HomeMy WebLinkAboutResolution 4552 Change to Land from Residential to Community Commercial South of Valley Center Road ♦ f 8o��'< Co COMMISSION RESOLUTION NO. 4552 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, APPROVING A CHANGE TO FIGURE 3-1 OF THE BOZEMAN COMMUNITY PLAN, THE FUTURE LAND USE MAP, FROM RESIDENTIAL TO COMMUNITY COMMERCIAL MIXED USE ON 37.98 ACRES GENERALLY LOCATED SOUTH OF VALLEY CENTER ROAD AND WEST OF NORTH 27i11 AVENUE. WHEREAS, the City of Bozeman has had a comprehensive plan (growth policy) since 1958; and WHEREAS, the City of Bozeman adopted it current growth policy known as the Bozeman Community Plan (BCP) through Resolution 4163 on June 1, 2009; and WHEREAS, Section 17.4 of the BCP establishes criteria for amending the BCP; and WHEREAS, the landowner, Valley Center LLC being represented by Morrison- Maierle, Inc submitted an application to amend Figure 3-1 of the Bozeman Community Plan; and WHEREAS, a public hearing was held by the Planning Board on June 17, 2014; and WHEREAS, the City Commission held a public hearing on July 7, 2014 to receive the recommendation of the Planning Board and public testimony; and WHEREAS, after considering the recommendation from the Planning Board, and the staff report the City Commission found that the Criteria of Section 17.4 of the Bozeman Community Plan were met by the application. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Page 1 of 3 Resolution 4552, Cattail North Growth Policy Amendment Section 1 Figure 3-1 of the Bozeman Community Plan is hereby amended to change the future land use designation from Residential to Community Commercial Mixed Use on a portion of land described as: A portion of Lot 2A of the Corrected Amended Plat of Lots 1 & 2 of Minor Subdivision No. 221E, in addition to Montana Department of Transportation right-of-way, Gallatin County right- of-way, & City of Bozeman right-of-way located in the SW1/4 Section 26, T1S, RSE, P.M., Gallatin County, Montana, and being further described as follows: Beginning at an intersection point of the north right-of-way line of Westlake Road and the centerline of East Valley Center Road; thence along said centerline S53°32'34"E a distance of 1247.08 feet to an intersection point with the centerline of an existing 60' public access &utility easement; thence along said centerline S36°27'38"W a distance of 200.33 feet; thence along an arc to the left a distance of 248.89 feet, said arc having a radius of 400.00 feet and a central angle of 35°39'04"; thence S00°4834"W a distance of 485.87 feet to an intersection point with the south line of Lot 2A; thence S89°44'31"W a distance of 714.97 feet; thence NO1'01'21"E, 403.23 feet; thence S89°47'41"W a distance of 565.15 feet; thence N00°16'15"W, a distance of 1219.98 feet; thence N89°44'38"E, a distance of 479.83 feet to the Point of Beginning. Said area contains 37.98 acres, more or less. See Exhibit A.
