A RESOLUTION OF THE CITY COIVIT.crSSION OF THE CITY OF :SOZE1IAH, MONTANA, LEVYING ,PiliD AS- SESSING A SPECIAL ASSESSMENT OF TAXES upon ALL TIiE PROP'rRTY IN SPECIAL IMPROVEMENT I DISTRICT NO. 261 IN THE CITY OF BOZEl:~T, COUNTY OF GALLATIN, STATE OF ~ONTMJA, TO DE- FRAY THE COST OF CONSTRUCTING A:ND WulKING THE HlPROVEI'iIENTS WITRIN SAID SPECIAL BI- PROV~AENT DISTRICT NO. 261. WHEREAS, The City Commission of the City of Bozeman, did on the 4th day of NJarch, 1927, duly and regularly pass Commi ssion Resolut ion No. 79, declaring it to be the intention of the said City Commission to create a special improvement district to be known and de signa ted as Spe cial Improvement Di stric t No. 261 of said City, for the purpose of constructing a sanitary sewer in the alley in Gardner & Smith's Rear- rangement o'r Block 2, Capitol Hill Addition, from Fifth Ave. to Fourth Ave., thence south on Fourth Ave. to the center of Arthur Street; also a lateral sewer in the alley in Block 15 of said addition, as rearranged, within said Ci~, and thereafter, after due and legal proceedings had, the said City Co~nission did on the 1st day of April, 1927, duly pass COIT@ission Resolution No. 80, creating said Special Improve- ment District No. 261 of said City of Bozeman, state of Montana, for the purpose of constructing the improvements as herein set forth, which Commission Resolutions No. 79 and No. 80, passed as aforesaid, are hereby referred to and made a part of this Resolution for further particulars in respect to the boundaries of said District, the character of the improvements to be constructed therein, the estimated cost of I said improvements and the method of assessing the cost age,inst the property wi thin said district; and WHEREAS, Said improvements as contemplated in said Commission Resolutions No. 79 and and No. 80 have been constructed and completed in accordance with the terms and con- 'ditions of Commission Resolutions No. 79 and No. 80, and the total cost of said im- provements so constructed is the sum of Three Thousand Seven Hundred Twenty-two and 8/100 Do liar s (:~3722.08) ; NOW, THEREFORE, Pursuant to the provisions of Chapter 56 and Chapter 64 of Part IV, of the Political Code of the 1921 laws of the State of Montana, and amendment s thereto, BE IT RESOLVED AND IT IS HEREBY ORDEllED BY TIIE CITY CmIM,ISSION OF THE CITY OF BOZEMA.N, STATE OF MONTANA: Sec. 1. That to defray the cost and expense of constructing and maJdng the said improvements in said Special Improvement District No. 261, there be, and there is hereby levied and assessed a tax amounting to the sum of Three Thousand Seven I Hundred Twenty-two and 8/100 Dollars (~3722.08) upon all the property in said Spe- cial Improvement District No. 261; that a particular description of each lot and par- cel of land with the name of the ovmer and the sum assessed against him or it for such improvements and the amount of each partial payment to be made and the day 'when the same shall be delinquent is set forth in detail in the assessment list hereto at- 185 tached, marked Schedule "A" and made a part hereof; that the several sums set oppo- site the names of the owners and the described lots and parcels of land be, and the I same are hereby respectively levied and assessed upon and against said described lots and parcels of land to defray the cost and e:~ense of constructine and m~cing said improvements within said District; that the several sums so assessed be col- lected from the respective owners of said lots and parcels of land described in said assessment list, Schedule nA", as required by law; that the payment of said sums shall be made in eight installments and the payment of said installments shall extend over a period of seven years; that the payment of the respective semi-annual install- ments shall be made between the 1st Monday in October and the 31st day of May of each year until payment of all the installments, together with the interest thereon, shall have been made; that said sums shall be paid and the collection thereon shall be made in the manner and in accordance with the law governing the collection of special improvement taxes; that failure to pay such assessments when the same shall become due and payable shall make such persons and said lots and parcels of land li- able to the penalties provided by law relative to delinquent taxes; Sec. 2. That the regular session of the City Commission of the City of Bozeman I to be held in the Commi ssion Chamber in the Ci ty Hall of said C1 ty on the 16th day . of September, 1927, at seven-thirty 0' clock P .1,~. be, and the same is hereby designat- ed as the time and :place, at which objections to the final adoption of this ReSJlu- tion will be heard by the said City Commission; Sec. 3. That the Clerk of the Commission of the City of Bozeman be, and he is hereby ordered and directed to publish in the Bozeman Daily Chronicle, a daily news- paper printed and published. in the said City of Bozeman, a notice signed by the Clerk of the Commission, and stating that a Resolution levying a special assessment of taxes to defray the cost and expense of constructing and making the improvements in the said Special Improvement District No. 261, is on file in the office of the Clerk of the Commission, subject to inspection for a period of five (5) days; that :~al(l Ylotice shall state the tir;:e and place at which objections will be heard. by the City Commission to the final adoption of this Resolution; that it shall be published at least five (5) da:,Ts before the day set by the City Cor.'1mission for the hearing of ob- jections and the final adoption of this Resolution. Passed and adopted by the City Commission of the City of Bozeman at a regular I session thereof, held on tl'lis 9th day of September, A.D. 1927. NOTICE IS ImREBY GIVEN, That at a regular session of the City Commission of the City of Bozeman, held on Friday, the 9th day of September, 1927, Commission Resolution No. 87 VIas duly passed and adopted; that said Commission Resolution levies and_ as- sesses a special assessment of taxes upon all the property in Special Improvement District No. 261 in said City, to defray the cost and eJ~ense of constructing and making the improvements within said district, to-wit: The construction of a sani- tary' sewer in the alley in Gardner & Smith's Rearrangement of Block 2, Ca:pitol !-::ill Addition, from Fifth Ave. to Fourth Ave.; thence south on Fourth Ave. to the center of Arthur Street. Also a lateral sewer in the alley in Block 15 of said addition, as rearranged. That said Commission Resolution No. 87 is now on file in the office of the Clerk of the Ci ty Commission, S\l bject to inspection for a period of fi ve (5) days by any person interested. That Friday, the 16th day of September, 1927, at 7:'1JJ o'clock P.M. of said d..ay, at the regular session of the said City Commission of the City of I Bozeman, at the Commission Chamber in the City Hall Building of said City, has been designated as the time and place when and where the said City Commission will hear and pass upon any and all obje ctions that may be mad.e to the final passage and adoption of said Resolution No. 87 and the levying of said assessment, and that said Resolut ion will be finally passed and adopted at said regular session. All persons interested are referred to Commission Resolution No. 79, declaring it to be the intention of the City Commission to create Special Impl"OVer:lent District No. 261, and Commission Resolution No. 80, creating Special Improvement District No. 261, for constructing and making the improvements therein.
