of Boze-
man,
State of Montana, held on the 18th day of June,
A.D.
1926, the said City Commis-
sion duly passed City Commission Resolution No.
63,
declaring it to be the intention
of said City Co~nission to create a Special Improvement District
to be known and des-
ignated as Special Improvement District No. 255
of said City, for the purpose of
the
construc ti on of concrete curbs a nd standard 0 r warreni te
bi t uli thic pavement 0 n that
portion of Cleveland Street between the
east line of Eighth Avenue and the west line
of Tenth Avenue,
within said City,
and to specially assess the entire cost and
ex-
pense of ma.king said improvements against the property within
said district under and
by virtue of the provisions of Sections 5225 to 527? inclusive,
of the Revised Codes
of Montana,
1921,
and any amendments thereto, which said Ci ty Commission Heso luti on

63 is hereby referred to and made a part hereof for further particulars in re-
spect to
the boundaries of said District,
the estimated cost of said improvement and
the method
of assessing the barne against the property within said District.
AND WHER?AS,
Notice of the passage of City Commission ~esolution No.
63 was
duly published in the Bozeman Weekly Chronicle,
a weekly newspaper printed and
pub-
lished
in said City of Bozeman,
to-wit:
In the is sue of ,Tune 24, 1926, and by mailing
a copy of such notice to each person,
firm or cor90ration, or agent of such person,
firm or cor~)oration having property wi thin the proposed district
at his last known
address upon the same day such notice was first published as
aforesaid, and due proof
having been made of the publication of said notice;

notice there
were filed with the Clerk of the City Commission no protests
against the proposed
work and against the creation and extent of said District to
be assessed;
and the
City Commission was in regularsessiQn on the
9th day of July,
1926, at 7:30 O'ClOCK
p.m.
of said day, at the Commission Chamber in the City Hall Building in the said
Ci ty of Bozeman,
the same being the time and place designated for hearing and passing

upon all protests,
if any, against the proposed work or against the creation or ex-
tent of said
district, or
both; and the
total frontage of all property within said

to be assessed being 1.360 lineal feet. as stated in City Commission nesolu-
tion No.
63,
and the frontage of all property within said district owned by persons

STATE OF MONTANA:

Sec.
1. That said Special
Improvement Dis tr i c t No.
255 of the City of Boze-
man, state of Montana,
be, and
the same is, hereby created for the- purpose of making
the improvements therein
as hereinafter described.
.
Sec.
2.
That said special improvements be,
and the same are, hereby ordered
to be made in said
Special Improvement Distric t No.
255 as follows:
The construction of concrete curbs' and
standard or Warreni te B i tul i thic
pavement on that portion of Cleveland Street between the
east line of Eighth
Avenue and the west line
of Tenth Avenue.
Sec.
3. That the entirB cost and expense of making the special improvements
herein set forth in
said Special
Improvement District No. 255 shall be paid by Special
Improvement District
Bonds of the denomina ti on of One Hundred Doll,,,,rs
($100.00) each,
and in fractions where
necessary,
to be issued and
chargeable against a fund
to be
~cno wn as
Special Improvement District No.
255 Fund;
said bonds to be redeemable at
the option of the
City of Bozeman,
Montana, whenever funds are available for 'that pur-
pose from said Special
Improvement District No. 255 Fund;
said bonds shall draw simple
interest at the
rate of six per cent.
per annum, which shall be chargeable as a part
of the cost of said
special improyement-'and shall run from the date of the registra.-
I
tion of said bonds
until said bonds are paid;
and such interest,
from the date of the
registration of the
bonds until the payment of the first installment, will be collect-
ed by the Director
of Finance of said City of Bozeman at the time of collecting such
first installment;
that the entire
cost and expense
of said improvement within said
district shall be
defrayed by a special assessment against the entire district,
each
lot or parcel of land
within said district bordering or abutttngupon said portion of
Cleveland Street wherein
the improvements shall be made,
to
be assessed for its pro-
portion of such expense,
each lineal
foot of the frontage of such lots or parcels of
land bordering upon
said improvement within said Special Improvement District No.
255,
exclusive of streets,
avenues,
alleys and public places,
to be assessed for its pro-
portionate share of
such entire cost;
that the amount
assessed against each lot or
parcel of land
shall be paid in equal annual installments
extending 'over a period of
twenty years.
Sec.
4. That the City Engineer be,
and he is hereby directed to prepare
plans and specifications
for the
doing of said work and making said improvements.
Sec.
5. That the Clerk of the Commission be,
and he is hereby directed to

publish a notice inviting
proposals for the furnishing of materials,
the doing of the
work and making of
said improvements in said Special Improvement'District No.
255, re-
ferring to plans and
specifications on file, by pUblishing the same
in two
issues of
the Bozeman Daily
Chronicle, a daily newspaper printed and published in the said City
of B07,eman, not less
than ten days before the time such bids will be opened, which
shall be at a meeting
of the
City Commission to be held on Friday, the 23d day of
