WIffiREAS, At a regular session of the City Commission of the City of Boze-
man,
State of Montana,
held on the 9th day of July,
A.D. 1926,
the said City Commis-
sion duly passed City Commission Resolution No.
70, declaring it to be the intention
of said City Commission to create a special improvement district
to be known and des-
ignated as Special Improvement District No.
258 of said City,
for the purpose of the
construction of concrete curbs and standard or Warrenite bitulithic
pavement on that
portion of Cleveland Street between the west line of Seventh
Avenue and the east line
of Eighth Avenue, within said City, and to specially assess the
entire cost and ex-
pense of making said improvements against the property wi thin
said district under and
by virtue of the provisions
of Sections 5225
to 5277 inclusive,
of the Revised Codes
of Montana,
1921, and
any ronendments thereto, which said City Commission Resolution

No.
70 is hereby referred to and made a part hereof for further particulars in re-
spect to
the boundaries
of said district,
the estimated cost of said improvement
and
the method
of assessing
the same
against the property within said district;
AND WH3RBAS, Notice of the passage of City Commission Resolution No.
70
was duly published in the Bozem~n Weekly Chronicle, a weekly
newspaper printed Mid
published in said City of Bozeman,
to-wit:
In the issue of July 15, 1926,
and by
mailing a copy of such notice to each person,
firm or corporation, or agent
of such
perso n I
firm or corporation having property within the proposed district at his last
l(nown address upon the same day such notice was first published
as aforesaid, and due
proof having been made of the publication of said notice;
AND WHF.REAS, Within the time provided by law and published notice there
were filed with the Clerk of the City Commissiorl no protests
against the proposed
work and against the creation and extent of said district to

Sec. 2.
That said spe cial improvements be,
and the
same are,
hereby
orrlered to be made
in said Special Improvement District No.
258 as follows:
The
construction of concrete curbs and standard or Warrenite bitulithic
pavement un that portion of Cleveland Street between the west
line of
Seventh Avenue and
the east line of Eighth Avenue.
Sec. ::5 .
That the entire cost and
expense of making the special improve-
ments herein set forth
in said Special Improvement District No.
2.58 shall be paid by
Special
Improvement Distri at Bond s of the denominati on
of One Hundred Dollars
($100.6t)
each,
and in fractions where necessary,
to be issued and chargeable
agains t a fund to
be known
as Spec ial Improvement District No.
258 Fund;
said bonds to
be redeemable at
the option of
the City of Bozeman,
Montana,
whenever funds are available for that
purpos e f rom said
Spec ial Improvement Distri ct No.
258 Fund;
said bo nds shall
draw
simple interest at
the rate of
six per cent.
per annum,
which shall be
chargeable as
d. part of the
cost
of said special improvement and shall run from the date of the
registration of said
bonds until said bonds are paid;
and such interest,
from the
date of
the
registration of the bonds until the payment of the first installment,
will be co llee ted
by the nirecto r of Finane e of sai d Ci ty of Bozeman at the ti rre
of

collecting such first
installment;
that the
en tire cas t and expense 0 f said improve-
ment within said district
shall be defrayed by a special asneGsment against the
en-
tire district,
each
lot or parcel of land '.'Vithin said district bordering or abutting
upon said portion
of Cleveland Street wherein the
improvements shall be made,
to be
assessed for its proportion
of such expense,
each lineal foot of
the
frontage of such
lots or parcels of
land bordering upon said
improvement wi thin said Special
Improve-
ment District No.
258,
exclusive of
streets,
avenues, alleys
and public places, to
be
assessed for its proportionate
share of such entire cost;
that the amount
assessed
against each lot or
parcel of land shall be paid
in equa.l annual ins tallments eX.tend-
ing over
a period of twenty years-
