing!with!communities!ranging!in!population! from!1500!to!over!two!million.!As!described!in!the!chart!in!the!previous!section,!we!have! advised!numerous!municipal!governments!on!the!adoption!of!regulatory!reforms!that!have! included!allowance!of!smaller!building!lots,!narrower!street!widths!(where!feasible),!and! reduced!impact/permit/subdivision!fees—to!give!only!a!few!examples.!!! Generically,!Bozeman’s!Workforce!Housing!Ordinance!is!considered!an!inclusionary!zoning!(IZ)! ordinance.!We!have!worked!with!City!attorneys!to!draft!inclusionary!zoning!ordinances!and! companion!administrative!procedures!for!the!cities!of!Santa!Fe!(NM),!Cambridge!(MA)!and! Durango!(CO).!Based!on!market!conditions!and!community!input,!we!have!also!recommended! that!communities!not!adopt!mandatory!requirements!for!homebuilders!due!to!an!unfavorable! cost]benefit!analysis—such!as!in!Blaine!County!(ID),!Flagstaff!(AZ),!Taos!(NM),!and!Los!Alamos! (NM).!!! Size!and!scope!of!similar!evaluations!that!we!have!completed.!To!lay!the!groundwork!for!new! policies!and!programs,!we!have!completed!extensive!housing!studies!for!the!clients!listed!in! Section!D,!above,!as!well!as!Flagstaff!(AZ),!Dallas!(TX),!Tarrant!County!(TX),!Jackson!(MS),!the! District!of!Columbia!and!a!number!of!other!communities.!The!dollar!value!of!our!housing!study! contracts!have!ranged!from!approximately!$15,000!to!over!$100,000,!while!our!teams!have! included!between!two!and!five!experts.!The!variations!in!size!and!scope!are!primarily!due!to!the! number!of!affordable!housing!issues!that!the!client!wishes!to!address.!! We!appreciate!the!fact!that!the!City!of!Bozeman!is!requesting!a!focused!evaluation!of! regulations!that!affect!housing.!!Producing!an!evaluation!and!recommendations!on!a!small!set!of! related!issues!is!naturally!less!costly,!and!in!our!experience,!the!recommendations!are!more! likely!to!be!successfully!implemented.!But!many!of!our!evaluations!are!more!complex.!In! addition!to!regulations,!we!often!evaluate!existing!financing!programs,!home!construction! programs,!rental!construction!programs,!capacity!of!nonprofit!and!for]profit!developers,!and! likely!locations!for!construction.!If!requested,!we!also!provide!complex!analyses!of!market! demand!for!affordable!housing!and!costs!of!development!of!different!types.!! Previous!work!for!the!City!of!Bozeman.!!In!March,!2012,!Werwath!Associates!completed!an! “Affordable!Housing!Needs!Assessment”!for!the!City!of!Bozeman.!This!work!included!interviews! with!local!builders!and!developers,!nonprofit!housing!groups!and!public!officials,!and!public! meetings.!Based!on!market!data,!analysis!of!current!regulations,!and!community!input,!21! specific!action!items!were!defined.!Among!these,!we!recommended!a!continued!suspension!of! the!Workforce!Housing!Ordinance!due!to!weak!market!conditions!and!a!re]evaluation!when!the! real!estate!market!showed!objective!signs!of!improvement.!The!Needs!Assessment!and!Housing! Plan!approved!by!the!City!Commission!included!consideration!of!regulatory!changes!that!would! reduce!housing!costs!and!speed!up!production:!such!as!allowing!smaller!house!lots!on!a!by]right! basis,!allowing!more!flexibility!in!re]platting!subdivisions,!and!deferring!or!subsidizing!impact! fees!for!affordable,!price]capped!homes!sold!to!lower]income!buyers.!Evaluation!of!these!issues! has!been!proposed!as!an!add]on!to!the!Scope!of!Services!in!the!current!RFP!(see!Section!H).!!!
