A RESOLUTION OF THE
COWIJ:ISSION OF THE CITY OF BOZEMAN, MONTANA,
DECLARING IT TO BE
THE INTENTION OF SAID COMMISSION TO CREATE A SPECIAL IMPROVE":
MENT DISTRICT TO BE
KNOWN AND DESIGNATED AS SPECIAL IMPROVEMENT DISTRICT NO.
263 OF SAID CITY,FOR
THE PURPOSE OF GRADING: PAVING WITH TWO COURSE CRUSHED
GRAVEL MACADAM PAVEMENT:
CONSTRUCTING CONCRETE CURBS AND INSTALLING SUCH DRAIN-
AGE STRUCTURES AS
MAYBE NECESSARY BETWEEN THE 'WEST LINE OF SIXTH AVENUE AND THE
:E;AST LJ;NE OF EIGHTH
AVENU1i: ON WEST OLIVE STREET , WITHIN SAID CITY, AND TO SPECIAL-
LY ASSESS THE ENTIRE
COST AND EXPENSE OF MAKING SAID IMPROVEMENTS AGAINST THE
LAND WITHIN SAID DISTRICT
AS CREATED.
BE IT RESOLVED BY
THE COMMISSION OF THE CITY OF BOZEMAN
Seotion 1.
That it is hereby declared to be the intention of the
Commission of the
City of Bozeman, state of Montana, to oreate a Special Improve-
ment District to be
known and designated as Special Improvement District No. 263
of said City for the
purpose of making the improvements within said Special Im-
provement District
hereinafter described.
Section 2.
That the boundaries of said Special Improvement Dis-
trict N'o. 263, to
be oreated, areas follows:-
Beginning at a point
in the east line of S. Eighth Avenue
where said line is
interseoted by the sout,h line of Lot
19, B.locklO of Park
Addition to Bozeman, said point being
149.03 feet south
of the south line of W. Olive Street;
Thence north along
the said east line of S. Eighth Avenue
to a point 148.74
feet north of the north line of said W.
Olive Street;
Thenee east parallel with and 148.74 feet
N. of sai~ north line
of W. Olive street to the west line
of S. Sixth Avenue;
Thenoe south along said west line of S.
Sixth Avenue to the
intersection of said line with the
south line of lot
6, Blook 11 of said Park Addition, said
point being 148.45
feet south of the south line of said W. Olive
Stree.t; Thence west
along the south line of lots 6 and 19
of said Block 11,
Lots 6 and 19 of Block 10 and the , extension
of said line across
S. Seventh Avenue and the alleys in said
Blook 10 and II, to
the point of beginning.
The assessments
against all corner
lots, viz; Lots No. 17 and 18 of Block 2 ;
lots No. 17 and 18
of Block 3; lot 1 and the N. 5.2
feet of
lot 2, lot 24 and
the N. 5.17 feet of lot 23 of Flock 10;
lot
1 and the N. 6.26
feet of lot 2, and lot 24 and the N. 5.25
feet of lot /23 of
Block 11 of said Park Addition to be douhle
that of inside lots.
Section 3.
That it is hereby declared to be the opinion of' said
Commission of the
City of Bozeman, State of Montana that all of the land within
said proposed Speoial
Improvement Distriot as defined :j.n Section 2 of this re-
solutio~, whether
abutting on said improvement or not, will he specially bene_
fittedhy the grading,paving,
installation of curbs "and culverts,
and all of
said improvements
and should bear the oostof said improvements in accordance
with th,s laws of
the stat,e of Montana in such case made and :provided.
Section 4.
That the oharacterof the improvement to be made within
said Special Improvement
District No. 263 is the grading;. the paving with two
oourse c~ushed gravel
macadam pavement; and the installati,eIl;
of 00 norete ourb s
and such drainage
structures'~i as may be neoessary on We!;!tOlive Street between the
west line of Sixth
Avenue South of the J!:a.st line of Eighth Avenue South in said
i' ,City qf Bozeman,
Montana.
Section 6.
That an approximate ,fJst.tmate of the cost of doing
all of:
work of constructing,
,all of: said improvements,
including the grading, pav-
ing, curb s, drainage,
structures, engineering, inspection
and all incidental
expenses,
is Two
Thousand Seven Hundred Fift~ ($2760.00) dollars.
Section 6.
That the total actual area of the land within said proposed
district to be taxed
for the cost of said improvemen"!is
(exclusive of streets,
avenues, alleys and
public places) is 148740 square feet, and an apIJroximate

estimate of the cost
of said ImIJrovement, to bes],!ecially taxed and assessed

against the land therein,
is $0.03077 per square foot
for corner lots and
$0.015386 per square
foot for inside lots.
Section 7.
That the entire cost and expense of making the special
improvements herein
set forth in said Special Improvement District No. 263
shall be paid by Special
Improvement District Coupon Bonds, as authorized by
the Laws of the State
of Montana, which bonds shall b,e in the denomination of
One Hundred Dollars
($10'0.00) each, or fractions
thereof where necessary,to
be issued and ehargeable
against a fund to be known as "Special Im:provement
District No. 263 Fund,"
said bonds to be redeemable at the option of the City
of Bozeman, Montana,
whenever funds are available for that purpose from said
Special Improvement'District
No. 263 Fund. Said
bonds shall draw simple in-
terest, at the rate
of six per cent per annum, which interest shall be charge-
able as a part of:
the cost of said improvement, and sha.ll run from the date
of the registration
of said bonds until said bonds are paid.
Section 8.
To pay said bonds, and interest thereon, representing
the cost of said improvement,
a special assessment shall be levied against
all of the lands within
said proposed Special Im],!rovement DfstrictNo. 263 as
herein before defined,
each lot or ~arcel of land within said District to be
assessed for that
portion of the whole cost in t:p.e proportion that the area. of
said lot,
or parcel qf land, bears to the area of the entire District,
exclu.,.
sive of streets, avenues,
alleys or public places, provided, that each square
foot of the land within
said district embraced within any corner lot, or tract
(and for the purposes
of assessmentln this district a corner lot is defined
as being any tract
of land, excepting streets, avenues or alleys, located
within a distanoe
of 30 feet of either side line of W. Olive Street within the
district)
shall be so assessed that each square foot of the land
embraced
within any such corner
lot, or tract,
shall bear double the amount of the cost
of such improvement
that a square foot of any inside lot, or tract,
shall bear.
Section 9.
Said assessment and taxes shall be payable in Seven
annual installments,
with six percent annual interest on deferred IJayments,
commencing with the
year 1928, but this IJrovision shall not be construed to
prev.ent full payment
at any time.

Section 10.
That the regular session of the Commission of the
City of Bozeman,
state of Montana,
to be held in said Commission's room in the
City Hall of Said
City of Bozeman, on Friday, the 13th of April, 1928 at FoUr
o'clock P. M. of saId
day, are the time and place designated when and where the
Commission will hear
and pass upon all protest duly and regularly made and fil-
ed against the proposed
improvement and the creation of said Special Improvement
District, and the
extent and character thereof, or of either thereof.
Section 11.
That the Cle:rk of said, Commission of Bozeman,
State
of Montana, be, and
he is hereby directed to give notice as re'luired by law,
of the adoption of
this Resolution.
