HomeMy WebLinkAboutResolution 109 Create SID No. 272 .- -.- 259 COMMISSION RESOLUTION NO. 109 A RESOLUTION OF THE COmUSSION OF THE CITY OF BOZEMAN, MONTANA I DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AND DESIGNATED AS SPECIAL IMPROVEMENT DISTRICT NO. 272 OF SAID CITY, FOR THE PURPOSE OF GRADING AND PAVING WITH TWO COURSE CRUSHED GRAVEL MACADAM PAVEMENT ON SOUTH GRAND AVENUE BETWEEN THE SOUTH LINE OF WEST CLEVELAND STREET AND THE NORTH CURB LINE OF WEST ARTHUR STREET, WITHIN SAID CITY, AND TO SPEC IALLY ASSESS THE ENTIRE COST AND EXPENSE OF MAKING SAID IMPROVE1~ENT AGAINST THE LAND WITHIN SAID DISTRICT AS CREATED. BE IT RESOLVED BY TIm COMMISSION OF THE CITY OFBOZE1~: Section 1. That it is hereby declared to be the intention of the Commission of the City of Bozeman, state of Montana, to create a Special Improvement District to be known and designated as Special Improvement Dis- trict No. 272 of said City, for the purpose of making the improvements within said Special Improvement District hereinafter described. Seotion 2. That the boundaries of said Special Improvement District No. 272, to be created, are as follows: Beginning at apoint in the south line of West Cleveland street, where the same is interseoted by the east line of the alley between Grand Avenue South am Third. Avenue South; thence south along the east line of said alley to the north curb line of West Arthur street; thence east along the north curb line I of West Arthur street to the west line of the alley between Grand Avenue South and Wi11son Avenue South; thence north along the west line of said alley to the south line of West Cleveland Street; thence west alo#g the south line of said West Cleveland Street to the place of beginning, all in the City of Bozeman, Montana. Section 3. That it is hereby deolared to be the opinion of said Commission of the City of Bozeman, state of Montana, that all of the land within said proposed Special Improvement District as defined in Seotion 2 of this Resolution, whether abutting on said improvement or not, will be specially and equally benefitted by the grading and paving, and all of said improvements, and should equally bear the cost of said improvement in accordance with the laws of the State of Montana, in such case made and ~rovided. Section 4. That the character of the improvement to be made within said Special Improvement District No. 272 is the grading and paving with two- course crushed gravel Macadam pavement on all that portion of South Grand Avenue in the said City of Bozeman, Montana, between the south line of West Cleveland street and the north curb line of West Arthur street. Section 5. That an approximate estimate of the cost of doing all of I the work of constructing all of said improvement, inclusing grading, paving, engineering, inspection and all incidental expenses is Nine Hundred Fourteen and 60/100 Dollars ($914.60). Section 6. That the total frontage of the land within said proposed district to be taxed for the cost of said improvement, exclusive of streets, avenues,ai1eys and public places, is six hundred 1600) lineal feet, and an approxiamte estimate of the cost of said improvement to be specially taxed and assessed against the land there-in, is $1.524 per front foot of said land; the - 260 .- term "front foot" referring to the number of lineal feet fronting or abutting, upon said South Grand Avenue within said proposed district. Section 7. That the entire cost and expense of making the speoial I improvements herein set forth in said Special Improvement District No. 272 shall be paid by Special Improvement District Coupon Bonds, as authorixed by the laws of the State of Montana, which bonds shall be in the denomination of One Hundred Dollars ($100.00) each, or fractions thereof where neoessary, to be issued and chargeable against a fund to be known as "Speoial Improvement District No. 272 Fund", said bonds to be redeemable at the option of the City of Bozeman, Montana, whenever funds are available for that purpose from said Special Improvement District No. 272 Fund. Said bonds shall draw simple interest at the rate of six per onet per annum. which interest shall be chargeable as a part of the cost at said improvement, and shall run from the date ot registration ot said bonds until said bonds are paid. Seotion 8. To 1>8.Y said bonds and interest thereon. representing the cost of said improvement, a speoial assessment shall be levied against all of the lands within said proposed Special Improvement Distriot No. 272, as hereinbefore detined; each lot or parcel of land within said District to be assessed for that portion of the whole cost in the proportion that the lineal feet ot said I lot or parcel of land bordering or abutting on said South Grand Avenue bears to the total South Grand Avenue frontage, exclusive ot streets. alleys, avenues and publio plaoes, within said District. Seotion 9. Said assessment and taxes shall be payable in seven annual installments, with six per cent annual interest on deterred payments, oommencing with the year 1928, but this provision shall not be oonstrued to prevent full payment at any time. Section 10. That the regular session of the Commission of the City of Bozeman. state of Montana, to be held in the said Commission's room in the City Hallot said City of Bozeman. on Friday, the 6th day of July, 1928, at tour o'clock P. M. of said day are the time and place desginated when and where the said Commission will hear am pass upon all protests, duly and regularly made and filed, against said proposed improvement, and the oreation of said proposed Special 1mprovement Distriot, and the extent and charaoter thereof, or of either thereof. Seot ion 11.' That the Clerk of the said Commission of the City of I Bozeman. state of Montana, ,be, and he is hereby directed to give notice as required by law. of the adoption of this Resolution. Passed by the Commission of the City of Bozeman, Montana, and approved by the Mityor of said City, this 15th day of June, A. D., 1928. D. 1928, a Resolution was duly passed and adopted by said Commission deolaring its intention to create a Speoial Improvement Distriot to be known and designated as "Speoial Improvement District No. 272" of said City, for the purpose of grading and paving with two-course crushed gravel Macadam pavement on all that portion of South Grand Avenue between the south line of West Cleveland street and the north ourb line of West Arthur Street within said City of Bozeman, Montana, and declaring it to be the intention of said Commission to specially assess the entire cost and expense of making such improvements against the entire District, eaoh lot or parcel of land within said District to be assessed for that portion of the whole oost that the lineal feet of said lot bordering or-abutting on said South Grand Avenue bears to the total South Grand Avenue frontage, exolusive of streets, avenues, alleys and publio plaoes, within said distriot. That the estimate of the approximate cost of oonstructing said improve- ment is $914.60; that the total frontage of the property within said Distriot to be assessed and taxed for said improvement is 600 lineal feet, and that the estimated cost per front foot of said property to be so specially assessed and taxed, is $1.524. That Friday, ~he 6th day of July, 1928, at 4 o'olock P. M. of said day and the Commission hamber of said City of Eozeman, State of Montana; has been designated as the time when and place where the said Commission will hear and pass upon all protests that may be made against the proposed work or against the extent or oreation thereof. Such protests, if any, must be filed with the Clerk of said Commission, in writing, within fifteen days after the date of the first publication of this notioe. That for a desoription of the boundaries of said proposed Special Improvement Distriot No. 272, reference is hereby made to Commission Resolution No. 109, declaring the intention of said Commission to oreate said district, which is now on file in the office of the Clerk of said Commission of the City I of Bozeman, Montana.
