BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZE1~N:
Sec. 1.
That it is hereby declared to be the intention of the City Commis-
sion of the City of Bozeman,
state 0 f Montana, to
create a special improvement distr~t
to be known and designated as Special Improvement District No.
258 of said City,
for
the purpose of making the improvements within said special improvement
district here-
in described.
Sec.
2. That the boundaries of said Special Improvement District
No. 258 to
be created are as follows:
"Beginning at a point in the west line of Seventh Ave.,
said point being lCO
feet south of the south line of Cleveland Street;
thence west parallel wi th
and 100 feet south of the said south line of Cleveland Street to
the east line
of Eighth Ave.; thence north along the said east line of Eighth Ave.
to a
point 100 feet north of the north line of said Cleveland street; thence

east parallel wi th and 100 feet north of the said north line of Cleveland
Street to
the west 1 ine of Seventh Ave.;
thence so uth along the said west
line of Seventh Ave.
to the place of beginning".
Sec. 3.
That it is hereby declared to be the intention of said City Cormnis-
sian of the City of Bozem~n,
State of Montana, that all of the land wi thin said pro-
posed speci~l improvement district as defined in Section 2 of
this Resolution, abuttmg
on said improvement,' will be specially and equally benefitted
by the improvements con-
templa ted,
and should equally bear the cost of said improvements in accordance with
the laws
of the State of Montana in such case made and provided.
Sec.
4. That the character of the improvements to be made within
said dist-
rict is as
follows:
The construction of Concrete Curbs and Standard or Warrenite Bitulithic pave-
ment on that portion of Cleveland Street between the west line of Seventh Av-
enue and the east line of ~ighth Avenue.

Coupon Bonds as authorized by the laws of the State of Montana, wh ich bo nds shall be
in the denominution of One Hundred Dollars ($100.00) each and in fractions where
necessary, to be issued and chargeable against a fund to be known as Special Improve- I
rnent District No. 258 Fund, said bonds to be redeemable at the option of the City of
Bozeman, Montana, whenever funds are available for that purpose from said Special
Improvement District No. 258 Fund. Said bonds shall draw simple interest at the rate
of six per cent. per annum, which shall be chargeable as a part of the cost of said
improvement and shall run from the date of the registration of said bonds until said
bonds are paid.
Sec. 8. To pay said bonds and interest thereon, representing the cost of
said improvement, a special assessment shall be levied against all of the lands wi thin
said proposed Special Improvement Dis tri ct No. 258 as he rei nbefore defined, each lin-
eal foot of the frontage thereof to be assessed and taxed for its proportionate share
of such entire cost exclusive of streets, avenues, alleys and pUblic places.
Sec. 9. Said assessment and taxes shall be payable in twenty-one annual
installments with six per cent. annual interest on deferred payments commencing wi th
the year 1927, but this provisi on shall not be construed to prevent full payment at
any time. I
Sec. 10. Tha.t the regular session of the City Commission of the City of
Bozeman, State of Montana, to be held in the Commission Chamber, City Hall Building, .
City of B07.eman, on Friday, the 30th day of July, 1926, at 7:30 o'clock p.m. of said
day, are the time and place designated when and where the said City Commissi on wi 11
hear and pass upon all protests duly and regularly made and fi led, against said pro-
posed improvement and the creation of said proposed improvement district, and the ex-
tent and character thereof, or of either thereof.
Sec. 11. That the Clerk of the said City Commission of the City of Boze-
man, state of Montana, be, and he is hereby directed to give notice as required by
law, of the adoption of this Resolution.
Passed by the City Commissi on of the City 0 f Boz eman, Montana, and approved
by the Mayor of said City, this 9th day of July, A.n. 1926.

Notice is hereby given that at a regular meeting of the City Comnission of
the City of Bozeman,
State of Montana, held on Friday,
the 9th day of July,
A.D.
1926,
a Resolution of said Commission was duly passed and adopted, declaring it to
be the intention of said Commission to create a special improvement district to be
known and designated as Special Improvement District No.

said City of Boze-
man, Montana,
for the purpose of making
improvements as follows:
The construction of concrete curbs and standard or Warrenite Bitulithic
pavement between the west line of Seventh Avenue and
the east line of
Eigh th Avenue.
And declaring it to be the intention of said City Commission to
specially assess the
entire cost and expense of said improvements,
including excavation, pavement,
engi-
neering,
inspection and incidentals, against the
land within said special improve-
ment district,
each lineal fo ot of the frontage of the land wi thin said district to
be assessed and taxed for its proportionate share of said entire cost, exclusive of
streets,
avenues, alleys and pUblic places.
That the cstiwJ.te of the approximate cost of constructing said improvement

Three Hundred Ninety-six and 80/100 Dollars
($2,396.80); that
the

total frontage of
the property within said district to be assessed and taxed for said
improvements is
840 lineal feet, and the estimated cost per lineal foot of

frontage

That at any time within fifteen days after the first
publication of this notice any owner of property liable
