City Commission
duly passed City Commission

64, declaring it to
be the intention of
said City Commission
to create a special improvement district to be known and desig-
nated as Special Improvement
District No. 256 of said City, for the purpose of con-
structing concrete
curbs, and standard or Warrenite bitulithic pavement;
providing for
the making of parkings
and planting trees and grass thereon,
installing sprinkling
boxes for irrigating
said parkings,
and for the future maintenance and care of said
pavement,
curb s .
trees and grass on Sixth Avenue from the so uth line of Cleveland
street to a line 28
feet south of the south line of Garfield Street,
within said City.
and to specially assess
the entire cost and expense of making said improvements agaimt

said district under and by virtue of the provisions
of Sections

of the Revised Codes of Montana,
1921, and any amendments
thereto, which said
City Commission Resolution No. 64 is hereby referred to and made
a part hereof for
further particulars in respect to the boundaries
of said district)

said district;

the Bo?;eman Weekly Chronicle, a weekly newspaper printed and pub-
lished in said City
of Bozeman. to-wit: In

to each person, firm or corporation,
or agent of such person,
firm or corporati
On having property within the proposed district. at his last known
address upon the same
day such notice was first published as aforesaid. and due proof
having been made of
the publication of said notice;
AND WHEREAS, Within the time provided by law and published notice
there
were filed with the
Clerk of the City Commission protests against the proposed work
and against the creati
on and extent of said distri ct to be assessed; and the said

City Commission was
in regular session on the 9th day of July,
1926, at ?:30 o'clock
p.m.
of said day, at the Commission Chamber in the City Hall Building
in the said
City of Bozeman,
the same being the time and place designated
for hearing and passing
u?on all protests,
if any, against
the proposed work or against the creation or extent

of said district,
or both;
and the total frontage of all property within said district

to be assessed being 1,362 lineal feet,
as stated in City Commission Resolution No.

64, and the frontage of all property within said district owned
by persons protesting
being 143
lineal feet, the
same being 10.5% of said total frontage and less than 40%
thereof,
said protests were, by regular vote of said City Commission, duly over-
ruled;
and
it further appearing that all of the proceedings for the
creation of said
district have been complied with;
NOW, THEREFORR, BJi:i IT ]{ESOLVED BY THE CITYCOMMI8S!ON OF THE CITY OF BOZE-
MAN,
STATE OF MONTANA:
Sec.
1. That said Special Improvement District No.
256 of the City of
"Bozeman,
State
of Montana, be, and the same is,
hereby created for the purpose of
making the improvements therein as hereinafter described.
Sec.
<) That said special improvements be,
and the same are, hereby
or-

dered to be made in said Special Improvement District No.. 256
as follows:
The construction of concrete curbs and
standard or Warrenite bitulithic pave-
ment;
the grading and seeding of the parkings, the
planting of trees and the
installation of sprinkling boxes on Sixth Avenue between the south line of
Cleveland Street and a line 28 feet south of the south line of Garfield Street.
Sec.
3. That the entire cost and expense of making the special
improve-
ments herein set forth in said Special Improvement District No.
256 shall be paid by

Special
Improvement District Bonds of the denomination of One Hundred Dollars each,
and in fractions
where necessary,
to be issued and chargeable against a fund to be
known as Special
Improvement District No. 256 Fund;
said bonds to be redeemable at the
option of the City of Bozeman, Montana,
whenever funds are available for that purpose
from said Special
Improvement District No. 256 Fund; said bonds shall draw simple
interest at the rate of six per cent. per annum, which shall
be chargeable as a part
of the cost of said special improvement and shall run from the
date of the registra-
tion of said bonds until said bonds are paid, and such interest,
from the date of the
regis tra ti on 0 f
the bonds until the payment of the first installment, will be collect-
ed by the Director of Finance of said City of Bozeman at the
time
of collecting such
first installment;
that the entire cost and expense of said improvement within said
district shall be defrayed by a special assessment against the
entire district,
each
lot or parcel of land within said district bordering or abutting
upon said portion of
Sixth Avenue wherein the improvements
shall be made,
to
be assessed for its propor-
tion of such expense,
each lineal foot of the frontage of such lots or parcels of
land bordering upon said improvement wi thin said Special Improvement
District No. 25

exclusive of streets, avenues,
alleys and pUblic places,
to be assessed for its pro-
portionate
sharp- of such entire cost;
that the amount assessed against each lot or
parcel of land shall be paid in equal annual
installments extending over a period of

5.
That the Clerk of the Commission be,
and he is hereby directed to
publish a notice inviting
proposals for the furnishing of materials,
the doing of the

work and making of
said improvements in said Special Improvement District Ho.
256,
referring to plans
and specifications
on file, by pUblishing the same in two issues
of the Bozeman Daily
Chronicle, a daily newspaper printed and published in the said
City of Bozeman,
not less than ten days
before the time such bids will be opened,
which shall be at
a meeting of the City Commission to be held on Friday,
the 23d day
of July, 1926.
Passed and adopted by the
City Commission of the City of Bozeman at a regu-
lar session thereof,
held on the
9th day of July, 1926.
Approved by the Mayor on the 9th day of July, 1926.
