A RESOLUTION OF THE CITY cownSSION OF THE CITY OF BOZEW.tAN, MONTANA

CREATING SPECIAL IMPROVE1mNT DISTRICT NO. 262 OF THE CITY OF BOZEMAN,
STATE OF MONTANA,
FOR THE PURPOSE OF CONSTRUCTING A SANITARY SEWER
IN THE ALLEY
IN BLOCKS "E" AND "F" OF STORY'S ADDITION FROM THE END
OF THE PRESENT
SEWER NEAR THE WEST LINE OF EIGHTH AVE!lTUE EAST A
SUFFICIENT
DISTANCE TO SERVE ALL THE LOTS IN SAID BLOCKS "En AND
tlFn BETWEEN
THE EAST LINE OF LOTS l~ & JO IN BLOCKS "E" AND THE
WEST LINE OF EIGHTH AVENUE. ALL WITHIN ~AID CITY, AND TO SPECI~
FICALLY ASSESS THE ENTIRE COST AND EXPBNSE OF 1UKING SAID IMPROVE-
MENTS AGAINST THE PROPERTY WITHIN SAID DISTRICT UNDER AND BY VIRTUE
OF THE PROVISIONS OF SECTIONS 5225 to 5277 INCLUSIVE, OF THE REVISED
CODES OF M01~ANA, 1921, AND ANY AMEND1ffiNT T!~RETO.
WHEREAS, at a regular session of the City Commission of the City of
Bozeman, State of Montana, held on the 5th day of August, A. D. 1927,
the said
City Commission duly passed City Commission Resolution No. 83, declaring
it to be
the intention of said City Commission to create a special improvement
district to
be known and designated as Special Improvement District No. 262 of said
City,
for the purpose of constructing a sanitary sewer in the alley in Blocks
"E" and
"F" of story's Addition from the end of the present sewer near the west
line of
Eighth Avenue east a sufficient distance to serve all the lots in said
Blocks
"E" and "Fit between the Eawt line of Lots 15 and 30, in Block "E". and
the west
line of Eighth Avenue, all within the City of Bozeman, Montana, and to
specially

assess the entire cost and expense of making said improvements
against the
property
within said district under and by virtue of the
provisions of Sec-
tions 5225
and 5277 inclusive, of the Revised Codes of Montana, 1921, and any
amendments thereto, which said City Commission Resolution No. 83 is hereby
referred to and made a part hereof for further particulars in respect
to the
boundaries of said district, the estimated cost of said improvement and
the
method of assessing the same against the property wi thin said d istric
t.
Alm WHEREAS, Notice of the passage of City Commission Resolution No.
83 was duly published in the Bozeman Weekly Chronicle, a weekly newspaper
printed and published in said City of Bozeman, to-wit:
In the issue of Aug. 11,
1927, and by mailing a copy of such notioe to each person, firm or corporation,
or agent of such person, firm or corporation having property within the
proposed
district at his last known address upon the same day such notice was
first
published as aforesaid, and due proof having been made of the publication
of
said notice;
AND 'WHEREAS, Within the time provided by law and published notice

there were filed with the Clerk of the City Commission no protests
against the
proposed work
and against the creation and extent of said district to be
assessed;
and the said City Commission
was in regular session on the 26th
day of August, 1927, at 7:30 o'clock P. M., of said day, at the Commission

designated for hearing and passing upon all protests,
if
any, against the proposed
work or against the creation or extent of said

district, or both;
and it further
appearing that all of the proceedings for
the creation of said
district have been complied with;
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COMlaSSION OF THE CITY
OF BOZEMAN,
STATE OF MONTANA:
Sec. 1.
That said Special Improvement District No. 262 of the City
of Bozeman,State of
Montana, be, and the same is hereby created for the
purpose of making
the improvements therein as hereinafter described.
Sec. 2.
That said special improvements be, and the same are, hereby
ordered to be made
in said Special Improvement District No. 262 as follows:
The construction of a sanitary sewer in the
alley in Blocks "Elf and ifF" of Story's Ad-
dition from the end of the present sewer
near the west line of Eighth Avenue east a
sufficient distance to serve all the lots in
said blocks "E" and "Ft't between the East line
of Lots 15 and 30, in Block "Ett,
and the west
line of Eighth Avenue, all within the City of
Bozeman, Montana.
Sec. 3.
That the entire cost and expense of making the special im-

provements herein
set forth in said Special Improvements District No.
262
shall be paid by Special
Improvement District Bonds of the denomination of
One Hundred Dollars
each, and in fractions where necessary,
to be issued and
chargeable against
a fund to be known as Special Improvement District No. 262
Fund;
said bonds to be redeemable at the option of the City of Bozeman,
Montana,
whenever funds are
available for that purpose from said Special Improvement District
No. 262 Fund;
said bonds shall draw siL:ple interest at
the rate of six :per cent.
per annurn, which
shall be chargeable as a part of the cost of said sPecial im-
provement and shall
run from the date of the registration of said bonds 'Until
said bonds are paid;
and. such
interest, from the date of the registration of
the bonds until the
payment of the first installment, will be collected by
the Director of Finance
of said City of Bozeman at the time of collecting such
first installment;
that the enti
re co st and expense of said improvement wi thin
said district shall
be defrayed by a special assessment against the entire
district, each lot
or parcel of land within said district wherein the im-
provements shall be
made,
to be assessed for its proportion of such expense,
each I
linear foot of the
Alley frontage of such lots or parcels of land within said
Special Improvement
District No. 262,
exclusive of streets, avenues,
alleys and
public places, to
be assessed for its proportionate share of such entire cost;

that the amount assessed against each lot or parcel of land shall be paid
in equal annual installments extending over a period of seven years.
I Sec. 4. That the City Engineer be, and he is hereby directed to
prepare plans and specifications for the d.olng of said work and making said
impr ove men ts.
Sec. 5. That the Clerk of the Commission be, and he is hereby directed
to publish a notice inviting proposals for the furnishing of materials, the doing
of the work and making of said improvements in said Special Improvement District
No. 262, referring to plans and specifications on file, by publishing the same
in the issues of the Bozeman Daily Chronicle, a daily newspaper printed and
published in the said City of Bozeman, not less than ten days before the time such
bids will be opened, which shall be at a meeting of the C1 ty Conunission to be held
on Friday, the 9th day of September, 1927.
