A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO CREATE A- I SPECIAL I1~ROVEA~NT DISTRICT TO BE KNOWN AND DESIGNATED AS SPECIAL I1~ROVEMENT DISTRICT NO. 270 OF SAID CITY, FOR THE PUR- POSE OF GRADING; PAVING WITH TWO COURSE CRUSHED GRAVEL 1~CADAM PAVEMENT AND INSTALLING SUCH DRAINAGE CULVERTS AS MAY BE NECESSARY ON NORTH GRAND AVENUE BETWEEN THE NORTH LINE OF WEST VILLARD STREET AND THE NORTH LINE OF WEST SHORT STREET, WITHIN SAID CITY, AND TO SPECIALLY ASSESS THE ENTIRE COST AND EXPENSE OF ~UKING SAID IMPROVE- MEUTS AGAINST THE LAND WITHIN SAID DISTRICT AS CREATED. BE IT RESOLVED BY THE COW~ISSION 02 THE CITY OF BOZE1JAN: Section 1. That it is hereby declared to be the intention of the Commission of the vity of Bozeman, State of Montana, to oreate a Special Improve- ment ~istrict to be known and designated as Special Improvement District No. 270 of said ~ity, for the purpose of making the improvements within said Special Improvement Distriot hereinafter described. Section 2. That the boundaries of said Special Improvement District No. 270, to be created, are as follows: Beginning at a point in the north line of West Villard Street, where the same is intersected by the east line of the alley between Grand Ave N. and Third Ave ~; thence north along the east line of said alley to the north line of West Short Street; thence East along the nOl'th line of West Short Street to the west line of the alley between Grand Ave. N and Willson Ave. N; thence south along the I west line of said alley to the north line of West Vil- lard Street; thence west along the north line of said West Villard Street to the place of beginning, all in the vity of Bozeman, Montana. Section 3. That it is hereby declared to be the opinion of said Commission of the City of Bozeman, State of Montana, that all of the land within said proposed special lmprovement Distriot as defined in Section 2 of this Hesolu- tion, whether abutting on said improvement or not, will be specially and equally benefitted by the grading, paving, and installation of said drainage culverts, and all of said improvements, and shauld equally bear the cost of said improvement in accordance with the laws of the State of Montana, in suoh case made and provided. Section 4. That the character of the improvement to be made wi thin said Special Improvement ~istrict ~o. 270 is the grading; the paving with two course crushed gravel macadam pavement and the installation of such drainage cul- verts as may be necessary, on all that portion of .North Grand. Avenue in the said City of Bozeman, Montana, between the norbh line of West Villard ~treet and the north line of West Short Street. I Section 5. That an approximate estimate of the cost of doing all of the work of constructing all of said improvements, including, grading, paving, culverts, engineering, inspection and all incidental expenses, is One Thousand Eight Hundred Twenty Seven Dollars ($1827.00). --... ... --.--- ...... .. .-..- - ....... 242 Seotion 6. That the total frontage of the land within said pro- posed district to be taxed for the cost of said improvement, exclusive of streets, avenues, alleys and publio places, is one thousand twenty six and siX I tenths ~1026. 6) lineal feet, and an approximate estimate of the cost of said improvement to be specially taxed and assessed against the land therein, is :$ 1.78 per front foot of said land; the term "Front foot" referring to the number of lineal feet fronting, or abutting, upon said ~orth Grand Avenue within said proposed district. Section 7. That the entire cost and expense of making the special improvements herein set forth in said Special Improvement ~istrict No. 270 shall be paid by Special Improvement Distriot Uoupon Bonds, as authorized by the laws of the State of Montana, which bonds shall be in the denomination of One Hundred ~ollars ($100.00) eaoh, or fractions thereof where necessary, to be issued and chargeable against a fund to be known as "Special Improvement Dis- trict No. 270 Fund", said bonds to be redeemable at the option of the City of Bozeman, Montana, whenever funds are available for that purpose from said Special Improvement District ~o. 270 Fund. Said bonds shall draw simple interest at the rate of six per cent. per annum, which interest shall be chargeable as a part of the cost of said improvement, and shall run- from the date of registration of said I bonds until said bonds are paid. Section 8. TO pay said bonds and interest thereon, representing the cost of said improvement, a special assessment shall be levied against all of the lands within said proposed Special improvement District No. 270, as here- inbefore defined; each lot or parcel of land within said Distriot to be assessed tor that portion of the whole cost in the proportion that the lineal teet of said lot or parcel of land bordering or abutting on said J:l!orth Grand Avenue bears to the total ~orth ~rand Avenue frontage, exclusive of streets, alleys, avenues " and public places, within said District. Section 9. Said assessment and taxes shall be payable in seven annual installments, with six per cent. annual interest on deferred payments, commencing with the year 1928, but this provision shall not be construed to prevent full payWent at any time. Seotion 10. That the regular session of the Commission of the City of Bozeman, State of Montana, to be held in the said Commissions room in the City Hall of said ~ity of Bozeman, on Friday, the 25th day of May, 1928, at I four 0' clock P 1.1 of said day, are the time and place designated when and where the said Commission will hear and pass upon all protests, duly and regularly made and filed, against said proposed improvement, and the creation of said ....- -.- 24~-) ... ....----- .. proposed Special Improvement ~istrict, and the extent and character thereof, or of either thereof. Section 11. NOTICE. ------ I NOTICE IS HEREB~ GIVEN That at a regular meeting of the liomrnission of the liity of Bozeman, ~tate of Mon~ana, held on Friday, the 4th day of May, A D 1928, a Resolution was duly passed and adopted by said liommission declaring it's intention to create a Special Improvement District to be known and deSignated as "Special Improvement District No. 270tt of said City, for the purpose of grading; paving with two course crushed gravel macadam pavement and installing such drain- age culverts as may be necessary, on all that portion of l~orth Grand Avenue between the north line of West Villard Street and the north line of West Short Street within said ~ity of Bozeman, Montana, and declaring it to be the intention of said vommission to specially assess the entire cost and expense of making such improvements against the entire ~istrict, each lot or parcel of land within said District to be assessed for that portion of the whole cost that the lineal feet of said lot bordering or abutting on said North Grand Avenue bears to the total North Grand Avenue frontage, exclusive of streets, avenues, alleys and public places, within said district. I That the estimate of the approximate cost of constructing said improvement is $ 1827.00; that the total frontage of the property within said District to be assessed and taxed for said improvement is 1026.6 lineal feet, 244 --- and that the estimated cost per front foot of said property to be so specially assessed and taxed, is ~ 1.78 That Friday, the 25th day of May, 1928, at 4 o'clock ~ M of said I day and the Commission Chamber of said vi ty of Bozeman, State of Montana, has been designated as the time when and place where the said uommission will hear and pass upon all protests that may be made aga.inst the proposed work or against the extent or creation of said District to be assessed, or Of either, both, or any thereof. Such protests, if any, must be filed with the Clerk of said Com- mission, in writing, within fifteen days after the date of the first publication of this notice. That for a description of the boundaries of said proposed Special Improvement District ~o. 270, reference is hereby made to Commission Resolution ho. 102, declaring the intention of said vommission to create said district, which is now on file in the office of the ~lerk of said Commission of the ~ity of Bozeman, M.ontana.
