A RESOLUTION OF THE CITY COMMISSION OFTBE CITY OF BOZEMAN, MONTANA, CREATING SPE- CIAL IMPROVEMENT DISTRICT NO. 260 OF TEE CITY OF BOZEMAN, STATE OF MONTANA, FOR THE PURPOSE OF CONSTRUCTING CONCRETE PAVEMENT AND STORM SEWER IN THE FIRST ALLEY SOUTH OF MAIN STREET, FROM TRACY AVE. TO WILLSON AVE., WITHIN SAID CITY, AND TO SPECIALLY ASSESS THE ENTIRE COST AND EXPENSE OF MAKING SAlD IMPROVElVIENTS AND THE MAINTENANCE THEREOF AGAINST THE PROPERTY WITHIN SAID DISTRICT, UNDER AND BY VIRTUE OF TEE PRO- VISIONS OF SECTIONS 5225 TO 5277 INCLUSIVE, OF THE REVISED CODES OF MONTANA, 1921, AND ANY .AMENDMENTS THERETO. WHEREAS, At a regular session of the C'ity Commission of the City of Bozeman, State of Montana, held on the 31st day of Dec., A.D. 1926, the said City Commission duly ~assed City Commission Resolution No. 77, declaring it to be the intention of said City Commission to create a ~ecial improvement district to be known and des- ignated as S:pecial Improvement District No. 260 of said City, for the purpose of constructing concrete :pavement and storm sewer in the first alley south of Main st., from Tracy Ave. to Willson Ave., within said City, and to specially assess the entir cost and expense of making said improvements against the property within said dist- riot under and by virtue of the provisions of Seotions 5225 to 5277 inolusive, of the Revised Codes of Montana, 1921, and any amendments thereto, which said City Com- mission Resolution No. 77 is hereby referred to and made a part hereof for further particulars in respect to the boundaries of said district, the estimated cost of' said improvement and the method of assessing the same against the property withiD :1 said district. AND WHEREAS, Notice of the passage of' City Commission Resolution No. 77 was du- ly published in the Bozeman Courier, a weekly newspaper printed and published in said City of Bozeman, to-wit: In the issue of January 7, 1927, and by mailing a copy of such notice to each person, firm or oorporation, or agent of such person, firm or corporation having property within the proposed district at his last known address upon the same day such notice was first pUblished as aforesaid, and due proof having been made 0.1' the publication .0:1: said notice; AND WHEREAS, Within the time provided by law and published noticei;here were filed with the Clerk of the City Commission, no protests against the proposed work and against the creation and extent of said district to be assessed; and the City Commission was in regular session on the 28th day of January, 1927, a.t '7:30 o'clOck P.M. of said day, at the Commission Chamber in the City lIa.ll Building in the said City of Bozeman, the same being the time and place designated for hearing and pass- ing upon all protests, if any, against the proposed work or against the creation or extent of said district, or Qoth; and it further appearing that all of the proceed- 0 . ,.... I ings for the creation of said district have been complied with; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, ! STATE OF MONTANA: Sec. 1- That said Special Improvement District No. 260 of the City of Bozeman, ---.---.... State of Montana, be, and the same is, hereby created for the ~urpose of making the improvements therein as hereinafter desoribed. Sea. p. That the entire cost and expense of making the special improvements herein set forth in said Special Improvement District No. 260 shall be paid by Spe- cial Improvement District bonds of the denomination of One Hundred Dollars ($100.00) each, and in fractions where necessary, to be issued and chargeable against a fund to be known as Special Improvement District No.. 260' ,Fun~; said bonds to be redeemabl at the option Qf the City of Bozeman,Montana, whenever funds are available for that ~urpose from said Special ImpJ;'overnent District No. 260 Fundi said bonds shall draw simple interest at the rate of six per cent. per annum, which shall be charge- able as a part of the cost of said special improvement and shall run from the date of the regIstration of said bonds until saiel bonds are paid; and such interest, from the date of the registration of the bonds until the payment of the first install- ment, will be colle~cted by the Director of Finance of said City of Bozeman at the time of cOIJ"ecting such first Installment; that the entire cost and expense of said improvement within said distr;j.ct shal:!, be defrayed by a special assessment against '..,"i';- theentfredistrict, eaohlot or parcel of land within said district wherein the improvements shall be made, to be assessed .for its proportion of such expense, each sql1are foot of the area of sl1ch lot s cr:parcelsof land wi thin said Spe cial Improve- ment District No. 260, exclusive of streets, avenues, alleys and public places, to be assessed for its proportionate share of such entire cost; that the amount assesse against each lot or paree.l of land shall be pa id in equal annual installments ex- tending over a period of five years.
