COM1:ISSION RESOLUTION NO. 106.
A RESOLUTION OF THE C01tMISSION OF THE CITY OF BOZEW~N, MONTANA,
CREATING SPECIAL IMPROVEMENT DISTRICT NO. 270 OF THE CITY
OF
BOZE1~N, STATE OF MONTANA, FOR THE PURPOSE OF PAVING WITH
TWO
I
COURSE CRUSHED GRAVEL MACADAM PAVEMENT AND INSTALLING SUCH
DRAINAGE CULVERTS AS MAY BE NECESSARY ON NORTH GRAND AVENUE
BETWEEN THE NORTH LINE OF WEST VILLARD STREET AND THE NORTH
LINE OF WEST SHORT STREET, ALL WITHIN SAID CITY, AND TO SPE-
CIALLY ASSESS THE ENTIRE COST AND EXPENSE OF MAKING SAID IM-
PROVEMENTS AGAINST THE PROPERTY WITHIN SAID DISTRICT UNDER
AND
BY VIRTUE OF THE PROVISIONS OF SECTIONS 5225 to 5277 INCLUSIVE,
OF THE REVISED CODES OF MONTANA, 1921, AND ANY AM:ENDMENTS
THERETO.
WHEREAS, At a regular session of the Commission of the City
of Bozeman, state of Montana, held on the 4th day of May,
A. D. 1928, the said
Commission duly passed Commission Resolution No. 103 declaring
it to be the
intention of said Commission to create a special improvement
district to be known
and designated as Special Improvement District No. 270 of
said City, for the
purpose of paving with two course crushed gravel macadam pavement,
and installing
such drainage oulverts as may be necessary on North Grand
Avenue between the
north line of West Villard Street and the North line of West
Short Street, all
within said city, and to specially assess the entire cost
and expense of making
said improvements against the property within said district
under and by virtue
of the provisions of Sections 5225 to 5277 inclusive, which
said Commission
Resolution No. 103 1s hereby referred to and made a part hereof
for further I
particulars in respect to the boundaries of said district,
the estimated cost
of said improvement, and the method of assessing the same
against the property
within said district.
AND WHEREAS, notice of the passage of Commission Resolution
No. 103 was dUly published in the Bozeman Wee~ly Chronicle.
a weekly newspaper
printed and published in said City of Bozeman, to-wit:
In the issue of April
la, 1928. and by sending a copy of such notice by registered
mail, to each person,
firm or corporation, or agent of such person, firm or corporation
having property
within the proposed district at his last known address upon
the same day such
notice was first published as aforesaid, and due proof havin8heen
made of the
pUblication of said notice;
AND WHEREAS, within the time provided by law and published
notice there were filed with the Clerk of the Commission
, pr6tests
against
the proposed work and against the creation and extent of said
district to be
assessed; and the said Commission was in regular session on
the 25th day of May, I
1928, at four o'clock P M of said day, at the Commission Chamber
in the City Hall
BUilding in the said City of Bozeman, the same being the time
and place designated
for hearing and passing upon all protests, if any, against
the proposed work or

against the creation or extent of said district, or both; and the total frontage
of all property within said district to be assessed being 1026.6 lineal feet, as
I stated in Commission Resolution No. 103. and the frontage of all property within
said district owned by persons protesting being lineal feet. the same being
of said total front~ge and less than 40% thereof, said protests were, by
regular vote of said Commission, duly overruled; and it further appearing that all
of the proceedings for c~eation of said district have been complied with;
NOW THEREFORE, be IT RESOLVED BY THE CO~:ISSION OF THE CITY OF
BOZENLAN, STATE OF MONtANA:
Sec. 1. That said Special Improvement District No. 270 of the
City of ~ozeman, State of Montana, be and the same is, hereby created for the
purpose of making the improvements therein as hereinafter described.
Sec. 2. That said special Improvements be, and the same are,
hereby ordered to be made in said Special Improvement District ~o. 270 as
follows:
The paving with two course crushed gravel macadam
pavement and installing such drainage culverts as
may be necessary on North Grand Avenue between the
north line of West Villard Street and the ~orth line
of West Short Street, all within said City.
I Sec. 3. That the entire cost and expense of making the special
improvements herein set forth in said Special Improvement District ~o. 270 shall
be paid by Special Improvement District Bonds of the denomination of One Hundred
Dollars each, and in fractions where necessary, to be issued and chargeable against
a fund to be known as Special Improvement Vistrict No. 270 Fund; said bonds to be
redeemable at the option of the ~ity of Bozeman, Montana, whenever funds are
available for that purpose from said ~pecial Improvement ~istrict ~o. 270 Furld;
said bonds shall draw simple interest at the rate of six per cent per annum,
which shall be chargeable as a part of the cost of said special improvement and
shall run from the date of the registration of said bonds until said bonds are
paid; and such interest, from the date of the registration of the bonds until the
payment of the first installment, will be collected by the Director of Finance
of said City of Bozeman at the time of collecting such first installment; that
the entire cost and expense of said improvement within said district shall be
defrayed by a special assessment against the entire district, each lot or
I parcel of land within said district wherein the improvements shall be made, to be
assessed for its proportion of such expense, each lineal foot of the frontage of
such lots or parcels of land within said Special Improvement District No. 270

exclusive of streets, avenues, alleys and public places, to
be assessed for its
proportionate share of such entire cost;
that the amount assessed against each
lot or parcel of land shall be paid in equal annual installments
extending over I
a period of six years.
Section 4. That the City Engineer
be, and he is hereby directed
to prepare plans and specifications for the doing of said
work and making said
improvements.
Section 5. That the Clerk of
the Commission be, and he is hereby
directed to publish a notice inviting proposals for the furnishing
of materials,
jhe doing of the work and making of said improvements in said
Special Improvement
District No. 270, referring to plans and specifications on
file, by publishing
the same in two issues of the Bozeman Daily Chronicle, a daily
newspaper printed
and published in the said City of Bozeman, not less than ten
days before the
time such bids will be opened, which shall be at a meeting
of the Commission to
be held on Friday, the 8th day of June, 1928.
Passed and adopted by the Commission of the City of Bozeman
at a regular session thereof, held on the 25th day of May,
1928.
