BE IT RESOLVED BY THE COJ!JIJ',IISSION OF THE CITY OF BOZEMAN: Section 1. That it is her.ebydeclared to be the intention of the Commission of the City of Bozeman, state of Montana, to create a Special Improvement District to be. known and designated as Special Improvement District No. 265 of said. City for the pu.rpose of making the improvements within said Special Improvement District hereinafter described. Section 2. That the boundaries of said Special Improvement Dist:cict No. 265, to becrElated,are as follows: B€!ginnin~a t a poii1t in the north 1 ine of W.. Main .treet, where the same is in ter- seated by the center line of N. Grand Avepue; thence north along said center lineofN. Grand Agenue to the south li11.e of W. Mendenhall Street; thence east along said south line of W. Mendenhall Street to the center line of H. Willson Avenue; thence sonthalong the said center line of N~ Will- son Avenue to the north line of W. Main Street; tbence west along said north line of W. Main Street to the place of beginning. Section 3. That it is hereby declared to be the opinion of said Commission of the City of Bozeman, State of Montana, that. all of tbe land wi thin said propo sed Special Improvement District as defined in Section 2 of this Resoiution, whether abutting on ,.said improvement or not, will be specially \ and equally benefitted by the grading, paving, installation of storm sewer, inlets and cOnnect ions, and all of sa id improvements, and shouldecfually bear the cost of said improvements in accordance with the laws of the State of Montana, in such case made arid provided. Section 4.. That the character of the improvement to be made wi thin said Special Improvement District No . 265.1s the grading; the construction of concrete :pavement, and the installation of sU0h storm sewer inlets and con- nections as maybe~necessary on the first Alley IJ. of :Main Street between the center 1 ine of N.. Wr1lson Avenue and the ce1;1 ter line of N. That an approximate estimate of the cost of doing ,all of of constructing all of said imp~ovements, including the grading, pav- ,ing, storm sewer inlets and connections, engineering, inspection, and all inci- dental expense s, is Three Tho1.1.sand EIght Iftmd.red Ninety'One(4~3,89LOO):pollars. Section 6. That the total frontage of the land within said proposed district to be taxed for the cost of said improvements (exclusive of streets, avenues, al,ley's and public l)laces) is 560 lineal feet and an approximate estimate of the cost of sa ide Im:provemen t , to be specially taxed and assessed against the land therein, is $6.9482 per lineal foot of said frontage. Section 7. That the entire cost and eXIJense of making the special improvements hereJn set forth in said 81)ecial Improvement District No. 265 shall be paid by Special Improvement District Coupon Bonds, as authorized by the Laws of the state of Montana, wJHch 'bonds shall be in the d.en<;>mination of One Hundred DOllars (:;~lOO.OO) each, or fractions thereof where necessary, to be issued and cbargealJle against a fund to be known as "Special ImI)rOVement District No. 265 Fund It , said bonds to be redeemable at the option of the City of Bozeman, IILontana, whenever funds are available for that Pur1)ose from said Special Improvement District No. 265 Fund. Said bonds shall draw simple in- terestat the rate of six per cent. per annum, which interest shall be charge_ able as a part of the cost ,of said improvement, and s11<'111 run from the date of the registration of said bonds until sa id bond s are pa id. Section 8. To pay said bonds, and interest thereon, representing the cost of said improvement, a special assessment shall be levied against all of the lands within said proposed Special Improvement District No. 2G5 as here- inbefore defined, each lot or parcel of land within said District to be assesf?cd for that portion of the whole cost in the proportion that the alley frontage of said lot, or parcel of land,bears to the alley frontage of the entire District, exclusive of streets, avenues, alleys or public places. Section 9. Said assessment and taxes shall be payable in ten annual installments, with six :per cent. annual interest on deferred payments, commencing with the year 1928, but this provision shall not be construed to prevent full payment at any time. , Section 10. Section II. That the Clerk of said Commission of the City of Bozeman, State of Montana, be, and he is hereby directed to give notice as required by law,' of the adoption of this Resolution. Fassed by the Commission of the City of Bozeman, Montana, and approved by the M.ayor of said City this 30th day of Uarch, A D 1928. ~ .&~!f ATTEST: Cler~n o1:fFie City of Bozeman, Montana NOT I 0 E NOTICE IS R'EREBY GIVEN THAT At a regular meeting of the Commission of the City of Bozeman, State of MontaxJa, held on Friday the 30th day of M.arch, 1928, a resolution was duly passed and adopted by said Oommission declaring its intentions to create a. special impl'ovement district to be lmown and desig- ilated(>.s Special Improvement District No. 265 of said City, for the purpose of grading, constructing concrete pavement and installing such. storm sewer inlets and connections as may be necessary on the first alley N. of Main Street be- tween Willson and Grand Avenues, and declaring it to be the intention of said Commission to specially assess the ent ire cost and expense of making such improvements against the entire district, each lot or parcel of land wi thin such district to be assessed. for that :part of the whole cost which its alley frontage bears to the alley frontage of the entire district, exclusive of streets, avenue s, alleys and public :places. That the estimate of the total cost and expense of making such improvements is $ 3,891.00; that the total alley frontage of all property in the district tobe assessed for the prpposed improvement exclusive of streets, avenues, all~ys and pUblic places. is 560 lineal feet, that the estimated cost per lineal foot of said property to be so .specially assessed and taxed is $6.9482 and that Friday, the 20th day of April, 1928 at 4 o'clock F Mandthe Commission Chamber of the said Oityof Bozeman has been d.esignated as the time when , and the place where, the said Commission will hear and pass upon all 'prote sts that may be made against the proposed work or against the extent or creation of the said district to be assessed, or both. For a description of the boundaries of said proposed. Special Improve- ment District No. 265, reference is hereby made to Gommisc1ion Resolution No. 92 declaring the intention of said Commission to create said special improve- mentdistrict, which is now on file in the office of the Clerk of the Com- mission of the City of Bozeman, Montana.
