A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONrANA,
DECLARInG IT TO BE THE INTENTION OF SAID CITY CO:MMISSION
TO
CREATE A SPECIAL I~~ROVEMENT DISTRICT TO BE KNOWN
AND DESIGNATED
AS SPECIAL I~~ROVEMENT DISTRICT NO. 269 OF SAID CITY,
FOR THE
PURPOSE OF CONSTRUCTING A SANITARY SEWER ON EAST MENDENHALL
STREET
,
BETWEEN WALLACE AND IDI AVENUES, WITHIN SAID CITY, AND TO SPEC IALLY
,ASSESS THE ENTIRE COST AND EXPENSE OF MAKING SAID IMPROVEMENTS AND
THE MAINTENANCE THEREOF AGAINST T!m PROPERTY WITHIN SAID DISTRICT,
UNDER AND BY VIRTUE OF THE PROVISIONS OF SECTIONS 5225 to 5277 INCLUSIVE
OF THE REVISED CODES OF-MONTANA, 1921, AND ANY AMENDMENTS THERETO.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN:
Sec. 1. That it is hereby declared
to be the intention of the
Commission of the City of Bozeman, State of Montana, to create a special improvement
district to be known and designated as Special Improvement District No
269 of
said City, for the purpose of making the improvements within said special improve-
ment district herein described.
Sec. 2. That the boundaries of
said Special Improvement District
No. 269 to be created are as follows:
All that portion of the Vity of Bozeman, Montana, within
the following metes and bounds, to-wit:
Beginning at a point in the center line of Wallace Avenue
North where the same is intersected by the north line of

East Mendenhall Street; thence east along the north line
of said East Mendenhall Street to a point 50 feet
east of
the east line of said Wallace Ave. N; thence north
150
feet to the south ~ine of the alley between ~ast Mendehhall
and East Lamme Streets; thence east along the south
line of
said alley to the west line of Ida Ave; thence south along
the said west line of Ida Ave.
to the north line of the
alley between ~ast Mendenhall and ~ast Main Streets;
thence
west along the north line of said alley to a point 50 feet
east of the east line of Wallace Ave. N; thence north 150
feet to the south line of ~ast Mendenhall Street; thence
west along the said south line of ~ast Mendenhall Street
to the center line of wallace Ave. ~; thence north along
the said center line of ~allace Ave. N to the place of be-
ginning.
Sec. 3. That it is hereby declared
to be the intention of said
Commission of the City of Bozeman, State of Montana, that all of the land within
said proposed ~ecial improvement district as defined in Section 2 of this Reso-
lution, abutting on said improvements, will be specially and equally benefitted
by the improvements contemplated, and should equally bear the cost of said im-
provements in accordance with the laws of the ~tate of Montana, in such case made
and provided.
Sec. 4. That the character of the
improvements to be made within

said district is as follows:

The digging of the necessary trenches and laying of a six
inch vitrified tile sewer pipe, together with the installa-
tion of all manholes, wyes and other appurtenances necessary
to construct and complete a sanitary sewer on ~ast Mendenhall
I
Street between Wallace and Ida Avenues.
Sec. 5. That an approximate
estimate of the cost of doing all
of the work, including
pipe, wyes, manholes, trenching, pipelaying, backfilling,
engineering, inspection
and incidentals, is One Thousand une Hundred Thirty ~wo
Dollars t$l132 .00) .
Sec. 6. That the total
frontage of the land within said proposed
district to be taxed for the cost of said improvements
texclusive of streets,
avenues, alleys and public places)
is six hundred eighty four (684)
lineal feet
and an approximate estimate of the cost of said improvement to be specially
taxed and assessed against the land therein,
is ~ 1.655 )er lineal foot of said
frontage.
Sec. 7.
That the entire cost and expense of making said special
improvements in said proposed vistrict No. 269 shall be paid by Special Im-
provement ~istrict uoupon Bonds as authorized by the laws of the State of Montana,
which bonds shall be in the denomination of One Hundred .uollars($lOO.OO) each
and in fractions where necessary,
to be issued and chargeable against a fund to
be known as Special Improvement ~istrict ~o. 269 Fund,
said bonds to be redeem-

able at the option of the Vity of Bozeman, Montana, whenever funds are available
for that purpose from said ~pecial Improvement Vistrict ~o. 269 Fund.
Said bonds
shall draw simple interest at the rate of six per cent per annum, which shall be
chargeable as a part of the cost of said improvement and shall run from the date
of the registration of said bonds until
said bonds are paid.
Sec. 8. To pay said bonds
and interest thereon, representing the
cost of said improvement, a special assessment shall be levied against all of
the lands within said proposed Special Improvement ~istrict .No. 269 as hereinbefore
defined, each lineal foot of the frontage thereof to be assessed and taxed for its
proportionate share of such entire cost, exclusive of streets,
avenues, alleys and
public places.
Sec. 9. Said assessment
and taxes shall be payable in eight annual
installments with six per cent. annual interest on deferred payments, commencing
with the year 1928, but this provision shall not be construed to prevent full
payment at any time.

Sec. 10. That the
regular session of the Gommission of the ~ity
of Bo ze rran , State of
Montana, to be held in the vommission Chamber, Uity Hall

the 25th day of May, 1928, at four olclock
P M of said day, are the time and place designated when and where the said
Commission will hear and pass upon all protests duly and regularly made and
filed, against said proposed improvement and the creation of said proposed im-
provement district, and the extent and character thereof, or of either thereof.

Sec. 11.
That the Clerk of the said Commission of the vity of
Bozeman, State of Montana,
be, and he is hereby directed to give notice as

required by law, of the adoption of this Hesolution.
Passed by the Liommission of the City of Bozeman, .Montana, and
approved by the Mayor of said City,

And declaring it to be the intention of said Commission to specially assess the
entire cost and expense of said improvements, including pipe, wyes, manholes,
trenching, pipe laying, backfilling,
engineering, inspection and incidentals,
against the land within said special improvement district,
each lineal foot of
the frontage of the land within said district to be assessed and taxed for its
proportionate share of said entire cost, exclusive of streets, avenues, alleys
and public places.
That the estimate of the approximate
cost of constructing said
improvement is One ~housand One tlundred ~hirty Two Dollars

total frontage of the property within said district to be assessed and taxed for

said frontage to be so specially assessed and taxed

That at any time within fifteen days
after the first publication of this notice any owner of property
liable to be
assessed on account of said proposed improvement may make
protest against said
improvement or against the extent or creation of said special
improvement district
in the manner provided by law,
such protest to be filed with the Clerk of said
Commission at the City Hall of said City of Bozeman,
State of Montana, and such
protest or protests will be duly considered by said Commission
at the time and
place as hereinbefore specified.
That for a description of the boundaries of
said Special Improvement District No. 269, reference is hereby
made to the
Resolution of the Commission of the City of Bozeman declaring
the intention to
oreate the same, Which is on file in the office of the undersigned
Clerk of
said Commission in the City Hall of said City of Bozeman,
State of Montana, and
open for inspection to all interested parties,
and to the public generally.
