COMMISSION RESOLUTION NO. 105 A RESOWTION OF THE COM1nSSION OF THE CITY OF BOZEMAN, MONTANA, I CREATING SPECIAL IMPROVEMENT DISTRICT NO. 269 OF THE CITY OF BOZEMAN, STATE OF MONTANA, FOR THE PURPOSE OF CONSTRUCTING A SANITARY SEWER ON EAST ~..ENDENHALL STREET BETWEEN WALLACE AND IDA AVENUES WITHIN SAID CITY, AND TO SPECIALLY ASSESS THE EN- TIRE COST AND EXPENSE OF MAKING SAID IMPROVEMENTS AND THE MAINTENANCE THEREOF AGAINST THE PROPERTY WITHIN SAID DISTRICT, UNDER AND BY VIRTUE OF THE PROVISIONS OF SECTIONS 5225 to 5277 INCLUSIVE, OF THE REVISED CODES OF MONTANA, 1921, AND ANY AMENDMENTS THERETO. WHEREAS, at a regular session of the vommission of the Gity of Bozeman, State of Montana, held on the 4th day of May, A D 1928, the said Com- mission duly passed Commission Resolution No. 102 declaring it to be the inten- tion of said Commission to create a special improvement district to be known and designated as Special Im);)rovement District No. 269 of said City, for the purpose of constructing a sanitary sewer on East Mendenhall Street between Wallace and Ida Avenues, all within said ~ity, and to specially assess the entire cost and expense of making said improvements against the property within said district under and by virtue of the provisions of Sections 5225 to 5277 inclusive, of the Revised Codes of Montana, 1921, and any amendments thereto, which said ~ommission iesolution No. 102 is hereby referred to and made a part hereof for further I partioulars in respect to the boundaries of said district, the estimated cost of said improvement and the method of assessing the same against the property within said district. AND WHEREAS, Notice of the passage ot ~ommission Resolution No. 102 was duly published in the Bozeman Weekly Chronicle, a weekly newspaper printed and published in said City of Bozeman, to-wit: in the issue of May l~, 1928, and by sending a copy of such notice by registered mail, to each person, firm or corporation, or agent of such person, firm or corporation having property within the proposed district at his last known address upon the same day such notice was first published as aforesaid, and due proof having been made of the publication of said notice; AND WHEREAS, Within the time provided by law and pUblished notice there were filed with the Glerk of the Commissio~o protests against the proposed work and against the creation and extent of said district to be assessed; and the said Uommission was in regular session on the 25th day of May, 1928, at four oiclock P M of said day, at the Commission Chamber in the City I Hall Building in the said vity of Bozeman, the same being the time and place designated for hearing and passing upon all protests, if any, against the proposed work or against the creation or extent of said district, or both; and the total ., .,-- 250 .-.-- frontage of all property within said district to be assessed being 684 lineal feet, as stated in Commission Hesolution No. 102 and the frontage of all property I withih said district owned by persons protesting being lineal feet, the same being of said total alley frontage and less than 40~ thereof, said protests were, by regular vote of said Commission, duly over-ruled; and it further appearing that all of the proceedings for the creation of said district have been complied With. NOW THEREIJORE, BE IT RESOLVED BY THE C01v'[MISSION OF THE CITY OF BOZEMAN, STATE OF MONTANA: Se c . I. That said Special Improvement ~istrict No. 269 of the City of .!:3ozernan, State of Montana, be, and the same is, hereby created for the purpose of making the improvements therein as hereinafter described. Sec. 2. That said special improvements be, and the same are, . hereby ordered to be made in Special Improvement District No. 269 as follows: constructin~ a sanitary sewer on East Mendenhall treet between Wallace and Ida Avenues. Sec. 3. That the entire cost and expense of making the special improvements herein set forth in said Special Improvement District No. 269 I shall be paid by Special Improvement District Bonds of the denomination of One HundDed Dollars each, and in fractions where necessary, to be issued and chargeable against a fund to be known as Special Improvement District No. 269 Fund; said bonds to be redeemable at the option of the City of Bozeman, Montana, whenever funds are available for that purpose from said Special Improvement District No. 269 Fund; said bonds shall draw simple interest at the rate of six per cent per annum, which shall be chargeable as a part of the cost of said special improvement, and shall run from the date of the registration of said bonds until said bonds are paid; and such interest, from the date of the registration of the bonds until the payment of the first installment, will be collected by the Director of Finance of said City of Bozeman at the time of collecting such first installment; that the entire cost and expense of' said improvement wi thin said distriot shall be defrayed b;" a special assessment against the entire district, each lot or parcel of land within said district wherein the improvements shall be made, to be assessed for its proportion of such expense, each linear foot of the frontage of such lots or parcels of land within said I Special Improvement ~istriot No. 269 exclusive of streets, avenues, alleys and public places to be assessed for its proportionate share of such entire cost; that the amount assessed against each lot or parcel of land shall be paid in anual equal installments extending over a period of seven years. ~51 , Sec. 4. That the City Engineer be, and he is hereby directed to prepare plans and specifications for the doing of said work and making said I improvements. Sec. 5. That the Clerk of the vommission be, and he is hereby directed to publish a notice inviting proposals for the furnishing of materials, the doing of the work and making of said improvements in said Special Improvement District No. 269 referring to plans and specifications on file, by publishing the same in two issues of the Bozeman Daily Chronicle, a daily newspaper printed and published in the said City of Bozeman, not less than ten days before the time such bids will be opened, which shall be at a meeting of the Commission to be held on Frid~, the 8th day of June, 1928. Passed and adopted by the Commission of the City of Bozeman at a regular session thereof, held on the 25th day of May, 1928. Approved by the Mayor on the 25th day of May, 1928.
