HomeMy WebLinkAboutResolution 110 Creating SID No. 272 262 -----.....-" - ._"...n .----.-------.."'...- .. ---.. -... -..----.----------....--....- COMMISSION RESOLUTION NO. 110 A RESOLUTION OF THE COMMISSION OF .THE CITY OF BOZEMAN, MONTANA, CREATING SPECIAL IMPROVEMENT DISTRICT NO. 272 OF THE CITY OF I BO ZE1ULN , STATE OF MONTANA, FOR THE PURPOSE OF PAVING WITH TWO- COURSE CRUSHED GRAVEL MACADAM PAVEMENT ON SOUTH GRAND A VENUE BETWEEN THE SOUTH LINE OF WEST CLEVELAlJD STREET AND THE NORTH CURB LINE OF WEST ARTHUR STREET, ALL WITHIN SAID CITY, AND TO SPECIALLY ASSESS THE ENTIRE COST AND EXPENSE OF lUUiING SAID IMPROVEMENTS AGAINST TEE PROPERTY WITHIN SAID DISTRICT UNDER AND BY VIRTUE OF THE PROVIS IONS OF SECTIONS 5225 TO 5277 INCLU-' SIVE, OF THE REVISED CODES OF MONTANA, 1921, AND ANY AMENDMENTS THERETO. WHEREAS, at a regular session of the Conmission of the City of Bozeman~ State of Montana, held on the 15th day of June, A. D., 1928, the sai4 Commission duly passed Conmlssion Resolution No. 109 decla.ring it to be the intention of said Commission to create a special improvement district to be known and designated as Speoial Improvement DistriQt No. '272 of said City, for the purpose of paving with Two-Course Crushed Gravel Macadam Pavement, on South Grand Avenue between the south line o-r West Cileyeland Street and the North curb line of West Arthur Street, all wi thin said city, and to specially assess the entire cost and expense of making said improvements against the property within said district under and by virtue of the provisions of Seotions 5225 to 5277 inclusive, whioh said Commission Resolution~o. 109 is hereby referred to and made a part hereof for further I particulars in respect to the boundaries of said district, the estimated cost of said i~provement and the method of assessing the same against the property within said district. AND WHEREAS, Notice of the passage of Commission Resolution No. 109 was duly published in the Bozeman Weekly Chronicle, a weekly newspaper printed and published in said City of Bozeman, to-wit: In the issue of June 21, 1928, and by sending a copy of suoh notice by registered mail, to each person firm or corpora- tion, or agent of such person firm or oorporation having property within the proposed district at his last known address upon the same day such notice was first published as aforesaid, and due proof having beeD made of the publication of said notice; AND WHEREAS, within the time provided by law and published notice there were filed with the Clerk of the Commission no protests against the proposed work and against the creation and extent of said district to be assessed; and the said Commission was in regular session on the 6th day of July, 1928, at four o'clock P. M., of said day, at the Commission Chamber in the City Hall Building in the said I Cit.y of Bozeman. the same being the time and plaoe designated for hearing and passing upon all protests, if any, against the proposed work or against the oreation or extent of said district, or both; and the total frontage of all property within said district to be assessed being 600 lineal feet, as stated in Commission Resolution No. 109, and the frontage of all property within said district ---. ~ -.--.--------.-- ----...---..-... 26;) .___.". .n.."._ .__.:_.._.._0:"'...'. . -....---..--.------- ...--.-------- owned by persons protesting being no liDeal feet, and the same being no per cent of the total frontage and leaa than 40 per cent thereof, said protests were, by I regu.lar vote of said Commission, duly over-ruled; and it further appearing that all of the proceedings fororeation of said distriot have been oomplied with; BOW, THEREFORE, BE IT RESOLVED BY THE COWISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Sec. 1. ~hat said Speoial Improvement District No. 272 of the City of Bozeman, State of Montana, be and the same is hereby oreate~ for the purpose of making the impDOvements therein as hereinafter Aescribed. Sec. 2. That said specialim,provements be, and the same are, hereby ordered to be made in said Speoial Improvement Distriot No. 272 as follows: The paving with two course crushed gravel maoadam pavement On South Grand Avenue between the south line of West Cleveland street am the North ourb line of West Arthur Street, all within said City. lec. 3. That the entire cost and expense of making the speoial improve- ments herein set forth in said Speoial Improvement Distriot No. 272 shall be paid by Speoial Improvement Distriot Bonds of the denomination of One Hundred Dollars each, and in fractions where necessary, to be issued and ohargeable against a fund I to be known as Special Improvement Distriot No. 272 Fund; said bonds to be redeem- able at the option of the City of Bozeman, Montana, whenever funds are available for that purpose from said Special Improvement District No. 272 Fund; said bonds shall draw simple interest at the rate of six per cent per annum, which shall be chargeable as a part of the cost of said speoial improvement and shall run from the date of the registration of said bonds until said bonds are paid; and such interest, from the date of the registration of the bonds until the payment of the first installment, will be collected by the Director of Finance of said City 'of Bozeman at the time of oollecting such first installment; that the entire cost and expense of making said improvement within said district shall be .defrayed by a ~ecial assessment against the entire district, eaoh lot or paroel of land within said district wherein ,the improvements shall be made, to be assessed for its proportion of such expense, each lineal foot of the frontage of suoh lots or parcels of land within said Speoial Improvement Distriot No. 272 ..elusive of streets, avenues, alleys and public plaoes, to be assessed for its proportionate share of such entire cost; that the &mount asse~ed against each lot or parcel I of land shall be paid in equal annual installments extending over a period of six years. Section 4. That the Clerk of the Commission be, and he is hereby direoted to publish a notioe inviti,ng proposals for the furnishing of materials, the doing of the work and making of said improvements in said Speoial Improvement District , No. 272, referring to plans and specifications on file, b7 publishing the same in I two issue. of the Bozeman Daily Chroniole, a daily newspaper printed and published ' in the said City of Bozeman, not less than ten days before the time the bids will be opened, which shall be at a meeting of the Commission to be held on Friday, the 27th day of July, 1928.
